The State government in Uttrakhand must have earned at least 1000cr from the electricity generated by the Tehri dam project on National River Ganga and this is a recurring incoming yet in the ongoing Supreme Court case between N.D Juyal and Shekhar Singh V/S GOI and another, the former government in its affidavit on the delay in rehabilitation work gave the reason that T.H.D.C has not provided funds for rehabilitation.The court had directed THDC in November 2011 to provide for a paltry 102.99 cr for the same. Even now the reason given to the SC for the delay in rehabilitation work is said to be lack of funds.
Before it come power the present Chief Minister Shri Vijay Bahuguna had conceded that the rehabilitation work was not being properly done. In response to the destruction of villages around the Tehri Dam during the monsoon in 2010 he had suggested that the state government should spend the earnings generated by the hydro electric projects on the project affected people. This line of thought is in consonance with the Power ministry’s guideline for the development of hydroelectricity projects sites dated 23 may 2006 which on page 10 states that the income so generated should be spend on project affected people .

2.3 Provision of 12% free power to the home state Government of India, vide its O.M. dated 17th May, 1989 have approved that “since the Home States are increasingly finding it difficult to locate alternative land and resources for rehabilitation of the oustees in hydro-electric projects. They, need to be suitably assisted by giving incentives, such as the (proposed) 12% free power, to enable them to take care of the problems of rehabilitation in the areas affected by the hydro-electric projects.
Without such assistance and incentives, considerable hydel potential of the country would remain unutilized. Accordingly, the State Government shall be entitled to realize 12% free power from the project for local area development and mitigation of Guidelines for development of Hydro Electric Projects Sites hardships to the project affected people in line with the Govt. of India policy”.
Further in this context the basic amenities mentioned below are nonexistent and if at all they exist ,they are of very poor quality, even at rural rehabilitation sites like Pathari part-1,2,3&4, the dam oustees in the rural area of Haridwar have not been properlly rehabilitated, even after 30 years 70% of them do not have land rights. These rehabilitation sites lack basic infrastructure like electricity, water, irrigation, transportation, health post, bank post office PDS, panchayat, mandir, roads, drains so much so these sites do not have picketed fence or a wall to keep out the wild animals. People have been fending off for themselves and have built houses on their own. In not so distant past on 11 June 2012, Shri Rajesh Nautiyal Assitant Executive Engineer at the shivilak nagar rehabilitation office in Haridwar division said that 4 cr have been sanctioned for the rehabilitation work but none for providing the basic infrastructures.
Matu Jansangthan had sent a letter on behalf of oustees, sign by Vimalbhai And Puran Singh Rana , Balwant Singh Pnawar and Jagdish Rawat (in Hindi, attached) to the Chife Minister Shri Vijay Bahuguna demanding that his government can do is spend the income (getting 12% free electricity form the Tehri and Koteshwer Dam) being generated to rehabilitate the dam oustees by providing them land holding with clear titles after sorting out with the central Ministry of Environment and Forest, provide the promised free electricity as per the Power ministry guidelines and set up committees of locals and project effected people to monitor and ensure quality in the provision of essential infrastructure and services at the rehabilitation sites.

उत्तराखण्ड में राष्ट्रीय नदी गंगा पर बने टिहरी बांध के ग्रामीण विस्थापितों ने राज्य को मिल रही मुफ्त बिजली में अपना हक मांगा है। 24 जनवरी को मुख्यमंत्री को दिये गये पत्र में उनसे मांग की गई है कि लिखा है कि राज्य सरकार को टिहरी बांध से मिलने मुफ्त बिजली संबधी सरकारी आदेश का जिक्र करते हुये पत्र में कहा गया है कि टिहरी बांध से मिल रही मुफ्त आमदनी को विस्थापितों पर खर्च किया जाये। पत्र साथ में है। जिसमें विस्तार से विषय को उठाया गया है।

टिहरी बांध से बिजली का उत्पादन भी हो रहा है जिससे राज्य सरकार को प्रतिदिन आमदनी भी हो रही है। जो आजतक करीबन् हजार करोड़ होगी। आप माननीय सुप्रीम कोर्ट में टिहरी बांध पर चल रहे एन0 डी0 जुयाल शेखर सिंह बनाम भारत सरकार और पुनर्वास पर चल रहे मुकद्दमों से परिचित होंगे ही। पूर्व राज्य सरकार ने अपने शपथ पत्र में पुनर्वास ना होने का कारण टिहरी हाइड्रो डेवलपमेंट कारपोरेशन ¼टी] एच] डी] सी]½ द्वारा पैसा नही देना बताया था। कोर्ट ने नवम्बर 2011 ¼टी] एच] डी] सी]½ आदेश में पूर्व राज्य सरकार द्वारा मांगी गयी 102-99 करोड़ की राशि देने का आदेश दिया।
अभी भी माननीय सुप्रीम कोर्ट में पुनर्वास कार्य पूरा ना होने का कारण पैसे की कमी बताई जा रही है। आपने भी पिछले कई चुनावों में बार&बार पूर्व राज्य सरकार के बारे में कहा था कि वो टिहरी बांध विस्थापितों का पुनर्वास कार्य सही नही कर रही है। ंआपने 2010 के मानसून में टिहरी बांध झील के आसपास के गांवों की तबाही के संदर्भ में भी कहा था कि राज्य सरकार को टिहरी बांध से मिलने मुफ्त बिजली से जो आमदनी हो रही है उसे टिहरी बांध विस्थापितों के लिये खर्च करना चाहिये। आपका यह सुझाव ऊर्जा मंत्रालय की "Guidelines for development of Hydro Electric Projects Sites" 23 मई 2006 के अनुरूप है जिसमें पेज 0 10 पर लिखा है कि बांध से दी जाने वाली मुफ्त बिजली की आमदनी को बांध विस्थापितों पर खर्च किया जाये।

नीति का संबधित हिस्साः-

इसी संदर्भ में हम कहना चाहते है किः-
पथरी भाग 1] 2] 3 4 हरिद्वार के ग्रामीण क्षेत्र में रहने वाले टिहरी बांध विस्थापितों के मामले 30 वर्षाे से लंबित है। यहंा लगभग 40 गांवो के लोगो को पुनर्वासित किया गया है। यहंा 70 प्रतिशत विस्थापितों को भूमिधर अधिकार भी नही मिल पाया है। बिजली] पानी] सिंचाई] यातायात] स्वास्थय] बैंक] डाकघर] राशन की दुकान] पचांयत घर] मंदिर] पितृकुटटी] सड़क] गुल] नालियंा आदि और जंगली जानवरों से सुरक्षा हेतु दिवार व तार बाढ़ तक भी व्यवस्थित नही है। बीसियों वर्षो से यह सुविधायें लोगो को उपलब्ध नही हो पाई है। यदि कहीं पर किसी तरह से कुछ व्यवस्था बनी भी है तो स्थिति खराब है। स्कूल भी कुछ ही वर्षो पहले बना है वो भी मात्र 10वीं तक है। प्राथमिक स्कूलों की इमारतें बनी है पर अघ्यापक नही है। स्वाथ्य सेवायें तो है ही नही। रास्ते सही नही है तो निकासी नालियां भी नही है। यातायात की सुविधायें भी नही है। लोगों को मात्र जगंल में छोड़ दिया गया है। अपने बूते पर विस्थापितों ने मकान बनाये है।
11 जून 2012 को हरिद्वार क्षेत्र के शिवालिक नगर स्थित पुनर्वास कार्यालय के अधिकारी उप-अधिशासी अभियंता श्री राजेश नौटियाल ने बताया की हरिद्वार पुनर्वास क्षेत्र के लिये 4 करोड़ रुपये की मंजूरी हुई है। पैसा आने पर ही काम शुरु होगा। किन्तु इन कामों में उपरलिखित कोई भी काम नही है। जबकि यह मूलभूत समस्यायें है।
टिहरी बांध से मिलने मुफ्त बिजली से जो आमदनी हो रही है उसे टिहरी बांध विस्थापितों के लिये खर्च करना चाहिये। पथरी भाग 1] 2] 3 4 हरिद्वार के ग्रामीण क्षेत्र में रहने वाले टिहरी बांध विस्थापितों के 30 वर्षाे से लंबित कार्यो के निपटान के लिये इस राशि का उपयोग करना चाहिये।
आपसे हमारी मांग है कि निम्नलिखित विषयों पर तुरंत कार्यवाही का आदेश करेंः-

  • भूमिधर अधिकार तुरंत दिये जाये। यदि वन भूमि की समस्या है तो इस बारे में आप केंद्रीय पर्यावरण एंव वन मंत्रालय से स्वंय बात करें और विस्थापितों को भूमि अधिकार दिलायें।
  • ऊर्जा मंत्रालय की नीति के अनुसार विस्थापितों को मुफ्त बिजली दिये जाने के प्रावधान को लागू करें। इस विषय में केंद्रीय ऊर्जा मंत्रालय से बात करें।
  • शिक्षा] स्वाथ्यय] यातायात] सिंचाई व पेयजल और अन्य मूलभूत सुविधायें तुरंत पूरी की जाये। इन कार्यो के लिये टिहरी बांध परियोजना से] जिसमें कोटेश्वर बांध भी आता है] मिलने वाली 12 प्रतिशत मुफ्त बिजली के पैसे का उपयोग किया जाये।
  • सभी कार्यों के लिये विस्थापितों की ही समितियंा बनाकर काम दिया जाये ताकि कार्य की गुणवत्ता बने और सही निगरानी भी हो सके।

इस समय केन्द्र व राज्य में आपकी ही सरकार है। नये बांधों को बनाने से पहले कार्यरत बांधों के विस्थापन-पर्यावरण की समस्याओं का निदान आवश्यक व न्याय की मांग है।

                     घाटी में पिंडरगंगा चिरंजीवी दिवस मनाया गया


पिंडरगंगा को अविरल बहने दो-हमें सुरक्षित रहने दो, उर्जा जरुरत से नही इंकार, विनाशकारी परियोजना नही स्वीकार, पिंडरगंगगा चिरंजीव रहे के नारों के साथ पिडंरगंगा चिरंजीवी दिवस की रैली निकाली गयी। देवाल के पिंडरगंगा के पंचप्रयाग से जलकलश लिया गया और रैली वहंा से पूरे देवाल बाजार में निकाली गई।

आज ही के दिन एक वर्ष पूर्व 20 जनवरी 2012 को चेपड़ो गंाव में धोखे से देवसारी बांध के लिये पर्यावरणीय जनसुनवाई पूरी की गई थी। भूस्वामी संघर्ष समिति व माटू जनसंगठन ने तय किया था कि इस दिन को ’’पिडंरगंगा चिरंजीवी दिवस’’ के रुप में मनाया जाये।

विभिन्न गांवो से पहुचे महिला-पुरुषों ने पिंडरगंगा को चिरंजीव बहते रहने देने का उद्घोष करते हुये बांध को नकारा। विभिन्न वक्ताओं दिनेश मिश्रा, मदन मिश्रा, महीपतसिंह कठैत, पुष्कर सिंह, शोभनसिंह खत्री, नर्बदादेवी, के0डी0मिश्रा, मुन्नीदेवी, देवनराम, महेशराम, रामचंद्र, जशोदा देवी भूपेनसिंह रावत, बृजमोहनशाह आदि ने मुख्यतः कहा कि:-

पिंडर गंगा हमारे लिये है जीवन, संस्कृति, सभ्यता, रोजगार का स्थायी साधन, घाटी का सौंद्रर्य। यह हमारी धार्मिक आस्था का केन्द्र बिन्दु और संसार भर में पूज्य है। नंदादेवी की राजजात यात्रा मार्ग पिंडरगंगा के किनारे ही है। अभी राष्टीय नदी गंगा जी की यही एक मात्र सहायिका है जो कि निर्बाध बह रही है। इसी सुंदर घाटी में बांधों की कतार लगने वाली है जिसका घाटी के लोगों ने कड़ा विरोध किया है। जनता के संघर्ष का ही परिणाम था कि 3 बार जनसुनवायी हुयी और तीनो बार घाटी ने बांध को नकारा और कम्पनी की पोल खुल गयी। प्रशासन की मिली भगत से चेपड़ो गांव में बैरीकेट लगाकर जनसुनवाई का नाटक किया गया। राज्य प्रदूषण नियंत्रण बोर्ड के अधिकारियों ने कम्पनी का साथ दिया और जनता से डर कर बिना लोगों का विरोध सुने बिना ही भाग गये।          
20 जनवरी, 2011 से आज तक  बांध कम्पनी के साथ तू डाल डाल मैं पात पात का खेल चल रहा है। पर्यावरण मंत्रालय ने अभी बांध की स्वीकृति नही दी। वन स्वीकृति के लिये आवश्यक कागजात भी जनता के सामने नही रखे। इसके बावजूद भी बांधों को लादने की कोशिशें जारी है। बांध कम्पनी की कोशिश यही रही कि किसी भी तरह से बिना किसी स्वीकृति के ही बांध के काम को आगे बढ़ाया जाय। जिसके लिये कानूनों का नीतियों का उलंघन, थोड़े पैसों का लालच देना और दलाल खड़े करवाना ये इनकी कारगर नीतियां हैं।
सत्य यही है कि 2009 से आज तक बांध स्वीकृति को हमने रोककर रखा है। जिसमें घाटी के गांव-गांव के मजदूर-किसानों खासकर बहनों के संघर्ष की हिस्सेदारी रही है।बांध के लिये वन स्वीकृति की कोशिशें बांध कंपनी कर रही है। चूंकि पर्यावरण स्वीकृति, वन स्वीकृति के बाद ही मिल पायेगी। बांध कंपनी की कोशिश यह भी है कि वो वन स्वीकृति के लिये आवश्यक कागजातों को सार्वजनिक ना करे। हमने इस बात को पकड़ा तो पर्यावरण मंत्रालय की वन समिति ने बांध कम्पनी से कागजात को वेबसाइट पर रखने को कहा। यह खेल कई बार चला किन्तु किन्ही दबावों के चलते 22 दिसम्बर 2012 को संपन्न वन समिति की बैठक में देवसारी बांध का विषय लाया गया। किन्तु अभी वन स्वीकृति नही हुई है।



ज्ञातव्य है कि बांध के लिए आवश्यक हैः- 1-पर्यावरण स्वीकृति, 2-वन स्वीकृति चरण-एक 3-वन स्वीकृति चरण-दो  4-राज्य सरकार की वन स्वीकृति आदि स्वीकृतियंा बांध कपंनी को अभी नही मिली हैे। जिनके बिना बांध नही बन सकता है।

22 दिसंबर 2012 को वन सलाहकार समिति ने कहा कि वो चतुर्वेदी समिति की रिर्पोट के बाद ही बांध कपंनी के प्रस्ताव पर विचार करेगी। सरकार ने राष्ट्रीय नदी गंगा व उसकी सहायक नदियों में लगातार बहने वाला पानी कितना हो यह तय करने के लिये योजना आयोग के सदस्य श्रीमान बी. के. चतुर्वेदी की अध्यक्षता में विभिन्न मंत्रालयों की एक समिति बनाई है जिसकी रिपोर्ट मार्च 2013 में आने की संभावना है।

पूरे उत्तराखंड में बांधों से विस्थापन, स्थायी रोजगार का छिनना, पानी की समस्या, सब जारी है। चमोली में ही विष्णुगाड बांध से विस्थापित 30 परिवारों का पुनर्वास नही हो पाया है। इसलिये जीवन भर रोज रोज की समस्यायें परेशानियां हम भी क्यों झेले? क्यों नही जन आधारित घराट जैसी बिजली परियोजनाये बने जिसमें स्थानीय लोगो को स्थायी रोजगार भी मिले और हमारी पिंडरगंगा घाटी भी सुरक्षित रहे। चन्द लोगों के अपने लालच के लिए पिण्ड़र की जनता अपनी घाटी की तबाही नही देख सकती।

World Bank Misleads Public on Vishnugad Project: Communities Asks Them to Report Facts

The press release issued by the World Bank (Bank) India office on January 10 is misleading and has gone too far defending the project without waiting for the Inspection Panel (IP) to do its investigation. We wonder whether this is a veiled attempt to influence the process and to send across a message to all affected communities that, irrespective of their complaints, the Bank will have its way.

We deplore the tone and tenor of the press release and the accompanying ‘questions and answers’ posted on Bank website for they being misleading and for its message that the concerns of the affected communities will not be given the due seriousness. Inspection Panel is the only forum within the Bank where affected communities can seek redressal for the damages caused by a Bank funded project.

The press release claims that Vishnugad Pipalkoti Hydro Electric Project (VPHEP) “is a sustainable hydropower project with manageable impacts that have been thoroughly assessed and for which appropriate mitigation measures are prepared.” The distance of flowing river between the upstream Tapovan Vishnugad HEP now under construction and the downstream proposed Vishnugad Pipalkoti HEP is exactly zero and yet the Bank has the temerity to call it sustainable.

This defensive stand of the management contradicts the Bank’s own status report in May 2012 when the Bank found the Overall Implementation Progress “Unsatisfactory” (compared to “satisfactory” rating in the previous review 6 months earlier) and Risk Rating becoming “High” (compared to “Substantial” previously)1. Disturbingly, the next Implementation review report is dated Dec 15, 2012, but the Bank has refused to make it public2.

There is no credible, comprehensive cumulative impact assessment done for the dams coming up on Ganga River Basin to estimate the damage the dams can cause. How can mitigation plans be prepared without estimating the damage? Nor there are any studies to ascertain the carrying capacity of the river taking into accoung the basin wide river use pattern by the various communities for their needs and livelihoods. Bank’s claim of “thorough assessment” is more exposed in the context of the environmental flow of Ganga is not determined yet. The BK Chaturvedi committee, an inter-ministerial committee headed by Planning Commission member B K Chaturvedi, was constituted in June 2012 by the Prime Minister's Office to recommend the flow that should be maintained in the Ganga and its tributaries. Their report is yet to be made finalized and made public.

As stated rightly in the Bank press release, the second stage forest clearance for the project is still awaited. We wonder why the Bank was in a hurry to approve the project before all clearance was in place. We wonder whether the Bank approval was again used as a pressure on the authorities to give all clearances. In 1985 the Bank had approved financing the Sardar Sarovar (Narmada) dam two years before it was given environmental clearance by the government of India. Bank’s lending was used then to put pressure on the government to bestow environmental clearance to a project which is, till date, an example of monumental destruction to people and environment. It was in fact the Narmada episode that led to the Bank setting up the Inspection Panel.

Even as the Bank press release claim that the construction could begin only after the Forest Clearance is in place, blasting has already began for construction of tunnel for the Power House, putting the people in Harsari villagers under immense strain. Blasting continues at night as well, making it difficult for the people to live there.

The Bank press release tries to misrepresent what its Board of Executive Directors (Board) decided. Having received the complaint in early July 2012, the Inspection Panel found it to be eligible and the request for investigation was registered exactly a month later. There after all concerned were notified by the Inspection Panel about the registration of request. It waited for the management (Bank) response for over 2 months, and after extending the deadline twice, they submitted their response to Inspection Panel on October 24. As mentioned in the Press Note of January 9, before preparing the Report and Recommendation a team of Inspection Panel had visited the project site, met with different stakeholders at different locations and it’s on the basis of these meetings that an investigation was recommended to the Board.

The Board “approved the Inspection Panel's Report and Recommendation to investigate matters of policy noncompliance and related harm raised in the Request for Inspection”3 in its December 18 meeting. While an investigation does not cast any judgment on the project, it’s a recognition that there are outstanding and unsettled issues involved in the project. It was deplorable for the Bank to agree to suspend the beginning of the full investigation till March 15, 2013, once the full investigation is approved.

We are concerned about many media reports that suggesting that the Ministry of Power has put undue pressure on the Bank to keep the report of the Inspection Panel under wraps until the Maha Kumbh Mela gets over. It is reported that the request was made in order to avoid agitations that the findings may trigger some protests by the Hindu pilgrims and spiritual leaders. We wonder whether Bank is in connivance with the government in suppressing the report from being made public. The Bank owes an explanation on why it will disclose the report and other documents only after March 15 and not immediately.

World Bank Inspection Panel to Investigate Vishnugad-Pipalkoti Dam

First of its kind for any hydro projects funded by the World Bank (WB) in India, the recourse mechanism of the WB, the Inspection Panel will investigate the policy violations by the proposed 444 MW Vishnugad Pipalkoti Hydro Electric Project built on Alaknandaganga river, a main tributary of Ganga, in Uttarakhand.

World Bank’s Board of Executive Directors approved the Inspection Panel's Report and Recommendation to investigate matters of policy non-compliance and related harm last month. 

This was followed by a complaint filed by the affected communities and their representatives in July last year to the Inspection Panel, raising serious social and environmental issues arising out of this project.

The complaint has raised issues of water shortages that will occur in the stretch of the river where water will be diverted into the underground tunnel. The "environmental flow" of the river has not been properly estimated and yet to finalized. It further said that the quality of the water in the Alaknanda River will be degraded when it is diverted into the underground tunnel and its free flow is blocked.

The loss of aquatic species and also degradation of the natural habitat of endangered species such as the "Cheer" pheasant, otter, and mahaseer fish is yet another major issue raised in the complaint.  There are serious concerns about the loss of livelihood due to this project. People’s access to river, sand and fish will be severely impacted due to this project. There are also health issues people are afraid of. Considering the inadequate and flawed Environment Impact Assessment used for the public hearing of the project, the World Bank got a fresh EIA done, but that was neither part of legal process, nor part of public consultation.

The houses and land located in the area under which the tunnel is being dug have developed cracks already (the project is yet to get final forest clearance without which any work is illegal and blasting for making tunnel for the Powerhouse are continue) and there has been no compensation for this. They also fear these houses will collapse if there were to be an earthquake as the area is in a high risk seismic zone. Construction and planning of multiple bumper to bumper dams on the same river has led to the possibility of serious negative impacts but these have not been analyzed via a comprehensive credible cumulative impact assessment. World Bank has not conducted an analysis of the no-project scenario, nor has there been a study of the impacts of the Project on different stakeholders.

In addition to this, the complaint also says that due to the diversion of the river there is no river water available for religious and cultural rituals like bathing festival, funeral rites, river worship, etc.

“We are happy that the complaint has been accepted for a full investigation by the Inspection Panel” said Briharshraj Tadiyal, one the complainants. Another complainant Bharat Jhunjhunwala said “we hope for a fair and independent investigation and no work or funds disbursements should happen till all issues are settled to the satisfaction of all concerned”.

The recommendation for investigation was given by the Inspection Panel after their visit to the project in November last year, meeting all parties connected with the project. Among the representations before the panel it was shown that there is zero length of free flowing river between the upstream under construction Tapovan-Vishnugad HEP  and Planned Vishnugad Pipalkoti Project.

Inspection Panel was set up in 1993 following the Independent Review Committee which looked into the violations by Sardar Sarovar (Narmada) Dam resulting World Bank’s withdrawal from the project.

One Not Varied Rehabilitation Policy For the Affected People!
Note Admitted For the Final Hearing in the Supreme Court


The Final hearing has commenced in the Supreme court case over Tehri Dam on River Bhagirathi in Uttrakhand .While beginning the proceedings of the final hearing for the October 2005 case of N. D. Juyal & Shekhar Singh V/s Government of India, Tehri Hydro Development Corporation (THDC) and others, Honourable Justice, on 22.8.2012 asked the appellant for the point wise information on all the issues which the dam proponent THDC must address/should have addressed before the filling of water in the Tehri Dam reservoir, for this 3 weeks were given to the appellant. Based on this information, the Dam Corporation and the Governments would respond within a time span of 3 weeks, after the same is submitted, the Supreme Court would begin the final hearing of the case. Matu Jan Sangathan has been sustaining the ground-swell in this case.
 
It is pertinent to note that the case challenges the order which had came after a 12 year long legal case between N.D Juyal & Shekar Singh V/s Government of India, Tehri Hydro-Electric Development Corporation and others in the year 2003. In this Tehri Dam was to be built in line with the environment and rehabilitation clauses, it was stated that in case of dispute the local high court was to be referred. Since the Work on the dam commenced, in contravenes of the environment and rehabilitative clauses, the petitioners had to file a case in the Nanital High court on 18.12.2004. The Nanital High court order came on 29 October 2005. At the time of Nanital High court order the rehabilitation conditions were dismal and there were protests for rehabilitation at various part of the affected area. The very next day, on 30 October 2005,the petitioners challenged the order of the Nanital high court in the Supreme court. The 7 year long case has seen more than 40 rulings which has carried forward the rehabilitation process for the displaced and has resulted in a ruling which restricts the Tehri Dam water level to 820 meters.
In the note submitted to the Supreme Court by Shri Sanjay Parikh, advocate for the PIL, has given a list of events and comprehensive backdrop of the case. He has emphasized the significant issues related to environment and rehabilitation problems. A brief outline of the same is as follows:
COMMAND AREA: This was mentioned in the Supreme Court order dated 01.09.2003. The environment and forest ministry had not made this available even under right to information.
CATCHMENT AREA: The Petitioners have been arguing that Catchment Area Treatment (CAT) has not been done properly and that certain areas have been left out. There has been wide scale landslides/ land erosion in the catchment area. Recently, in August 2012 massive soil erosion took place in as much as part of the forest in catchment area swept into the reservoir; the reservoir is full of trees, stumps, wood, muck & soil. A team of experts should be constituted by the MoEF to carry out complete study of the catchment area as the entire Uttarakhand region has become extremely sensitive and fragile. This is in the interest of safety of the people living in Uttrakhand.
RESETTLEMENT & REHABILITATION (R&R): The work at rehabilitation sites is still incomplete. This is borne out from the report which is given by the Joint Committee March, 2010 appointed by the State of Uttarakhand. The report also mentions that land rights have still not been given to the oustees of the land where they have been rehabilitated. There are number of other issues discussed in the said Report namely; provisions of Hospitals, improvement and care of agricultural land, construction of wall to save the rehabilitation sites from wild animals, care and upkeep of drinking water, constitutions of panchayats etc. in so many rehabilitation sites no educational institutions exists. The rehabilitation sites namely Pathri (I to IV) and Sumannagar have no transportation facilities; therefore, people are suffering serious problems in commutation. Compensation to the shop-keepers of the affected rural area has not been given. 202 families residing at 820 to 835 mtrs are still to be rehabilitated. There is requirement of Forest Land for remaining affected families. The State of Uttrakhand, itself had admitted in a report of Joint committee that it needs to undertake completion of balance work of rehabilitation. 156 complaints are pending for redressal.
INCOMPLETE BRIDGES AND CUT OFF AREAS: Of the proposed three bridges for the cut off area, the work has begun at only one at Dobra Chanti, the other two at Chinyalisaur and Ghonti bridge the work has not yet begun. This has been admitted by the State of Uttarakhand in its affidavit dated 12.12.2011.
There cannot be any discrimination/ different treatment among the three villages i.e. Raoulkota, Nakot and Siyansu and other villages which have been found to be similarly affected due to raise in water level in the Tehri Dam Reservoir. It cannot be contented that R& R will apply to only three villages, when the provisions of R& R have to comply with Art. 21 of the Constitution. Oustees situated similarly cannot be treated differently by applying to one set of oustees the rehabilitation Policy and the ‘Collateral Damage Policy’ to others. Environment clearance of Tehri Dam Project dated 19 July, 1990 stated that the "rehabilitation package covering population affecting Koteshwar Dam as well as those living on the rim of the reservoir and likely to be affected will be prepared before 31.3.1991.", but the rehabilitation of Raulakot is still to be done, in addition to the other affected villages as mentioned in the Joint Expert Committee Report. Land sliding due to filling of water in Reservoir and induced seismicity and directly related to Tehri Dam and cannot be put in the category of collateral damages. Survey by Geological Survey of India should continue so that the villages which are sinking or are affected by landslides receive adequate help and R & R in advance.
Non Compliance of orders dated 17.9.2010 & 9.11.2010 The supreme court had given several directions vide the Orders dated 17.9.2010 and 09.11.2010 in these orders Supreme Court itself had underlined the rehabilitation related issues, but these orders have been over sighted .
MONITORING A continuous monitoring of the Tehri Dam, its Catchment areas and affected villages is required and therefore, an Expert Committee under the MoEF should be constituted which continuously reports on issues concerning safety, environment and rehabilitation of the affected persons so that timely action in advance is taken to avoid any disaster and to ensure safety, security and rehabilitation of the families.
In the present state of affairs when the state of Uttrakhand and the centre is ruled by the same party and both are ardently advocating new dams in Uttrakhand., they also must, without difficulty, resolve the Tehri Dams displacement and rehabilitation issue which has been the most devastating environmental and displacement calamity for Uttrakhand. The long -term progress of Uttrakhand cannot be sustained by turning a blind eye to the environmental questions in the name of development.

सभी प्रभावितों के लिये पुनर्वास नीति एक हो!

अंतिम सुनवाई के लिये सर्वोच्च न्यायालय में नोट

उत्तराखंड में भागीरथी पर बने टिहरी बांध पर सर्वाेच्च न्यायालय में चल रहे मुकद्दमंे की अंतिम सुनवाई चालू हो गई है। माननीय न्यायाधीश ने अक्टूबर 2005 से चले से चले रहे एन0 डी0 जुयाल व शेखर सिंह बनाम भारत सरकार, टीएचडीसी व अन्य मुकदमे में अंतिम सुनवाई की शुरुआत करते हुये 22-8-2012 को पहले वादियों से उनके सभी मुद्दों पर बिंदुवार जानकारी चाही जिनको बांध का जलाशय के पूरा भरने से पहले बांध प्रयोक्ता, टिहरी जलविद्युत निगम को पूरा करना चाहिये। जिनके लिए उन्हें तीन हफ्ते का समय दिया गया था। वादियों द्वारा दी गई जानकारी के बाद बांध कंपनी और सरकारें उस पर तीन हफ्ते में अपना जबाब दाखिल करेंगी। जिसके बाद सर्वोच्च न्यायालय अंतिम सुनवाई चालू करेगा। माटू जनसंगठन इस मुकद्दमंे से संबधित जमीनी कार्य से जुड़ा है।

ज्ञातव्य है कि टिहरी बांध के खिलाफएन0 डी0 जुयाल व शेखर सिंह बनाम भारत सरकार, टीएचडीसी व अन्य लगभग 12 वर्ष पुराने मुकदमें का फैसला 2003 में आया था। जिसमे टिहरी बांध को पर्यावरण व पुनर्वास की शर्तो का अनुपालन करने के साथ बनाने की इजाज़त दी गई थी। साथ ही कोई समस्या होने पर स्थानीय हाईकोर्ट में जाने को कहा गया था। पर्यावरण व पुर्नवास की शर्तो का अनुपालन किये बिना बांध का काम आगे बढ़ाने जाने पर वादियों ने 18.12.04 को नैनीताल हाईकोर्ट में याचिका दायर की जिसका फैसला 29 अक्टूबर 2005 को आया। इस फैसले के समय भी पुर्नवास कि स्थिति भी बहुत ख़राब थी। जगह जगह पुनर्वास के लिए आन्दोलन चल रहे थे। वादियों ने अगले दिन ही 30 अक्टूबर 2005 को माननीय सर्वाेच्च न्यायालय ने इस फैसले को चुनौति देते हुए सर्वाेच्च न्यायालय में याचिका दायर की गई। लगभग 7 वर्ष से चल रहे मुकदमें में 40 से ज्यादा आदेशों द्वारा विस्थापितों के पुनर्वास की प्रक्रिया आगे बढ़ी साथ ही टिहरी बांध का जलाशय अभी भी 820 मीटर से ऊपर भरने की इजाज़त नहीं है।

सर्वाेचय न्यायालय में दाखिल किये गये नोट में 21 वर्षों से टिहरी बांध पर दायर जनहित याचिका के अधिवक्ता संजय पारिख ने अदालत को पूरे मुकदमें का सारांश व अदालती कार्यवाही की तिथिवार सूची दाखिल की है। जिसमें उन्होंने महत्वपूर्ण तरह से टिहरी बांध से जुड़ी पर्यावरणीय व पुर्नवास की समस्याओं को रेखांकित किया है। जिसका हम सारांश नीचे दे रहे है।

कमांड एरिया-सर्वाेच्च न्यायालय के 1/9/2003 के आदेश में इसका उल्लेख किया गया था। सूचना के अधिकार के तहत भी जानकारी पर्यावरण एंव वन मंत्रालय और टीएचडीसी ने यह उपलब्ध नहीं कराया है।

जलसंग्रहण क्षेत्र उपचार योजना- वादियों ने शुरू से अदालत को यह बताया है कि इस पर सही तौर पर काम नहीं किया गया है। जलसंग्रहण क्षेत्र में भूस्खलन भू-शरण बहुत तेजी से हो रहे है। हाल ही में अगस्त 2012 में भारी मात्रा में लकड़ी, पेड़, मिट्टी, मलबा, जलाशय ने दाखिल हुआ है। वादियों की और से सुझाव दिया गया है कि केंद्रीय पर्यावरण और वन मंत्रालय द्वारा एक समिती बने जो पुरे टिहरी बांध क्षेत्र का आकलन करे।

पुर्नवास पुर्नस्थापना अभी भी पूरा नहीं हुआ है राज्य सरकार वह टीएचडीसी की संयुक्त निरीक्षण समिति 2010 की रिपोर्ट के अनुसार भी यह सिद्ध होता है। अभी तक सभी विस्थापितों को भूमिधर अधिकार तक नहीं दिए गये है।  

राज्य सरकार के शपथ पत्र 12/12/2011 के अनुसार भी ग्रामीण दुकानदारों को मुआवजा नहीं मिला है। 156 केस शिकायत विभाग के सामने लंबित है। जलाशय स्तर 820 मीटर से 835 मीटर के बीच 202 परिवार रहते है। शेष प्रभावित परिवारों के लिए जंगल भूमि के लिए जरूरत है। टिहरी जिलाधिकारी व पुनर्वास निदेशक का कार्यभार एक ही व्यक्ति के पास होना, पुनर्वास कार्य की गति को बाधित करता है इसलिए आवश्यक है की पुर्नवास निदेशक आवश्यक स्टाफ के साथ अलग ही नियुक्ति हो। पुराने टिहरी शहर का संस्कृति केंद्र का बनना है। ग्रामीण पुनर्वास स्थल शिवालिक नगर और रानीपुर में समुदाय सेवाओं का बनना है। जलाशय स्तर 820 मीटर से 835 मीटर के बीच बेनाप भूमि धारकों मुआवजा और अन्य समुदायिक सेवाओं को बनाने में छह महिने लगने है। टिहरी बांध जलाशय के खतरनाक हिस्सों पर सुप्रीम कोर्ट के आदेशानुसार जानमाल की रक्षा हेतु के अनुसार तार बाढ़ बननी है। इसके अलावा ग्रामीण पुनर्वास स्थलों पर अस्पताल, कृषि-भूमि का रखरखाव, जंगली जानवरों से सुरक्षा हेतु तार-बाढ़, पीने के पानी की सही व्यवस्था, पंचायतों का गठन आदि नही हुआ। अनेकों पुनर्वास स्थलों में शिक्षा व्यवस्था का न होना, पथरी भाग एक से चार व सुमन नगर में यातायात का प्रबंध नही है। यह सब काम अभी होने है। सरकार ने प्रति प्रभावित परिवारों को 100 यूनिट बिजली देने की घोषणा की थी पर उसे पूरा नहीं किया है। टिहरी बांध जलाशय की सीमा रेखा परिवर्तन के कारण 45 गाँव में प्रभावित परिवारों का पुर्नवास होना है।

पुलों का ना बनना-
कट ऑफ़ एरिया के लिये प्रस्तावित तीन पुलों में से डोबरा चंाटी पुल अभी कुछ ही बन पाया है। शेष दोनो चिन्याली सौड़ और घांेटी पुलों पर अभी काम तक चालू नहीं हुआ है। राज्य सरकार के शपथ पत्र 12/12/2010 के अनुसार इन पुलों को पूरा होने में लगभग दो साल लगने थे।
रोलाकोट, नकोट, स्ंयासु और अन्य गाँव जो कि टिहरी बांध जलाशय से पानी भरने के कारण से प्रभावित हुए है। इर सभी के लिये एक ही तरह की नीति अपनाई जानी चाहिए। यह किसी भी तरह से सही नहीं होगा की इन तीन गाँवों के लिए ही पुनर्वास/पुनर्स्थापना नीति हो जबकी संविधान की धारा 21 के अनुसार भी एक समान तरह से प्रभावित हुओं के लियेे एक नीति होनी चाहिये। टिहरी बांध की पर्यावरण स्वीकृति 19.07.90 में भी साफ लिखा है कि पुनर्वास पैकेज कोटेश्वर बांध और जलाशय से  प्रभावित आबादी तथा वे लोग जो बांध की झील के रिम क्षेत्र में रहते हो और प्रभावित हो रहे हों, उनके पुनर्वास का पैकेज 31-3-1991 से पूर्व तैयार हो जाये।’’ टिहरी बांध जलाशय में पानी भरने के कारण हो रहे भूस्खलन को अलग आपदा वर्ग में नहीं रखा जा सकता। भारतीय भूगर्भ सर्वेक्षण द्वारा सर्वे लगातार होना चाहिये ताकि जो गांव धसक रहे है या भूस्खलित हो रहे है उनकी समुचित मदद और पुनर्वास/पुनर्स्थापना पहले ही हो जाये।

आदेशों का पालन नही
सर्वाेच्च न्यायालय द्वारा दिये गये 17/9/2010 और 9/11/2010 के आदेशों का पालन नहीं हुआ है। जिसमें स्वंय सर्वोच्च न्यायालय ने पुनर्वास संबधित विषयों को रेखांकित किया था।

बांध की निगरानी टिहरी बांध के जलसंग्रहण क्षेत्र और प्रभावित गांवों की लगातार निगरानी की जरुरत है जिसके लिये पर्यावरण एंव वन मंत्रालय के अंतर्गत एक विशेषज्ञ समिति बने। यह समिति लगातार सुरक्षा, पर्यावरण और प्रभावितों के पुनर्वास पर अपनी रिर्पोट लगातार देती रहे ताकि त्रासदी को पहले ही दूर किया जा सके। और प्रभावितों की सुरक्षा, पुनर्वास निश्चित हो सके।

आज कि परिस्थिति में जब राज्य व केंद्र में समान दलो की सरकारें है और दोनो ही उत्तराखंड में नए बंाधों की वकालत कर रही है तो उन्हे उत्तराखंड के सबसे बड़े पर्यावरणीय व विस्थापन की त्रासदी पैदा करने वाले टिहरी बांध के विस्थापितों के पुनर्वास की समस्या को आसानी से सुलझा लेना चाहिए। उत्तराखंड राज्य के दीर्घकालीन विकास को देखते हुये पर्यावरण से जुड़े सवालों को विकास के नाम पर उपेक्षित नही करना चाहिये।

Assiganga is one of the main tributary of Bahgirathiganga which meet Bhagirathiganga in Uttarkashi, The Assiganga valley is very beautiful, green and thus a place that many tourists like to visit. The Dodital is also a reason people like to visit. The Assiganga Valley is small, but full of biodiversity and the tens of tributaries that meet in the Assiganga. There are 7 villages in the valley. 

A Cloud burst  on 3rd August, 2012 in Assiganga valley near Sangam Chatti.The situation in the Assiganga valley, now, however is not very good. The river bed is full of stones, uprooted trees and also dam materials. Main road towards Sangam Chatti has collapsed. 

Their are Hydro Power Project are coming up in this small valley named Assignaga HEP phase-1,2 and 3. The Power House of the Assignaga HEP phase-2 was destroyed by the heavy rainfall during the cloud burst.

According to villagers the situation has become worse because of the extensive use of explosives, used for the building of 3 Assiganga HEPs. Muck from the dam has been spread all over the place without following any norms or environmental safeguards. Due to this, the devastation in the valley has worsened. Workers in the three HEPs living near the river lived in tin sheds, these have been washed away. Although the Govt. is claiming that less then 30 people died, this is not the reality. Houses near the river have cracked or been destroyed, low level fields are now filled with sand, big boulders have rolled on to the riverbed, and bridges have disappeared. Villagers have lost their connectivity, and village paths have also been destroyed.
