माननीय सर्वोच्च न्यायालय ने नोटिस जारी किया
माननीय सर्वोच्च न्यायालय ने गंगा पर प्रस्तावित कोटली-भेल परियोजनाओं पर पर्यावरण एंव वन मंत्रालय और नेशनल थर्मल पावर कारपोरेशन को नोटिस जारी किया। विमलभाई, राजेन्द्रसिंह नेगी व त्रिलोक सिंह रावत माटू जनसंगठन और डा0 भरत झुनझुनवाला द्वारा पर्यावरण स्वीकृति को चुनौति देने वाली याचिका पर माननीय न्यायाधीश श्री डी0 के0 और श्री अनिल आर0 दवे ने 27 जनवरी 2012 को यह नोटिस जारी किया।14 सितम्बर 2010 को राष्ट्रीय पर्यावरण अपीलीय प्राधिकरण ने कोटली-भेल ए 1 (195 मेवा) और कोटली भेल 2 (520 मेवा) की पर्यावरण स्वीकृति पर रोक की याचिका को यह कहते हुये खारिज कर दिया था कि गंगा के प्रवाह पर बांधो से कोई फर्क नही पड़ेगा। वादियों ने प्राधिकरण के इसी निर्णय को चुनौति माननीय सर्वोच्च न्यायालय दी है।
वादियों की ओर से वरिष्ठ अधिवक्ता श्री राजपंजवानी, सुश्री अनिता शिनाॅय, श्री रित्विक दत्ता एंव श्री राहुल चैधरी ने अदालत में पक्ष रखा। इन भीमकाय बांधों में जहंा विभिन्न महत्व के पर्यावरणीय व सामाजिक विषयों संबधी प्रश्न अनुत्तरित है वहीं उत्तराखंड के सांस्कृतिक समृ़द्ध क्षेत्र पर भी डूब का खतरा मंडरा रहा है।
भागीरथी पर प्रस्तावित कोटली-भेल 1 अ में 17 किलोमीटर जलाशय प्रस्तावित है जो कि भागीरथीगंगा का आखिरी स्वतंत्र हिस्सा शेष है। इसके ऊपर मनेरी भाली चरण एक, मनेरी भाली चरण दो, टिहरी बंाध, कोटेश्वर बांध कार्यरत है। यह पूरा क्षेत्र भूकंप प्रभावित है। 2010 के मानसून में कोटली-भेल 1 अ के प्रस्तावित बांध स्थल के निकट ही स्थापित एनएचपीसी का दफ्तर धाराशायी हो गया था।
प्रस्तावित कोटली भेल चरण 2 का 32 किलोमीटर जलाशय भागीरथीगंगा और अलकनंदागंगा के आघ्यात्मिक संगम देवप्रयाग जहंा से गंगाजी पहाड़ो में पूर्ण होती है उसको डूबायेगा। महत्वपूर्ण बद्रीनाथ धाम का प्राचीन ऐतिहासिक मार्ग व उससे जुड़े आध्यात्मिक स्थलों को भी डुबाने की तैयारी है।
राष्टीय नदी गंगा जी के प्रति अपना कत्र्वय निभाने के लिये हम हर स्तर पर संघर्ष करेंगे, जमीनी स्तर से लेकर माननीय अदालत में भी।

Supreme Court Notice to NHPC and MoEF on Kotli-Bhel two projects
The Supreme Court of India issued notice to Ministry of Environment and Forest and National Hydro Power Corporation on Two HEPs named Kotli-Bhel 1A (195MW) and Kotli-Bhel 2 (520MW).
Earlier on 14 Sept 2010 National Environment Appellate Authority dismissed appeal against the environment clearance of these two projects filed by Vimalbhai, Rajendra Singh Negi, Trilok Sing Rawat of Matu Jansangthan.
NEAA order has been challenged in Supreme Court by Vimalbhai, Rajendra Singh Negi , Trilok Sing Rawat of Matu Jansangthan and Dr. Bharat Jhunjhunwala.

ANIL R. DAVE heard the Appeal against the order of NEAA and
issued notice to Ministry of Environment and Forest and National Hydro Power Corporation.
Sr. Advocate Raj Panjwani with Anitah Shenoy, Ritwik Dutta and Rahul Choudhary
represented the petitioners before the court.
Despite of various environmental and social issues which remain standing unanswered, a very significant cultural area is also under the threat of submergence.
These dams are proposed on Bhagirathiganga and Ganga. Kotli-Bhel 1A (195MW) is proposed on Bhagirathiganga. The making of a 17 K.M. long reservoir would amputate Ganga from its last free stretch near the Holy confluence of Alaknandaganga and Bhagirathiganga, “Devpryag”. After Devpryag, it flows as Ganga. This proposed project is just after the two big reservoirs of Tehri dam and Koteshwer dam. The area is also very much landslide prone. It is important here to indicate that in 2010 monsoon, the office of project proponent NHPC itself collapsed, which was nearly half K.M. from the proposed dam site.
Proposed Kotli-Bhel 2 HEP (520MW) consists of a 32 K.M. long reservoir which will submerge the Holy Devpryag. The reservoir is supposed to stretch till the Bhagirathiganga and the Alaknandaganga. This is how a triangular reservoir will come up around the Devpryag. The old Badrinath Marg for pilgrims will also get submerged.
We will fight the battle both, on ground and at the Hon'ble Court to obey our duty towards our National River Ganga and its inhabitants.
