High Court direct MOEF & Uttaranchal to file affidavit on status of
GRA and Co-ordination Committee


In the petition filed by N.D. Jayal & Shekhar Singh the High Court of Uttaranchal give several direction to the Ministry of Forest and Environment (MoEF) and state of Uttaranchal. This petition has been filed in the continuation of Supreme Court Judgment dated 1-9-05 to ensure monitoring by the High Court.
Supreme Court in its judgment has said that no submergence or impoundment should take place unless all the requirement of rehabilitation and environmental conditions are fulfilled.
The High Court directed the MoEF to file an affidavit giving all the particulars to enable the High Court to do monitoring as per the Supreme Court direction. It is the MOEF which has been filing reports & granting clearance to the Dam Project.
Tunnel-1 was closed on MOEF instance & now closer of tunnel-2 is also cleared. This has been done without all the aspects of rehabilitation & environment conditions being fully compiled with all respects. The High Court also directed the UA to file an affidavit providing the details of functioning of Grievance Redressal Authority (GRA); Co-ordination Committee and their periodical meetings. The petitioners have alleged that GRA headed by S.D.M. is non-functional & the co-ordination committee meeting has also not taken placed.
The High Court reiterated, on apprehension off closer of tunnel-2 illegally by THDC that direction have already been given for not closing the said tunnel.
It is record on that Catchment Area Treatment Plan; Flora; Fauna; water quality management are all incomplete; the command area development plans are not even been submitted and cleared.
Rehabilitation is not only incomplete in; as much as in several village even land acquisition procedure have not been completed; R/R sites have also not been developed. Basic civic amenities are like Primary Health Centre, Pahchayat Bhawan, Barat Ghar, School and Shopping complex; irrigation and drinking water, roads, electricity etc. are totally incomplete in all new R/R sites.
There is, therefore, total non-compliance of Supreme Court direction by MOEF, Uttaranchal Govt. and THDC.
Development for all, not only for few.
