Ref.: 15 June Office Memorandum regarding Inter-Ministerial Group on issues related to Gangaji

Respected Sir,
We came to know that on 15 June 2012 Ministry of Environment and Forest issued an office memorandum for the "Constitution of an Inter-Ministerial Group on issues related to river Ganga" by using the power given in the NGRBA Notification dated 20th February, 2009.

Memorandum says that "It was recommended in the NGRBA 3rd meeting to constitute a multidisciplinary group to look at the various options with regard to conservation, irrigation use and running of the Hydroelectric projects to ensure uninterrupted flow of river Ganga".

15th June OM also narrated the 3 objectives and 15 members including 3 expert members from NGRBA.
It seems that the whole exercise of making a committee is again an eye wash, related to the national river Ganga’s environmental and ecological health. It is also against the permanent development of the area of origin of Gangaji as well as the Himalayan range. We are giving some point wise objections for this committee.
  • This Office Memorandum was not publicized anywhere by any of the member ministry in this committee including the Ministry of Environment and forest till today.
  • Inclusion of members in the committee is also a violation of the spirit of democracy. The selection of Ministry members was not done keeping in mind any criteria of expertise in environment or social-economic back ground.
  • Inclusion of expert member from NRGBA appears to be a random selection. There is no valid reason or criteria for selecting these three people.
  • The TOR is also not very definite and precise. There is no stay on ongoing projects.
  • What about the HEPs who did not get Environment and Forest clearances? For example, the HEP on the River Pinder. This is still the only free flowing tributary of Gangaji.
  • Only three months were sanctioned for doing the study (of which already half the time has passed). It was also sanctioned to people who know nothing about this vast issue and do not have much time to complete this in the right way. It is incomprehensible.
You have shown much concern towards Gangaji but making this kind of committee shows the lack of intention to save Gangaji from Gangetic Hydroelectric Projects and free flowing pollution.

It seems that the whole process of making the committee is adhoc and impulsive, without much planning and transparency. This step does not take into consideration all the issues and concerns raisied around this important river, Gangaji.
Thus we demand you:-

  • Spare Gangaji from the devastation that will be caused by under construction and planned Hydro Electric Projects.
  • To ensure this, repeal the Environment and Forest clearances of all Hydro Electric projects on the 'Bhagirathi Ganga' and 'Vishnupadi Alaknanda Ganga,' as well as on all their tributaries.
  • Conduct a comprehensive credible and independent study on the impacts of HEPs and the ways in which we can protect Gangaji.
  • The terms and conditions of conducting this Study should be made public. Peoples' organizations, independent environmentalists and social activists should be the part of the report making process.
  • The recent "Study on Assessment of Cumulative Impact of Hydropower Projects in Alaknanda and Bhagirathi Basins up to Dev Prayag" done by the Indian Institute of Technology, Roorkee is incorrect and should be abandoned immediately.
  • Stop all construction of HEPs on Gangaji till aforementioned study is completed.
  • 130 km of the Bhagirathi ganga was scheduled to be declares an Ecosenstive Zone. This should not be delayed.

Resignation of Judicial members from NGT makes Supreme Court unhappy with Central Govt. 


Case in Supreme Court of India:-Union of India Vs. Vimal Bhai & others
Advocates Sanjay Parikh, Ritwick Dutta, Rahul Choudhary, Anitha Shenoy are appearing before the Supreme Court.

The matter of Union of India Vs. Vimal Bhai & ORS. on 13/05/2012 was heard by Hon'ble Mr. Justice G.S. Singvi and Hon'ble Mr. Justice Sudhansu Jyoti Mukhopadhaya.

After hearing councel of the respondents, Shri Sanjay parikh and Additional soliciter Gernel of GOI. Court gave the order "We have perused additional affidavit dated 09.07.2012  filed  by respondent No.1 and additional affidavit filed today by Shri  Surjit  Singh, Joint  Secretary, Ministry of Environment and Forests, New Delhi.  We are extremely unhappy to note that two  Judicial  Members  of the National Green Tribunal - Hon'ble Shri Justice  C.V.Ramulu  and  Hon'ble Shri Justice Amit Talukdar have tendered resignation.  Shri  Sanjay  Parikh, learned counsel for respondent No.1  gave  out  that  the  Judicial  Members resigned  because  of  the  non-availability  of  functional  facility   and residential accommodation.

                         Learned  Solicitor  General  and  learned  Additional  Solicitor General assured that they will immediately  take  up  the  matter  with  the concerned authorities of the Government and make a statement on the date  to be fixed by  the  Court  on  the  issue  of  making  available  the  housing  accommodation to the Judicial Members of the National Green Tribunal.

            In view of the statement made by the learned  Solicitor  General and the Additional Solicitor General, we deem it proper to  request  Hon'ble Shri Justice C.V.Ramulu and Hon'ble Shri Justice Amit Talukdar not to  press for acceptance of  their  resignation  for  a  period  of  one  month.   The concerned authority  in  the  Central  Government  shall  not  accept  their resignation till one week after the next date of hearing, which is fixed  as 13.08.2012."

It is important to say that while GOI has accommodation for the Secretary,MoEF on the first day of his joining, they do not have proper place for the Honb'le Judges of the NGT.

In our additional afidavit we says that "It is pertinent to point out that the earlier the Hon’ble Chairperson of the National Green Tribunal (Hon’ble Justice L.S Panta) had resigned followed by the resignation of an Expert Member (Vijai Sharma). The deliberate delay in issuing the appointment letter to Hon’ble Justice R.V Ravendran  despite his name being recommended by the Hon’ble Chief Justice of the Supreme  Court only reveals that the union of India is not keen to ensure a fully functional Green Tribunal. The Respondent has reasons to believe that the resignation have been due to lack of basic facilities including residential accommodation being provided to the Judicial and technical members of the National Green Tribunal. It is an unfortunate state of affairs that the most important environmental court of India set up through an Act of Parliament is being rendered non functional due to lack of residential accommodation being provided to the members. Since the last one year the members of the NGT have been forced to stay in Government guest houses/ State Bhawans. This has adversely affected the dignity of office as well as effective judicial functioning.  The act of the Central Government specially the Ministry of Environment and Forest and Ministry of Urban Development is aimed purely in ensuring that the National Green Tribunal is rendered non functional in the similar manner in which the National Environment Appellate Authority was made non functional.  The prime reason is the due to the fact that the National Green Tribunal has been passing decisions which have not been favorable to the Central Government and the central Government is now being made more accountable for its decision concerning the environment and natural resources.

The continuing lack of basic facilities which includes residential accommodation, proper and dedicated staff and court premises is adversely affecting the administration of justice, the dignity of the Court and also shows that the government is not serious about environmental issues.

          डा0 भरत झुनझुनवाला पर हमले की निंदा

आज सुबह वरिष्ठ पत्रकार डा0 भरत झुनझुनवाला के लक्षमोली गांव {टिहरी गढ़वाल, उत्तराखंड} स्थित घर पर ‘‘अलकनंदा जलविद्युत परियोजना, श्रीनगर’’ कंपनी के कर्मचारियों  द्वारा हमला किया गया। सुबह के समय वे और उनकी पत्नि श्रीमति मधु झुनझुनवाला घर पर थे। बांध कंपनी के लगभग 40 लोगो ने अलकनंदागंगा किनारे उनके आवास पर हमला किया। गंदे व अभ्रद शब्दों का प्रयोग किया।

जब शोर सुनकर श्रीमति मधु झुनझुनवाला ने घर के दरवाजे़ बंद किये तो हमलावरों ने दरवाजें   पर हमला किया जिससे दरवाजें के शीशे व चटखनी टूट गई। डा0 भरत झुनझुनवाला ने अपनी बात समझानेें की कोशिश की तो उन्होने धमकी दी की यदि दो दिन मे  डा0 भरत झुनझुनवाला ने बांधों का विरोध बंद नही किया तो उन्हे घर सहित जला दिया जायेगा।

हम इस कृत्य की पूरी तरह से निंदा करते है। यह कृत्य बताता है कि बांध कंपनी ‘‘अलकनंदा जलविद्युत परियोजना, श्रीनगर’’ कितनी मजबूत है। प्रशासन को इस बात का पूरी तरह से अनुमान था। जो पुलिस की गाड़ी उनके घर के पास उस समय मौजूद थी वो हमले के समय वहंा से चली गई थी। उनके घर के आसपास काफी समय से पुलिस व सरकारी जासूस घूमा करते थे। उन पर हमला हो सकता है इसका अनुमान तब ही से था जब बांध कंपनी द्वारा श्रीनगर में प्रायोजित धरने किये गये थे और पिछले दिनों स्वामी सानंद पूर्व में {डा0 जी0 डी0 अग्रवाल} को जबरदस्ती पुलिस गिरफ्तार करके ले गई थी। तब भी सरकार ने डा0 भरत झुनझुनवाला की कोई सुरक्षा की कोशिश नही की। यह उत्तराखंड में लोकतंत्र पर बांध कंपनियों का हमला है।

ज्ञातव्य है कि डा0 भरत झुनझुनवाला पिछले कई वर्षो से उत्तराखंड में रह रहे है। श्रीनगर में निमार्णाधीन अलकनंदा जलविद्युत परियोजना के दीर्घकालीन पर्यावरणीय असरों को सामने ला रहे है। इस संदर्भ में विभिन्न अदालतों में कई मुकद्दमंे भी चल रहे है। जिस कारण से बांध कंपनी की गल्तियंा सामने आयी। कई बार बांध बंद हुआ किन्तु फिर भी बांध कंपनी के दवाब मंे सरकार ने कड़े कदम नही उठाये। बांध की जानकारी के लिये देखे



हम सब फिर दोहराते है कि इस तरह के हमलों से गंगा घाटी में बांधो के कुप्रभावों को और सच्चाई को सामने लाने वालो को दबाया नही जा सकता। उत्तराखंड की नई सरकार के सामने यह नई चुनौति है कि वो टिहरी, कोटेश्वर, मनेरी-भाली एक व दो, विष्णुप्रयाग व अन्य  बांधों की समस्याओं का समाधान किये बिना नये बांधों को आगे धकेले और बांध से विकास रोजगार के झूठे सपने दिखाये या फिर उत्तराखंड के सही विकास की योजना बनाये।
हम सब  डा0 भरत झुनझुनवाला का सर्मथन करते है। अब डा0 भरत झुनझुनवाला की सुरक्षा की जिम्मेदारी राज्य सरकार की है।

Press Note: People gethered against Land Acquisition in Pinderganga Valley 17-06-12

भूमि-अधिग्रहण के खिलाफ सत्याग्रह का पहला चरण समाप्त


22 मई से भूमि अधिग्रहण के खिलाफ गांव-गांव में सत्याग्रह जारी है। शांतिपूर्ण सत्याग्रह के तहत 14 जून 2012 को थराली तहसील पर भू-अघ्यापति अधिकारी ‘‘गांव से कूच’’ किया गया। अगला चरण जल्द ही घोषित किया जायेगा।

भूमि-अधिग्रहण के खिलाफ सत्याग्रह के अंतर्गत 14 तारिख को गंाव-गांव से पंहुचे सैकड़ो की संख्या में लोगो ने ‘‘गांव से कूच‘‘ के तहत तहसील थराली का घेराव किया जहंा भूमि अधिग्रहण प्रक्रिया के लिये भू-अघ्यापति अधिकारी आये थे। डटे रहेंगे नही हटेगें - नही हटेगें - नही हटेगें, बांध कंपनी वापिस जाओं, भू-अघ्यापति अधिकारी वापिस जाओं, केन्द्र सरकार होश में आओं, राज्य सरकार होश में आओं नारों के साथ पिंडरगंगा घाटी के गांवो से मजदूर, किसान, महिलायें, पुजारी, व्यापारी लोग थराली पुल से तहसील पर पहुंचे। उनके बैनर पर लिखा था ‘‘पिंडर को अविरल बहने दो-हमे सुरक्षित रहने दो‘‘। पिंडरगंगा घाटी में भूमि-अधिग्रहण के खिलाफ सत्याग्रह जारी है। जिसके आठवें दिन इस ‘‘गांव से कूच‘‘ का आयोजन किया गया था।
तहसील में पुलिस की भी काफी उपस्थिति थी। जोकि सरकारी जोर जबरदस्ती व उनके गलत कामों का सबूत थी। तहसील प्रांगण में ही दोपहर तक सभी चली। महीपत सिंह कठैत ने कहा कि हमारी धरती को छीनने की कोशिशों को नाकाम किया जायेगा। सरकार विकास के नाम पर हमारी घाटी को बर्बाद नही कर सकती है।
विभिन्न वक्ताओं ने बांध को नकारते हुये गंगा की एकमात्र बिना किसी रुकावट के बह रही पिंडरगंगा को बहते रहने देने के प्रति अपनी प्रतिबद्धता जताई। डा0 जगमोहन रावत, ममता शाह, मुन्नी मिश्रा, नर्मदा देवी, दिनेश मिश्रा, शोभन सिंह खत्री, के.डी. मिश्रा, उमादेवी, बलवंत राम, मदन मिश्रा ने गलत विकास  लोगो पर थोपे जाने का विरोध किया। के. डी. जोशी ने विभिन्न प्रतिनिधियों के हस्ताक्षर युक्त ज्ञापन पढ़ा और उत्तराखंड सरकार के मुख्य सचिव के नाम लिखे गये इस ज्ञापन को मौके पर मौजूद भू-अघ्यापति अधिकारी के प्रतिनिधी बाहर बुलाकर दिया।

ज्ञापन में मुख्य रुप से कहा गया कि            ‘‘भूमि अधिग्रहण कानून 1894 की धारा 17 के अन्तर्गत हमारी भूमि का अधिग्रहण होना गैर वाजिब है। देवसारी जलविद्युत परियोजना {252मेवा} को लोक हित का प्रयोजन बताना गैर कानूनी है। वरन् इस परियोजना से लोक अहित होगा। पतित पावनी पिंडर गंगा जिसकी माता के रूप में पूजा होती है उसे बहती नदी के स्थान पर बहाव रहित तालाबों एवं सुरंगों में बदला जा रहा है। गंगा के पवित्र जल में आक्सीजन की मात्रा कम हो जायेगी। तालाब में बदल जाने के बाद गंगा पवित्र और पूजनीय नहीं रह जायेगी। यह हमारी आस्था पर हमला है।

परियोजना से स्थानीय समाज पर तमाम विपरीत आर्थिक, सामाजिक एवं पर्यावरणीय प्रभाव पड़ेंगे जैसे तापमान में कमी से रोग बढ़ना, भूमि के धसान से मकानों का क्षति ग्रस्त होना, दलदल में मवेशियों का फंसना, जंगल की डूब भूमि से मिलने वाले ईंधन, चरान, चुगान आदि से वंचित होना, महिलाओं को खेती और पशुपालन से वंचित होकर असहाय जीवन जीने के लिये मजबूर होना, बालू एवं मछली व्यवसायियों को बेरोजगार होना इत्यादि।
देवसारी जलविद्युत परियोजना {252मेवा}के कागजातों जैसे पर्यावरण प्रभाव आंकलन रिर्पोट व प्रंबध योजना में भारी कमियां है। अभी परियोजना को कोई पर्यावरण या अन्य स्वीकृतियंा नही मिली है। परियोजनाओं के लिये धारा 17 के अन्र्तगत जाॅंच करने एवं जनता को अपना पक्ष रखने से वंचित किया जाना गैरवाजिब और गैरकानूनी है क्योंकि धारा 17 का उपयोग केवल युद्ध जैसी राष्ट्रीय आपदाओं के लिये किया जा सकता है। सामान्य परियोजनाओं के लिये माननीय उच्चतम न्यायालय के द्वारा इस धारा का उपयोग करना अवैध ठहराया जा चुका है।

वर्तमान भू-अधिग्रहण की कार्यवाही दुराग्रहपूर्ण है और अधिकारियों के द्वारा बिना विवेक को प्रयोग किये की गयी है अतः इसे निरस्त किया जाये।’’


सुभाष पुरोहित सभा के अंत में धन्यवाद ज्ञापन देते हुये कहा की लड़ाई लम्बी है। सरकार समझ ले की संघर्ष गांव-गांव मे चल रहा है।

पिंडर घाटी के लोग हर स्तर पर

आवश्यक पूर्व जानकारीः-
{पिंडरगंगा घाटी, जिला चमोली, उत्तराख्ंाड में प्रस्तावित देवसारी जलविद्युत परियोजना (252मेवा) विरोधी आंदोलन जारी है। राष्ट्रीय नदी गंगा की एकमात्र स्वतंत्र बहती सहायिका पिडंरगंगा पर बांधो की विभिषिका लादने का विरोध जारी है। ज्ञातव्य है कि इस परियोजना की पर्यावरणीय जनसुनवाई दो बार 13 अक्तूबर, 2009 फिर 22 जुलाई 2010 में रोकी गई। जिसके बाद 20 जनवरी 2011 को बैरिकेट लगाकर पर्यावरणीय जनसुनवाई का नाटक किया गया। 20 जनवरी 2011 को आयोजित जनसुनवाई में सभी प्रभावितों को बोलने का मौका ही नही दिया गया। जिसमें प्रशासन और प्रदूषण नियंत्रण बोर्ड की भूमिका पूरी तरह संदेहास्पद रही है। अपनी आवाज़ को सामने लाने के लिये 3 अप्रैल 2011 में घाटी के हजारों लोगो ने पिंडर के किनारे संगम मैदान में लोक जनसुनवाई में शामिल होकर बांध विरोध में अपनी एकजुटता दिखाई। जिसे यू ट्यूब पर Bandh Katha  टाईप करके देखा जा सकता है। विरोध प्रदर्शन जारी है}

Land Acquisition officer rounded by the people
Satyagraha against Land Acquisition in the Pinder Ganga Valley : end of first phase

{ From 22nd may there has been satyagraha against the land acquisition in every village. Under peaceful satyagraha, the "Gaon se Kooch" (Rally from the Village) started on 14th June 2012 from Tharali Tehsil. The next phase will be announced shortly }

On 14th June, nearly thousand of villagers’ gheraoed the Tharali tehsil under the "Gaon se Kooch" (Rally from the Village) for the satyagrah against the land acquisition where the land question officer had arrived for land acquisition process. Dante rahenge, nai hatenge, nahi hatenge (We will be vigilant, we will not move!), Dam company go away!, Land acquisition officer go away!, Central Govt, wake up!, Central govt, wake up – Labour, farmers, women, Pujari, Businessmen and fisherrmen all from Pinder Ganga Valley have arrived with slogans at Tharali tehsil. The banner they carried the message of – “Pinder ko aviral behne do- hume surakshit rehne do” (Let Pinder flow undammed, let us remain safe!). A satyagrah is going on in the Pinder Ganga valley against land acquisition. On this 8th day the Gaon se Kooch (Rally from the Village) has been organised

There was considerable presence of police at the tehsil, which is indicative of the state force and wrong doings. The meet took place in the tehsil premises till afternoon. Mahipat singh kaithat said that the efforts to steal our land will be made unsuccessful. The government cannot destroy our valley in the name of development.
All the speakers spoke against the dam and were of the opinion that the Pinder ganga flow unhindered without any obstruction. Dr. Jagmohan Rawat, Mamta Shah, Munni Mishra, Narmada devi, Dinesh Mishra, Umadevi, Balwant Ram, Madam Mishra opposed wrond development beinh imposed on people. K.D Joshi read the resolution signed by the representatives which was written for the Chief Secretary Uttarakhand government and was given to the present land acquisition officer.
The resolution stated that – Under the Land Acquisition Act, 1894 section 17, acquisition of our land is unauthorized. Claiming the Devsari Hydro electric project (252MW) to be in interest of people is unlawful. In fact people will not benefit from this project. Pinder ganga is revered as a mother and worshipped and this place is being changed to ponds and. The oxygen level in ganga may go down. After getting converted to a pond, the ganga will not remain pure and worship-worthy. It is an attack on our faith.
This project will also have a negative impact on the economic and social lives of the people who live in the region. The impact on the environment is also immense. For example, changes in climate leading to increase in disease, landslides cause damage to housing, cattle getting caught in swampy and marshy land, loss of forest cover and produce due to submersion, loss of sand and fish leading to unemployment. The role of women also changes as they will no longer be involved in agriculture and cattle-rearing. This leaves them helpless and desperate.
The documents of Devsari Hydro electric project (252MW) like the Environmental Impact Assessment Report and the Environmental Management Plan has many shortcomings. The project hasn’t received any clearance as of yet. As per section 17, it unlawful to keep away inspection and the people to put forth their side because section 17 can only be used in war like situations of national emergency. The Honourable Supreme Court has ruled against using section 17 for such regular projects.
The present land acquisition process is faulty and use by the officials without aplying mind. It should therefore be stalled."

Subhash Purohit delivered the thank you speech in the end and said that the struggle is a long one. the government should realise that the struggle is taking place in every village

The people of the Pinder Valley oppose Dam at every level. It is in this regard that the Satyagraha is being launched against the land acquisition.

Background Note:-

Movement is going on against the proposed Devsari Hydro-electric project in the Pinder-Ganga Valley, district Chamoli, Uttarakhand. The Pinderganga is the only free flowing tributary of the National river Ganga. The movement is against the building of huge dams on this tributary. The Public Hearing for Environment was stopped twice on 13th October 2009 and 22nd July 2010. On 20th January 2011, the hearing was a farce with barricades being used against the people. Affected people were not given chance to speak. The role of the administration and Pollution Control Board was completely questionable. In order to bring their voice to the fore, thousands of people in the valley gathered on the banks of the river at Sangam on the 3rd of April, 2011, for a people’s public hearing. They spoke up against the dam and pledged solidarity to the movement. The clliping of hearing can be viewed on youtube as ‘bandh katha’.

टिहरी बांध विस्थापितों के मामले 30 वर्षाे से लंबित है। भूमिधर अधिकार ही नही मिल पाया है। बिजली, पानी, सिंचाई, यातायात, स्वास्थय, बैंेेक, डाकघर, राशन की दुकान, पचांयत घर, मंदिर, पितृकुटटी, सड़क, गुल, नालियंा आदि और जंगली जानवरों से सुरक्षा हेतु दिवार व तार बाढ़ तक भी व्यवस्थित नही है। कही पर बरसों से यह सुविधायें लोगो को उपलब्ध नही हो पाई है। यदि कहीं पर किसी तरह से कुछ व्यवस्था बनी भी है तो स्थिति खराब है। स्कूल भी अब बना वो भी मात्र 10वीं तक है। प्राथमिक स्कूलों की इमारतें बनी है पर अघ्यापक नही है। स्वाथ्य सेवायें तो है ही नही। लोगों को मात्र जगंल में छोड़ दिया गया है। अपने बूते पर विस्थापितों ने मकान बनाये है। यातायात की सुविधाये है ही नही। रास्ते सही नही है तो निकासी नालियां भी नही है।

ज्ञातव्य है कि राज्य सरकार ने 2010 में सिंचाई विभाग के तत्वाधान में जो दिनकर समिति बनाई उसकी रिर्पोट को सार्वजनिक नही किया था किन्तु सुप्रीम कोर्ट में चल रहे एन. डी. जयाल व शेखर सिंह बनाम भारत सरकार के मुकद्दमें में इस रिपोर्ट के आधार पर पैसा मांगा। चूंकि अदालत में यह सिद्ध हो गया था कि पुनर्वास नही हो पाया है।  राज्य सरकार ने तब यह कहा की टिहरी हाइड्रो डेवलपमेंट कारपोरेशन {टी. एच. डी. सी.} पैसा नही दे रही इसलिये पुनर्वास के काम नही हो पा रहे है। कोर्ट ने टी. एच. डी. सी. को आदेश दिया की मांगी गयी 102.99 करोड़ की राशि देने का आदेश दिया।

कई महिनो बाद सरकार ने इस पैसे का क्या किया नही मालूम। जमीन पर स्थितियंा नही बदली। इसलिये आज माटू जनसंगठन की ओर से हरिद्वार क्षेत्र में बसाये गये के ग्रामीण विस्थापितों का प्रतिनिधी मंडल शिवालिक नगर स्थित पुर्नवास कार्यालय पर प्रर्दशन किया और पुनर्वास निदेशालय को ज्ञापन दिया।
विमलभाई ने कहा की 30 वर्षो बाद भी भूमिधर अधिकार क्यों नही दिये गये। पुनवास कार्य में हो रहे खर्च पर अब लोक निगरानी होगी। आपने स्वाथ्यय सेवाओं तक नही दी है। इन सब का जवाब अब देना होगा। आप हमारे ज्ञापन पर अपनी आख्या लगाकर प्रशासन का भेजे।
पूरनसिंह राणा ने कहा की यह जानने का हमे अधिकार है कि सरकार पैसे का क्या कर रही है। विस्थापित बेराजगार है और काम बाहर के लोग करे? विस्थापित क्षेत्र के ग्राम प्रधान पद्मसिंह गुंसाई, पंचायत सदस्य रणबीर सिंह राणा के साथ बलवंत पंवार, उत्तमसिंह, आजाद, तेगसिंह, प्रमोद आदि ने भी प्रभावित क्षेत्र की समस्याओं को कहा।

ज्ञापन में मांग की गई कीः-

भूमिधर अधिकार तुरंत दिये जाये।
शिक्षा, स्वाथ्यय, यातायात, सिंचाई व पेयजल और अन्य मूलभूत सुविधायें तुरंत पूरी की जाये।
सुविधाओं के लिये 103 करोड़ की राशि का उपयोग किया जायेगा ही। इन सब कार्यों के लिये विस्थापितों की ही समितियंा बनाकर काम दिया जाये ताकि कार्य की गुणवत्ता बने और सही निगरानी भी हो सके।

उपस्थित अधिकारी उप-अधिशासी अभियंता श्री राजेश नौटियाल ने कहा की हरिद्वार पुनर्वास क्षेत्र के लिये 4 करोड़ रुपये की मंजूरी हुई है। पैसा आने पर ही काम शुरु होगा।
इन सबके लिये बार बार पत्र लिखें गये है। किन्तु या तो राजनैतिक इच्छाशक्ति का आभाव है या विस्थापितों को दुधारु गाय माना जाता है कि उनकी समस्याओं का यदि निबटारा हो गया तो फिर उनके नाम पर पैसा कैसे आयेगा? एक समस्या यह भी दिखाई देती है कि नीचे के अधिकारी समस्याओं को समस्या नही मानते। और उपर शासन तक भेजने की कोशिश भी नही करते है। जैसे की स्वास्थ्य सेवाओं का ना होना।
नये बांधो का हल्ला मचाने वाली सरकार और संस्थाओं को इस पर विचार करना चाहिये। आगे दौड़ पीछे छोड़ नही चलेगा।

  भूमि अधिग्रहण के खिलाफ सत्याग्रह


पिंडर घाटी , जिला चमोली, उत्तराख्ंाड  में प्रस्तावित देवसारी जलविद्युत परियोजना विरोधी आंदोलन जारी है। राष्ट्रीय नदी गंगा की एकमात्र स्वतंत्र बहती सहायिका पिडंरगंगा पर बांधो की विभिषिका लादने का विरोध जारी है। बांध के विरोध के कारण गढवाल विश्विद्यालय, उत्तराख्ंाड  के अध्यापकों ने झूठ बोलकर सर्वे किये। हमारे पास इसके सबूत है। ज्ञातव्य है कि इस परियोजना की पर्यावरणीय जनसुनवाई दो बार 13 अक्तूबर, 2009 फिर 22 जुलाई 2010 में रोकी गई। जिसके बाद 20 जनवरी 2011 को बैरिकेट लगाकर पर्यावरणीय जनसुनवाई का नाटक किया गया। 20 जनवरी 2011 को आयोजित जनसुनवाई में सभी प्रभावितों को बोलने का मौका ही नही दिया गया। जिसमें प्रशासन और प्रदूषण नियंत्रण बोर्ड की भूमिका पूरी तरह संदेहास्पद रही है। अपनी आवाज़ को सामने लाने के लिये 3 अप्रैल 2011 में घाटी के हजारों लोगो ने पिंडर के किनारे संगम मैदान में लोक जनसुनवाई में शामिल होकर बांध विरोध में अपनी एकजुटता दिखाई। जिसे यू ट्यूब पर  bandh katha टाईप करके देखा जा सकता है।

जब लोगो ने 2011 में सुरंग टैस्टिंग का काम रोका तो पुलिस के बल पर काम कराने की कोशिश की गई। यह लगातार जारी है। बांध कंपनी व सरकार बंाध काम को किसी भी तरह आगे धकेलने और यह सिद्ध करने के लिये कि बांध बनेगा ही। अब भूमि अधिग्रहण का सहारा ले रही है। जिसका पूरी घाटी में जबरदस्त विरोध है। बांध कंपनी की इस चाल का जवाब दिया जायेगा। 22 मई को बांध के प्रस्तावित डूब क्षेत्र देवाल में रैली और पुतला दहन इसी का एक प्रांरभिक कार्यक्रम था। भूमि अधिग्रहण के खिलाफ गांव-गांव में सत्याग्रह की शुरुआत होगी।

हमारा शांतिपूर्ण सत्याग्रह अगामी 13 जून 2012 को नये चरण में दाखिल होगा। पिंडरगंगा घाटी में प्रभावित गांवो मंे सांकेतिक उपवास रखा जायेगा। इसी शाम को भूमि-अधिग्रहण नोटिस का दहन होगा। 14 जून को तहसील पर ‘‘गांव से कूच’’ किया जायेगा। एक शांत सुरम्य पिंडरगंगा घाटी को आंदोलन में धकेलने की जिम्मेदारी सरकार की है। इसके बाद अगला चरण घोषित किया जायेगा।

अभी परियोजना को कोई पर्यावरण और वन स्वीकृतियंा नही मिली है। परियोजना के लिये धारा 17 के अन्र्तगत जाॅंच करने एवं जनता को अपना पक्ष रखने से वंचित किया जाना गैरवाजिब और गैरकानूनी है क्योंकि धारा 17 का उपयोग केवल युद्ध जैसी राष्ट्रीय आपदाओं के लिये किया जा सकता है। सामान्य परियोजनाओं के लिये माननीय उच्चतम न्यायालय के द्वारा इस धारा का उपयोग करना अवैध ठहराया जा चुका है। स्पष्ट है कि वर्तमान भू-अधिग्रहण की कार्यवाही दुराग्रहपूर्ण है।


जबकि इस परियोजना से स्थानीय समाज पर तमाम विपरीत आर्थिक, सामाजिक एवं पर्यावरणीय प्रभाव पड़ेंगे जैसे तापमान में कमी से रोग बढ़ना, भूमि के धसान से मकानों का क्षति ग्रस्त होना, दलदल में मवेशियों का फंसना, जंगल की डूब भूमि से मिलने वाले ईंधन, चरान, चुगान आदि से वंचित होना, महिलाओं को खेती और पशुपालन से वंचित होकर असहाय जीवन जीने के लिये मजबूर होना, बालू एवं मछली व्यवसायियों को बेरोजगार होना इत्यादि। इन दुष्प्रभावों की जानकारी संबन्धित अधिकारियों को पहले ही लिखित एवं मौखिक रूप में दी जा चुकी है। देवसारी जलविद्युत परियोजना {252 मेवा} के कागजात पर्यावरण प्रभाव आंकलन रिर्पोट एवं पर्यावरण प्रंबध योजना आज तक समझने वाली भाषा हमें हिन्दी में नही मिली। हम उसका भी जवाब दे सकते है। पर लोगो को हिन्दी में जानकारी दी तो जाये। हमने यह सारी बातें भी संबधित विभागों को निवेदन के रुप में भेजी है। किन्तु उसे दरकिनार करके यह परियोजना हम पर लादी जा रही है। पिंडर घाटी के लोग हर स्तर पर इसका विरोध करेंगे। इसी क्रम में भूमि-अधिग्रहण के खिलाफ सत्याग्रह है।

Satyagraha 
against Land Acquisition in the Pinder Ganga Valley

Movement is going on against the proposed Devsari Hydro-electric project in the Pinder-Ganga Valley, district Chamoli, Uttarakhand. The Pinderganga is the only free flowing tributary of the National river Ganga. The movement is against the building of huge dams on this tributary. Due to protest, faculty of the Garhwal University were not able to tell the truth to the people while they were doing surveys for the dam. There is proof of this. The Public Hearing for Environment was stopped twice on 13th October 2009 and 22nd July 2010. On 20th January 2011, the hearing was a farce with barricades being used against the people. Affected people were not given chance to speak. The role of the administration and Pollution Control Board was completely questionable. In order to bring their voice to the fore, thousands of people in the valley gathered on the banks of the river at Sangam on the 3rd of April, 2011, for a people’s public hearing. They spoke up against the dam and pledged solidarity to the movement. The clliping of hearing can be viewed on youtube as ‘bandh katha’.

In 2011, when people tried to stop the tunnel testing work, police force was used to get the work done. This continues. It is as if the government and the private company building the dam are determined to take this ahead and prove that the dam will be built. They are now using land acquisition to take land from the people for the project. There is massive opposition against this in the whole valley. The people are revolting.

The first of this was on 22nd May in Debal, which is in the proposed submersion area. A rally was held where effigies were also burnt. The Satyagraha against land acquisition has begun in every village.

The next phase of our peaceful satyagraha starts on 13th June 2012. People in the affected villages will participate in a fast. The same evening, the land acquisition notice will then be burnt. On the 14th of June, the movement will come to the tehsil through the ‘Gaon se Kooch’ (Rally from the village). The next phase will be announced after this.

A picturesque peaceful valley has become a battleground for the movement. The government is responsible for this.

The project has not received environmental and forest clearances. This is a requirement of every project. It is only in special cases, under section 17, that land can be acquired from the public with adequate notice and compensation. This section is used only in case of war or other national crisis. In ordinary circumstances, the Honb'le Supreme Court has ruled that the section will not be used. It is hence clear that the present land acquisition process is wrong.

This project will also have a negative impact on the economic and social lives of the people who live in the region. The impact on the environment is also immense. For example, changes in climate leading to increase in disease, landslides cause damage to housing, cattle getting caught in swampy and marshy land, loss of forest cover and produce due to submersion, loss of sand and fish leading to unemployment. The role of women also changes as they will no longer be involved in agriculture and cattle-rearing. This leaves them helpless and desperate.

The relevant officials have already been notified of this impact through verbal and written communication. The Environmental Impact Assessment Report and the Environmental Management Plan of the Devsari Hydro-electric project (252 mw) have yet not been given to the people in the language they understand i.e Hindi. There will be questions raised even on those reports and plans, but first we need to see them in Hindi. We have raised these questions to all the relevant departments earlier. These have been ignored and the project is being forced upon us. The people of the Pinder Valley oppose this at every level. It is in this regard that the Satyagraha is being launched against the land acquisition.

Press Note: 30-05-12 Protest against Vishunugad-Pipalkoti HEP: condemned Prof. G.D. Agarwal arrest by Uttarakhand Govt.


 In proposed Vishnugad-Pipalkoti HEP (444MW), on National River Alaknandaganga, Uttarakhand people protested against dam and condemned Prof. G.D. Agarwal arrest  by Uttarakhand Govt.
पुनर्वास असंभव है: बुरे प्रभावों को कब तक छुपाओंगे?
बांध नही स्थायी विकास चाहिये! नदियों को अविरल बहने दो! नदी हमारी कागज तुम्हारा विष्णुगाड-पीपलकोटी जलविद्युत परियोजना में पुनर्वास असंभव है। बुरे प्रभावों को छुपाकर नही रखा जा सकता है। इन नारों के साथ आज बांधकालोनी के सियासेंण पुल में धरना दिया गया। साथ ही श्री जी0 डी0 अग्रवाल की गिरफ्तारी की भी भत्र्सना की गई।

उत्तराखंड के चमोली जिले में अलकनंदागंगा पर प्रस्तावित विष्णुगाड-पीपलकोटी जलविद्युत परियोजना पर्यावरणीय जनसुनवाई के समय से ही विवादो के घेरे में है। 18 अक्तूबर 2006 की जनसुनवाई विस्थापितों को सही जानकारी ना देने के कारण स्थगित हुई थी। बाद में 9 जनवरी को दुबारा भी वही विरोध हुआ पर तत्कालीन उपजिलाधिकारी ने रिर्पोट में सब सही दिखा दिया। माटू जनसंगठन ने पहली बार क्षेत्र में इस बात की जानकारी दी की इसमें विश्व बैंक भी शामिल है। विश्व बैंक ने परियोजना के कागजातों में कमियंा देखकर कुछ नये अध्ययन जरुर करवाये थे। विश्व बैंक ने भी एक वर्ष तक विचार नही किया था इस बांध को कर्ज देने के लिये। बाद मे उसने ठेकेदार लाॅबी को खुश किया और ठेको के सपने दिखाकर विरोध की आवाज़ को दबाने का प्रयास किया। जो आज भी जारी है। किन्तु विश्व बैंक का कर्ज अभी तक बांध कंपनी को नही मिला है।

हमारा विष्णुगाड-पीपलकोटी जल-विद्युत परियोजना से विरोध इसके दीर्घकालीन पर्यावरणीय कुप्रभावों और पुनर्वास की अनिश्चिितता के कारण है। बांध निर्माता कंपनी टिहरी जलविद्युत निगम {टीएचडीसी} का अतीत बहुत बुरा है। हम टिहरी बांध के विस्थापितों की दुर्दशा देख रहे है। यदि उनका पुनर्वास आज तक नही हो पाया तो क्या गारंटी है कि यहंा पर पुनर्वास होगा। सुप्रीम कोर्ट में यदि एन0 डी0 जुयाल एंव शेखर सिंह की याचिका नही होती, जिसमें माटू जनसंगठन के साथी मदद कर रहे है, तो जितना पुनर्वास हुआ है शायद वह भी नही हो पाता। नवम्बर में सुप्रीम कोर्ट के कारण से ही राज्य सरकार को टिहरी बांध विस्थापितों को 102.66 करोड़ रुपये मिले है। वरना तो 2005 में ही टीएचडीसी ने पूर्ण पुनर्वास घोषित कर दिया था। टिहरी बांध में आजतक जलाशय पूर्ण पुनर्वास ना होने के कारण नही भरा गया है।

यहंा भी वैसी ही स्थिति है। पिछले 8 सालांे से हम विष्णुगाड-पीपलकोटी जल-विद्युत परियोजना के बुरे प्रभावो को झेल रहे है। हमने बहुत सारे पत्र भी लिखे। 15 मार्च, 2012 को तत्कालीन जिलाधिकारी महोदय हमारे गांव आये थे। उन्हे हमनें बांध के कारण हुयें नुकसानों जैसे मकानों की दरारंे व पानी के सूखे स्तोत्र दिखाये थे। हमे उम्मीद बनी थी की वो हमारी समस्या का हल करेगें। किन्तु सारी बात बांध कंपनी ने घुमा दी। जो चर्चा भी नही हुई थी वो 15 मार्च, 2012 की बैठक की रिर्पोट में लिखी गई। इसमें यह भी साफ लिखा है कि आपदा प्रभावितों के लिये भी जमीन नही है तो बांध विस्थापितों को जमीन नही दी जा सकती। 28 मार्च को तत्कालीन जिलाधिकारी ने टीएचडीसी को पत्र में लिखा है कि वैकल्पिक टनल के डिफ्ट के लिये व्यवधान उत्पन्न करने वालोे पर वैधानिक कार्यवाही की जाये। आश्र्चय है कि तत्कालीन जिलाधिकारी जी बांध कंपनी को ऐसा लिखकर दे रहे है। पर हमारे नुकसान की भरपाई 8 वर्षो से ना करने के बारे में टीएचडीसी पर कोई कार्यवाही नही? प्रशासन को तो स्थानीय लोगो की मदद करनी ही चाहिये। ऐसा क्यों नही हो रहा? यह गंभीर विषय है।
हमने बांधों के बुरे प्रभाव इसी जिले में बन रही परियोजनाओं में देखे है। हम अपनी अलकनंदागंगा को स्वतंत्र देखना चाहते है। जिसके लिये हमारी भरसक कोशिश रहेगी। इसीलिये बांध कंपनी हमारे नुकसानों की भरपाई नही कर रही है। इस तरह दवाब बनाकर वो चाहते है कि हम बांध के लिये रजामंदी दे। जिसके लिये हम तैयार नही है।

धरना देने के बाद गोपेश्वर मे जिला कार्यालय जाकर जिलाधिकारी महोदय को ज्ञापन दिया व चर्चा की। ज्ञापन में मांग की गई हैः-

  • हमारे आजतक के हुये नुकसानों की भरपाई टीएचडीसी द्वारा की जाये।
  • यदि टीएचडीसी व सरकार हमारे विरोध के बाद बांध बनाती भी है तो टनल का अलाईमेन्ट बदला जाये।
  • टीएचडीसी व सरकार इस बात की लिखित गांरटी दे कि परियोजना  से हमारे जीवन व आजीविका पर किसी भी तरह की धूल, विस्फोटो के कंपन, जलस्त्रोतांे का सूखना जैसे असर नही पड़ेगे।

जो बांध कंपनी थोड़ा सा मुआवजा तक नही दे सकती वो विस्थापितों को पुनर्वास क्या देगी? यह बांध समर्थकों को भी याद रखना चाहिये कि यदि बांध बनता है तो टिहरी बांध विस्थापितों की कहानी फिर यहंा दोहराई जायेगी। इसलिये बड़े बांध रुकने ही चाहिये।

Affected Chamoli villagers demand compensation

Residents of various villages in Chamoli district affected by the construction of the Vishnugad-Pipalkoti hydro electric project have demanded that the Tehri Hydro Development Corporation (THDC) provide a written guarantee to the Government to the effect that dust, tremors caused by detonations and drying up of water resources due to work on the project will not affect their lives and livelihood. 

Staging a protest demonstration near Siyasain Bridge in Chamoli, the affected villagers demanded that the THDC should compensate them for the damage they have suffered till date due to the project. If the company and State Government construct the dam ignoring the strong opposition of locals, the alignment of the tunnel should be changed. The villagers also condemned the treatment being meted out by the Government to Swami Gyan Swaroop Sanand who is agitating against large dams on the Ganga and its tributaries. The proposed Vishnugad-Pipalkoti HEP on Alaknanda River has been mired in controversy and elicited strong opposition of the locals since the first environmental public hearing. The villagers allege that the company has continued to conceal relevant information from them which is also one of the reasons why the World Bank has not yet funded the project. The villagers are opposing the project due to the long term environmental damage and uncertainty regarding the rehabilitation of the affected villagers.
“The THDC has a very bad track record. We have seen the anomalies in rehabilitation of those affected by construction of the Tehri Dam. Those affected by construction of the Tehri dam have not yet been fully rehabilitated so we doubt if we will be rehabilitated properly. We have been experiencing the negative repercussions of the Vishnugad-Pipalkoti project for the past eight years and have written several letters to the authorities and approached ministers and bureaucrats repeatedly. However, our grievances have been consistently ignored by the authorities who have continued to favour the interests of the company in stead of ensuring the welfare of the affected people,” said the protesting villagers.
