जून 2013 की त्रासदी के लिये जिम्मेदार जी0वी0के0 बांध कंपनी पर नौ करोड़ का मुआवज़ा व जुर्माना
प्रभावितो ने जीत मनाई/ एन जी टी को धन्यवाद दिया / सरकार से कार्यवाही की अपेक्षा की 

उत्तराखंड में जी0वी0के0 कंपनी के अलकनंदा नदी पर बने श्रीगर बांध के कारण तबाह हुयी संपत्ति के मुआवजें के लिये ‘‘श्रीनगर  बाँध  आपदा  संघर्ष  समिति‘‘  और ‘‘माटू जनसंगठन‘‘ ने अगस्त 2013 में राष्ट्रीय हरित प्राधिकरण में एक याचिका दायर की थी। राष्ट्रीय हरित प्राधिकरण ने लगभग 18 बार सुनवाई के बाद 19 अगस्त 2016 को उत्तराखंड के लिये ऐतिहासिक फैसला दिया। अपने इस फैसले में माननीय न्यायाधीश यू0 डी0 साल्वी व माननीय विशेषज्ञ सदस्य ए0 आर0 यूसुफ ने जी0वी0के0 कंपनी को जून 2013 आपदा में श्रीनगर में तबाही के लिये जिम्मेदार ठहराते हुये प्रभावितों को 9]26]42]795 करोड़ रुपये का मुआवजा देने व प्रत्येक वादी को एक लाख रुपये देने का आदेश दिया है। 

ज्ञातव्य है कि जी0वी0के0 कंपनी के बांध के कारण  श्रीनगर शहर के शक्तिबिहार] लोअर भक्तियाना] चौहान मौहल्ला] गैस गोदाम] खाद्यान्न गोदाम] एस0एस0बी0] आई0टी0आई0] रेशम फार्म] रोडवेज बस अड्डा] नर्सरी रोड] अलकेश्वर मंदिर] ग्राम सभा उफल्डा के फतेहपुर रेती] श्रीयंत्र टापू रिसोर्ट आदि स्थानों की सरकारी/अर्द्धसरकारी/व्यक्तिगत एवं सार्वजनिक सम्पत्तियंा बुरी तरह से क्षतिग्रस्त हुई थी।

‘‘श्रीनगर  बाँध  आपदा  संघर्ष  समिति‘‘  और ‘‘माटू जनसंगठन‘‘ राष्ट्रीय हरित प्राधिकरण के इस जनपक्षीय आदेश का स्वागत करते है। इस आदेश ने सिद्ध किया है कि जून 2013 की त्रासदी में बांधों की बड़ी भूमिका थी। माटू जनसंगठन ने जून 2013 की आपदा में बांधों की भूमिका का मुद्दा हर स्तर पर उठाया था। विधायकांे, सांसदों हर बड़े राजनैतिक दलों को पत्र भेजा था, मिले थे। अफसोस कि सभी इस सवाल पर मौन ही रहे। अब इस आदेश के बाद सरकारें जागेंगी और नदी व लोगो के अधिकारों का हनन करने वाली बांध कंपनियों पर लगाम लगायेंगी। यह आदेश ना केवल उत्तराखंड वरन् देशभर में बांधों के संदर्भ में अपनी तरह का पहला आदेश है। देशभर के बांध प्रभावित क्षेत्रों के लिये यह नया रास्ता दे रहा है। कही भी बांधों के कारण होने वाले नुकसानों के लिये यह आदेश एक नजीर होगा।

प्राधिकरण का आदेशः-

1. प्रतिवादी संख्या 1- अलकनंदा हाइड्रो पावर कंपनी लिमिटेड इस आदेश की तिथि के 30 दिन की अवधि के अंदर सार्वजनिक देयता बीमा अधिनियम] 1991 की धारा 7 (ए) के तहत स्थापित पर्यावरण राहत कोष प्राधिकरण के माध्यम से श्रीनगर शहर में जून] 2013 के बाढ़ पीड़ितों को मुआवजा के तौर पर 9]26]42]795 करोड़ रुपये की राशि जमा करेगी.

2. नेशनल ग्रीन ट्रिब्यूनल (अभ्यास और प्रक्रिया) नियम, 2011 के नियम 12 के तहत, जमा किए जाने वाले मुआवजे की राशि से 1 प्रतिशत राशि कटौती करके कोर्ट फीस के तौर पर रजिस्ट्रार, नेशनल ग्रीन ट्रिब्यूनल को सौंप दिया जाएगा. 

3. प्रतिवादी संख्यां 3 - उत्तराखंड राज्य सरकार, व्यक्तियों के दावे के समर्थन में आवश्यक सबूत के साथ अनुलग्नक ए-5 में संलग्न सूची के अनुसार उनके दावों की सूची की निगरानी के लिए कोई वरिष्ठ उप संभागीय मजिस्ट्रेट को तैनात करने के लिए पौड़ी जिले के जिलाधिकारी को आवश्यक निर्देश जारी करेगी। इसके लिए नियुक्त एसडीएम पेश किए जाने वाले सबूतों के आधार पर दावों को सत्यापित करेगा और दावे की प्रात्रता के आधार पर अनुलग्नक ए-5 की सूची के अनुसार देय कोर्ट फीस की राशि के तौर पर 1 प्रतिशत कटौती करके उस व्यक्ति को सौंपेगा। दावे आमंत्रित करने की घोषणा जिलाधिकारी कार्यालय, श्रीनगर नगरपालिका कार्यालय एवं उत्तराखंड राज्य के वेबसाइट में एक नोटिस प्रकाशित करके की जाएगी। इस नोटिस के प्रकाशन के 90 दिनों के बाद जिलाधिकारी द्वारा नो-क्लेाम (कोई दावा शेष नहीं) दायर किया जाएगा। इस तरह उपरोक्त राशि के वितरण के बाद शेष राशि बाढ़ द्वारा प्रभावित सार्वजनिक संपत्ति की बहाली के उपाय के तौर पर पर्यावरण राहत कोष में उपयोग किया जाएगा.

4. प्रतिवादी संख्या 1 लागत की रकम के रुप में आवेदकों और प्रतिवादी संख्या 4 सहित प्रत्येक को एक-एक लाख रुपए की राशि का भुगतान करेगा।  

5. इस प्रकार 2014 के मूल आवेदन संख्या 3 का निपटारा हो गया है।

प्राधिकरण ने अपने 42 पन्नों के आदेश में बहुत विस्तृत रुप से लिखा है कि जी0वी0के0 कंपनी ने लगातार पर्यावरणीय शर्ताे का उलंघन किया जिसके कारण बाढ़ में बांध की मक तबाही का कारण बनी। विभिन्न रिर्पोटे बताती है कि जहंा मक डाली जाती है वहाँ सुरक्षा दीवार व मक पर पेड़ लगाना, जाली लगाना किया जाना चाहिए। मगर बरसों से नदी किनारे मक रखी गई पर फिर भी उस पर पेड़ नही लगाए गये। प्राधिकरण ने माननीय सर्वोच्च न्यायालय के आदेश पर बनी रवि चोपड़ा समिति की रिर्पोट को भी देखा जिसने मौके पर मुआयना किया था। प्राधिकरण ने बांध कंपनी की इन दलीलो को मानने से इंकार किया कि यह क्षेत्र बाढ़ प्रभावित क्षेत्र में आता है, यह ईश्वरीय  कारणांे से हुआ।  

मालूम हो की अभी तक राज्य सरकार ने बाढ़ क्षेत्र को परिभाषित नही किया है। 

उत्तराखंड  सरकार  के  वकील  ने  अपना पक्ष रखते हुये पहले  तो  यह  सिद्ध  करने  की  कोशिश  की कि यह  मुक़दमा  सुनने  लायक  ही  नही  क्यूंकी यह  ईश्वरीय  कारणांे  से  हुआ है और  इसमंे जी0वी0के0 कंपनी का कोई  दोष  नही  है। किन्तु प्राधिकरण ने अपने आदेश के पैरा 19 में कहा है कि राज्य सरकार वादियों के, जी0वी0के0 कंपनी को दोषी ठहराने के, कियी तर्क का खंडन नही कर पायी है। 

हम विशेष आभारी है लीगल ‘‘इनीशियेटिव फॅार फॅारेस्ट एण्ंड एन्वायरंमैंट‘‘ के वकील रित्विक दत्ता व वकील राहुल चौधरी जिन्होने बिना फीस लिये इस याचिका पर बहस की। सुनवाई के दौरान दखल  याचिकाकर्ता डॉ. भरत झुनझुनवाला के भी हम आभारी है जिन्होने प्राधिकरण के सामने जी0वी0के0 कंपनी  द्वारा किये गये पर्यावरण शर्तो के उलंघन संबधी सभी तथ्य रखे।

हमारी मांगे 
उत्तराखंड सरकार प्राधिकरण के आदेशानुसार तुरंत पौड़ी के जिलाधिकारी को आवश्यक निर्देश दे। इस तथ्य पर ध्यान दिया जाये कि मुआवजा वितरण की प्रक्रिया बिना भ्रष्टाचार के पूरी हो।

जब यह सिद्ध हो गया है कि श्रीनगर के एक हिस्से में बाढ़ के लिये जी0वी0के0 कंपनी जिम्मेदार है। तो शासन-प्रशासन को तुरंत जी0वी0के0 कंपनी पर आपराधिक कार्यवाही की प्रक्रिया शुरु करनी चाहिये। उसे जानबूझ कर की गई लापरवाहियों के लिये दण्डित किया जाये।  ताकि भविष्य के लिये वे सावधान रहे।

न्यायपालिका ने अपना कार्य पूरा किया है अब शासन-प्रशासन को अपनी भूमिका अदा करते हुये न्याय को लोगो तक पंहुचाना है।

GVK Company held responsible for June 2013 Disaster, fine rupees 9 crore.
Affected people Happy / Gave thanks to NGT/ Hope Government take action accordingly 


On 19th august National Green Tribunal (NGT) after 18 hearings gave a historic verdict on the petition filed in august 2013 by Srinagar Bandh Aapda Sangharsh Samiti and Matu Jansangathan for the compensation against the destruction and damage caused during 2013 disaster because of srinagar dam constructed over Alaknanda river by GVK company Uttrakhand. Hon’ble Justice U.D Salvi, judicial member and Hon’ble Prof. A.R. Yousuf , expert member held GVK company responsible for 2013 disaster and ordered to compensate the affected people with rupees 9,26,42,795 Rs. and 1 lakh per petitionor. 

Srinagar Bandh Aapda Sangharsh Samiti and Matu Jansangathan welcomes NGT’s pro people order. This verdict proved that rapid dam construction is the major reason for 2013 disaster. Matu Jansangathan raised voice on the role of dams  in 2013 disaster at every level including parliament, legislation and famous politicians but unfortunately nobody uttered a word. Now after NGT’s order political parties will control such dam companies who abuses people’s right. This is ever first order by NGT  in the Hydro Power Projects. It will give a new way to the Hydro Power Project affected people.  

Oprative part of NGT’s order  :-

1. Respondent no.1- Alaknanda Hydro Power Co. Ltd. shall deposit an amount of Rs 26,42,795/- by way of compensation to the victims of the June, 2013 floods in city of Srinagar with the Environmental Relief Fund Authority established under Section 7 (a) of Public Liability Insurance Act, 1991 within a period of 30 days from the date of this order.

2. Amount of Court fee payable i.e. 1% of the amount of compensation awarded shall be deducted from the said deposited amount and remitted to the Registrar, National Green Tribunal as per Rule 12 of the National Green Tribunal (Practise and Procedure) Rules, 2011.

3. The respondent no. 3- State of Uttarakhand shall issue necessary directions to the District Magistrate of District Pauri to depute any senior Sub-Divisional Magistrate to call for the claims from the persons as per list annexed as annexure A-5 with necessary proof in support of their claims. The SDM so deputed shall verify the claims made in light of the proofs produced and remit the amount due to such person/s after deduction therefrom the proportionate 1% amount of Court fees payable as per list annexure A-5 on finding the claim to be meritorious. Claims shall be called by publishing a notice, therefor in the office of the District Collector, Srinagar Municipal Corporation and on the website of the State of Uttarakhand. No Claim filed after 90 days of publication of such notice shall be entertained by the District Magistrate. Balance amount remaining in environment relief fund after disbursement of the amount as aforesaid shall be utilised for taking such measures for restoration of the public property affected by the floods.

4. Respondent no.1 shall pay an amount of Rs. 1 lakh each to the applicants as well as the respondent no. 4 as and by way of cost.

5. Original Application no. 3 of 2014 thus stands disposed of. 

The tribunal in its 42 pages order has briefly explained that GVK company has regularly violated the environmental norms which has resulted in flood and devastation of muck. Various reports have also pointed out that walls protecting muck should be built , also plantation and wire fencing should be done around the muck. The muck though put around the river way back but still no plantation has been carried out yet. Tribunal also went through the Ravi Chopra Committee’s report which was constituted by MOEFCC under the dircetion of  Hon’ble Supreme Court of india , the committee has also inspected the area. The tribunal also denied to accept the arguments put forwarded by Dam company that the area comes under flood affected area. Since the State Government has not defined a flood area, therefore what happened in the area was a natural calamity.

Putting forward his argument, the Uttarakhand State public prosecutor first tried to prove that the matter should not be taken into cognizance of court because what happened was a "Act of God" and not negligence on the part of state government or GVK company. The tribunal in its para 19 of the order has said that state government has not been able to deny the argument which held responsible the GVK company for disaster.

We are highly obliged to our advocates, Ritwik Dutta and Rahul Chaudhary who took up this case without charging any fee. We are also grateful to Dr. Bharat Jhunjhunwala , the plaintiff who provided all facts pertaining to environmental conditions violated by GVK company to the tribunal.

Thus we demands:

---According to order issued by NGT,  Uttrakhand state government authority to instruct District Magistrate of Pouri district that the issue of allocation of compensation should be done without corruption.

---When it was proved that GVK Company is responsible for the flood in a particular area of Srinagar then the administration should also take appropriate action and initiate criminal proceedings against it. The GVK Company should be penalized for the offenses committed knowingly to make them alert in the future.

As the judiciary performed its duty likewise the state administration should also take the same route to ensure justice to the people affected.
