The Environment Public Hearing for the proposed Devsari HEP (252 MW) was a complete sham and led to the complete humiliation of the people of the Pinder Valley. The officers of the District Administration and the Uttarakhand State Environment Protection and Pollution Control Board were completely part of this drama held on January 20, 2011 at the Chepdu village on the banks of the River Pinder.
The public hearings for the project held on 13-10-2009 and 22-07-2010 were opposed by the people due to their procedural and legal violations and the 20-01-2011 public hearing was no different. This public hearing, too, was not legally or procedurally sound. Just like in the public hearings of 13 October 2009 and 22 July 2010, there is a long list of legal violations in the 20 January 2011 public hearing.
The stage set for the public hearing was 12 feet above the ground and behind it was a solid wall. In the 50 feet area around the stage there were three barricades set up. Thus, it was clear that the whole meeting had been well thought off and planned in advance. Behind the barricades was where this well – rehearsed drama of environment public hearing was being played out. The people from the affected villages of Deval, Tharali and Narayan Bagad block, in spite of lack of resources, turned up for the public hearing in thousands. People were shouting slogans such as- “Let the Pinder flow free- Let us be safe- Dam Company, go back- Suspend this fake public hearing”. And the police, the people from the project company and the barricades prevented the people from putting forward their views. The people could not even reach the stage during the entire hearing. Next to where the officers of the Uttarakhand State Environment Protection and Pollution Control Board sat, there was a small passage for the people to get to the stage. This passage, however, was being guarded by the police and the officers from the SJVN.
The Board was clearly on the side of the dam company; they could be seen following the SJVN’s orders. Only a few people were allowed to go on stage and these were people who were associated with the dam company. When the 63 year old, former teacher Mr Dinesh Mishra tried to get on stage with a letter, he was pushed and shoved and not allowed to do so. The women were also stopped from taking stage. When, somehow, from the ranks of the dam affected, Mr Madan Mishra got onto the stage to speak, the sound system was tampered with and the mikes went off. He was not allowed to finish.
The Additional District Collector, who was presiding over the public hearing, also did not pay attention to the blatant legal and procedural violations. Either he did not know that the public hearing is the one and only opportunity for the people to put forward their views, oppositions, etc or he just decided to sit there tongue-tied. The few people allowed onto stage said the exact thing given as the rules for public hearings in the Environment Impact Assessment Notification of 14 September 2006.
The company had not made any arrangements to get the affected people to the public hearing. The people spent their own money to get there. And yet, they were not allowed to make their point. This public hearing did not just cheat the people of their rights, but was also a great insult to the people of the Pinder valley. The Bhu- Swami Sangharsh Samiti and Matu Jansangathan have been continuously writing to the Board and keeping them abreast with the legal and procedural violations, but no action or enquiry has been undertaken by the Board in this matter.
But we will not keep quiet. After the public hearing, there was a huge meeting at Deval where this event was condemned and it was announced that the people were prepared for the long fight ahead.
On the afternoon of 21 January, the leaders of Bhu- Swami Sangharsh Samiti and Matu Jansangathan went to the office of the Uttarakhand State Environment Protection and Pollution Control Board and put the matter before the member Secretary of the Board, Mr Ajay Gairola. He guaranteed that after the investigation of the tathyon and after taking the views of the Board members into account, once they return from Tharali, he will talk to us. Only then will he take a decision on the public hearing.
On 24 January in the Gopeshwar office in the Chamoli District, around 250 people from affected villages surrounded the District Collector and demanded that this staged fake public hearing be suspended.

पूरी तरह से पिंडर घाटी की जनता को अपमानित करके प्रस्तावित देवसारी जलविद्युत परियोजना (252 मेगावाट) की पर्यावरणीय जनसुनवाई का खेल किया ंगया। 20 जनवरी 2011 को चेपड़ू गंाव में पिंडर नदी के किनारे हुये इस खेल में जिला प्रशासन, उत्तराखण्ड राज्य पर्यावरण संरक्षण एंवम् प्रदूषण नियंत्रण बोर्ड के अधिकारी पूरी तरह शामिल थे।
ज्ञात्वय है कि इस परियोजना की 13-10-2009 व 22-7-2010 को हुई जनसुनवाईयंा भी लोगो ने प्रक्रियागत व कानूनी खांमियों के कारण लोगो द्वारा नकार दी थी। 20-1-11 की जनसुनवाई भी ना तो कानूनी रुप से सही थी ना ही व्यवहारिक रुप में सही थी। 13 अक्तूबर 2010 व 22 जुलाई 2011 को स्थगित हुई जनसुनवाईयों में 20 जनवरी 2011 की जनसुनवाई में भी हो रहे कानूनी उलंघनों की लम्बी सूची रही है।
जनसुनवाई का मंच जमीन से लगभग 12 फुट उपर था। पीछे दिवार थी। सामने 50 फुट के दायरे में बांस के तीन बैरिकेट लगाये गये थे। फिर पंडाल काफी बड़ा था। जिसमें कुर्सियंा रखी थी। यानि कुल मिलाकर मामला पूरी तरह प्रायोजित था। बैरिकेट के पीछे अंदर पर्यावरणीय जनसुनवाई का खेल चल रहा था। देवाल, थराली व नारायण बगड़ ब्लाक के प्रभावित गांवो के लोग साधनहीनता के बावजूद हजार से ज्यादा की संख्या पहंुचे। लोग पिंडर को अविरल बहने दो-हमें सुरक्षित रहने दो, बांध कंपनी वापिस जाओं, झूठी जनसुनवाई रद्द करो के नारे लग रहे थे। और पुलिस-बांध कंपनी के लोग-बैरिकेट उन्हे बात रखने से रोकते नजर आये। कुल मिलाकर मंच प्रभावितों की पहुंच में ही नही था। उत्तराखण्ड राज्य पर्यावरण संरक्षण एंवम् प्रदूषण नियंत्रण बोर्ड उसके मात्र एक तरफ छोटा सा रास्ता लोगो के जाने के लिये था। जिस पर पुलिस व बांध कंपनी यानि सतलुज जलविद्युत निगम के अधिकारी खडे़ थे।
बोर्ड के अधिकारियों की भूमिका बांध कंपनी के पक्ष में थी वे उन्ही के निर्देशों का पालन करते नजर आये। चुनिंदा लोगो को ही मंच तक जाने दिया गया। जो कि बांध कंपनी के साथ रिश्ता रखते है। 63 वर्षीय पूर्व अध्यापक श्री दिनेश मिश्रा जी जब एक पत्र लेकर मंच पर जाने लगे तो उन्हे धक्का देकर जबरन रोका गया। महिलाओं को भी रोका गया। किसी तरह से जब प्रभावितों की ओर से मदन मिश्रा जी किसी तरह बोलने के लिये पहुच पाये तो माईक की व्यवस्था खराब कर दी गई। उन्हे पूरा बोलने भी नही दिया गया।
अतिरिक्त जिलाधीश जोकि जनसुनवाई की अध्यक्षता कर रहे थे, उन्होने भी किसी कानूनी या व्यवहारिक उलंघन पर ध्यान नही दिया। या तो वे जानते ही नही थे कि पर्यावरणीय जनसुनवाई लोगो को अपनी बात रखने का एकमात्र रुप में मौंका है। या उन्होने जानबूझकर ऐसा होने दिया। मंच पर कुछ लोगो ने वही बोला जो कि पर्यावरण प्रभाव आकलन अधिसूचना 14 सितम्बर 2006 में दिये गये जनसुनवाई के लिये आवश्यक नियमों में कहा गया है।
कंपनी ने अपनी ओर से लोगो को लाने की कोई व्यवस्था नही की थी। लोग अपने साधनों से पहुंचे थे। तब भी वे अपनी बात नही कह पाये। ये ना केवल जनसुनवार्ह के रुप में लोगो के साथ धोखा किया गया था बल्कि ये पिंडर घाटी की जनता का अपमान था। भू-स्वामी संर्घष समिति व माटू जनसंगठन की ओर से बोर्ड को लगातार कानूनी व प्रक्रियागत खांमियों के बारे में सूचित किया गया किन्तु उनकी ओर से कोई भी कार्यवाही नही की गई।
पर हम लोग चुप नही बैठे। जनसुनवाई के बाद देवाल में बड़ी सभा हुई जिसमें इस कुकृत्य की भर्तस्ना की गई और लम्बी लड़ाई के लिये तैयारी की घोषणा की गई।
24 जनवरी को चमोली जिले के गोपेश्वर स्थित कार्यालय में प्रभावित गांवो के लगभग 250 लोगो ने जिलाधीश का घेराव करके इस तथाकथित जनसुनवाई को स्थगित करने की मांग की।
बांधो को लोगो पर लादने के खिलाफ स्ंार्घष जारी है।
