प्रैस नोट Supreme Court Notice to NHPC and MoEF on Kotli-Bhel two projects on 27.01.2012


माननीय सर्वोच्च न्यायालय ने नोटिस जारी किया
माननीय सर्वोच्च न्यायालय ने गंगा पर प्रस्तावित कोटली-भेल परियोजनाओं पर पर्यावरण एंव वन मंत्रालय और नेशनल थर्मल पावर कारपोरेशन को नोटिस जारी किया। विमलभाई, राजेन्द्रसिंह नेगी व त्रिलोक सिंह रावत माटू जनसंगठन और डा0 भरत झुनझुनवाला द्वारा पर्यावरण स्वीकृति को चुनौति देने वाली याचिका पर माननीय न्यायाधीश श्री डी0 के0 और श्री अनिल आर0 दवे ने 27 जनवरी 2012 को यह नोटिस जारी किया।

14 सितम्बर 2010 को राष्ट्रीय पर्यावरण अपीलीय प्राधिकरण ने कोटली-भेल ए 1 (195 मेवा) और कोटली भेल 2 (520 मेवा) की पर्यावरण स्वीकृति पर रोक की याचिका को यह कहते हुये खारिज कर दिया था कि गंगा के प्रवाह पर बांधो से कोई फर्क नही पड़ेगा। वादियों ने प्राधिकरण के इसी निर्णय को चुनौति माननीय सर्वोच्च न्यायालय दी है।

वादियों की ओर से वरिष्ठ अधिवक्ता श्री राजपंजवानी, सुश्री अनिता शिनाॅय, श्री रित्विक दत्ता एंव श्री राहुल चैधरी ने अदालत में पक्ष रखा। इन भीमकाय बांधों में जहंा विभिन्न महत्व के पर्यावरणीय व सामाजिक विषयों संबधी प्रश्न अनुत्तरित है वहीं उत्तराखंड के सांस्कृतिक समृ़द्ध क्षेत्र पर भी डूब का खतरा मंडरा रहा है।
भागीरथी पर प्रस्तावित कोटली-भेल 1 अ में 17 किलोमीटर जलाशय प्रस्तावित है जो कि भागीरथीगंगा का आखिरी स्वतंत्र हिस्सा शेष है। इसके ऊपर मनेरी भाली चरण एक, मनेरी भाली चरण दो, टिहरी बंाध, कोटेश्वर बांध कार्यरत है। यह पूरा क्षेत्र भूकंप प्रभावित है। 2010 के मानसून में कोटली-भेल 1 अ के प्रस्तावित बांध स्थल के निकट ही स्थापित एनएचपीसी का दफ्तर धाराशायी हो गया था।

प्रस्तावित कोटली भेल चरण 2 का 32 किलोमीटर जलाशय भागीरथीगंगा और अलकनंदागंगा के आघ्यात्मिक संगम देवप्रयाग जहंा से गंगाजी पहाड़ो में पूर्ण होती है उसको डूबायेगा। महत्वपूर्ण बद्रीनाथ धाम का प्राचीन ऐतिहासिक मार्ग व उससे जुड़े आध्यात्मिक स्थलों को भी डुबाने की तैयारी है।
राष्टीय नदी गंगा जी के प्रति अपना कत्र्वय निभाने के लिये हम हर स्तर पर संघर्ष करेंगे, जमीनी स्तर से लेकर माननीय अदालत में भी।

Supreme Court Notice to NHPC and MoEF on Kotli-Bhel two projects
The Supreme Court of India issued notice to Ministry of Environment and Forest and National Hydro Power Corporation on Two HEPs named Kotli-Bhel 1A (195MW) and Kotli-Bhel 2 (520MW).
Earlier on 14 Sept 2010 National Environment Appellate Authority dismissed appeal against the environment clearance of these two projects filed by Vimalbhai, Rajendra Singh Negi, Trilok Sing Rawat of Matu Jansangthan.
NEAA order has been challenged in Supreme Court by Vimalbhai, Rajendra Singh Negi , Trilok Sing Rawat of Matu Jansangthan and Dr. Bharat Jhunjhunwala.

ANIL R. DAVE heard the Appeal against the order of NEAA and

issued notice to Ministry of Environment and Forest and National Hydro Power Corporation.

Sr. Advocate Raj Panjwani with Anitah Shenoy, Ritwik Dutta and Rahul Choudhary
represented the petitioners before the court.

Despite of various environmental and social issues which remain standing unanswered, a very significant cultural area is also under the threat of submergence.
These dams are proposed on Bhagirathiganga and Ganga. Kotli-Bhel 1A (195MW) is proposed on Bhagirathiganga. The making of a 17 K.M. long reservoir would amputate Ganga from its last free stretch near the Holy confluence of Alaknandaganga and Bhagirathiganga, “Devpryag”. After Devpryag, it flows as Ganga. This proposed project is just after the two big reservoirs of Tehri dam and Koteshwer dam. The area is also very much landslide prone. It is important here to indicate that in 2010 monsoon, the office of project proponent NHPC itself collapsed, which was nearly half K.M. from the proposed dam site.
Proposed Kotli-Bhel 2 HEP (520MW) consists of a 32 K.M. long reservoir which will submerge the Holy Devpryag. The reservoir is supposed to stretch till the Bhagirathiganga and the Alaknandaganga. This is how a triangular reservoir will come up around the Devpryag. The old Badrinath Marg for pilgrims will also get submerged.
We will fight the battle both, on ground and at the Hon'ble Court to obey our duty towards our National River Ganga and its inhabitants.

Tehri Dam Case for Final Hearing in 17-4-2012

N. D. Jayal and Shekhar Singh Vs. Govt. of India and other cases, 
came for hearing on 6th January, 2012 but were not heard. 
The court fixed April 17, 2012 to be the next date for the final hearing. 
It is to be remembered that a land mark judgement was passed by the Hon'ble Supreme Court on 3 November 2011. In its order Hon'ble Supreme Court directed the Tehri Hydro Development Corporation to give Rs102.99 crore to the State Govt. of Uttarakhand for the Rehabilitation of the Tehri Dam oustees. However, THDC is still trying to raise the water level of the Tehri Dam Reservoir to its full capacity. On behalf of the petitioners, Adv. Sanjay Parikh (who is fighting this case from 20 years), argued that rehabilitation is not just about giving a compensation amount, it is also the responsibility of THDC and State Govt of Uttarakhand. But, sadly, inspite of various orders passed by the Hon'ble court, both have failed to fulfill the responsibility of proper rehabilitation. Till when will the oustees wait for the rehabilitation?

JUSTICE R.M. Lodha stated that rehabilitation is not an issue of debate.

In the year 2010, due to heavy rainfall in the catchment area, THDC mislead the Hon'ble court by feigning a terror of flood in neighbouring plains like Rishikesh and Haridwar and succeeded in getting the permission to fill the Tehri Dam Reservoir upto 830 M, which was incorrect. Due to filling of the reservoir, the surrounding villages suffered from land slides. These villagers too, did not get the rehabilitation.

Sr. Adv. Mr. Colin Gonsalves, also informed the court that the proposed bridges and the rehabilitation work for the oustees below 825M have yet not been completed.

Dr. Rajiv Dhawan,Sr. Adv. (A.C.) too intervened bringing to light the fact that we were providing information from the ground while THDC showed only paper work. Situation of oustees from Bhakra to Narmada dams is still the same and Tehri dam is in the queue. In the process of making dams , Medha Patkar and Sunderlal Bahuguna were also misbehaved with. However, the rehabilitation has yet not been done.

JUSTICE R.M. Lodha stated that the judgement would be given after
assessing the whole situation.  He asked  the state council of
Uttarakhand to file a detailed, true status of rehabilitation and resettlement.

It is brought to our notice by Mr. H.P. Raval, learned Additional Solicitor General for THDCIL that the State Government of Uttrakhand, vide its letter dated October 25, 2011, had communicated to grant permission to raise the water level of Tehri Dam Reservoir up to R.L. 825M subject to the condition that an amount of 102.99 crores is paid immediately. Mr. Raval submits that within two weeks from today, the said amount (102.99 crores) shall be paid to the State Government.

बांध! पर क्यों??? Why dams????

नदियों को अविरल बहने दो!! नदियों को नदियंा ही रहने दो!!
माटू जनसंगठन के द्वारा उत्तराखंड के बांधों पर अध्ययन के दौरान बांधों के जो असर सामने आये है उन्हे हम यहंा दे रहे है। समय-समय पर हम नये अनुभवों के साथ इसे अपडेट करते रहेगें।
पूर्व निर्मित जलाशय व सुरंग जलविद्युत परियोजनाओं के खतरों पर कोई ध्यान नही, उनका कोई निस्तारण नही फिर नयी परियोजनायें क्यों?
उत्तराखंड में सैकड़ों बांध बनाये जा रहे है। किसको फायदा मिला?
आखिर कितने बांध? किसके लिये?
देश व राज्य की सरकारें ये सच्चाई बतायें, इस पर श्वेत पत्र जारी करे।
उसके बाद ही नयी परियोजनाओं की बात करें।



भारत के ‘‘केन्द्रीय जल आयोग’’, अन्तर्राष्ट्रीय स्तर पर बांधों के बारे में अधिकारिक संस्था ‘‘बडे बांधों के अन्तर्राष्ट्रीय आयोग’’ व दो वर्षो तक विश्व भर के बंाधो का विस्तृत गहन अध्ययन करने वाले ‘‘विश्व बांध आयोग’’ इन तीनो की मान्य परिभाषाओं के अनुसार अपने निम्नतम नींव से 15 मीटर से ऊंचे बांध, बड़े बांधों की श्रेणी में आते हैं। अथवा 5 से 15 मीटर की ऊँचाई वाले बाँध जिनकी जल भण्डारण क्षमता 30 लाख घनमीटर से अधिक हो और 10,000 हजार हेक्टर तक सिंचाई क्षमता वाले हों तो भी वो बड़े बांध माने जायेंगे। राज्य की लगभग सभी नदियों पर बनने वाले बंाध 15 मीटर की ऊँचाई वाले है।

दीर्घकालीन लागतें-हानियंा: महत्वपूर्ण बिन्दु...........

जंगल व जमीनः-

 उत्तराखंड के पहाड़ी क्षेत्रों मंे मात्र 7 प्रतिशत भूमि खेती योग्य शेष है। नदी किनारे कि भूमि प्रायः सबसे अच्छी और उपजाऊ होती है। बांधों में ये ही जमीने या तो डूब रही है या अन्य बांध कार्यो-बांध की कालोनी आदि में जा रही हैं।
 उत्तराखंड के वनो के नष्ट होने का एक बड़ा कारण ये परियोजनाये भी है। जीव-जंतुओं पर भी बुरा असर हो रहा है।
ये उत्तराखंड का स्थायी विनाश है। साथ ही इससे लोगों के वन संबंधी हक हकूक भी समाप्त हो रहे है।
 सुरंग परियोजनाओं में जितनी जमीन डूबती है परियोजना काॅलोनी में उससे ज्यादा जमीन जाती है। परियोजना वाले बाद में बची जमीन वापिस नहीं करते जैसे मजदूर काॅलोनी आदि की जमीन।
 जल विद्युत परियोजनाओं के कारण बन रही सुरंगे पहाड़ों को हजारों किलोमीटर लम्बाई में खोखला कर रही है। जिन से हो रहे नुकसानों को पूरी तरह नजरअंदाज किया जा रहा है। जो कि आने वाले समय के लिये खतरनाक है।
 खेती कम होने से भविष्य में खाद्य सुरक्षा बड़ा प्रश्न खड़ा होने वाला है।

नदीः-

 पूरे राज्य में नदी किनारे असुरक्षित हो रहे हैं। बांध से विद्युत उत्पादन के लिए कभी भी नदी का पानी छोड़ा जाता है।
जिससे नदी में पानी का प्रवाह भी अनिश्चित हुआ हैै।
 सुरंग परियोजनाओं में जहां से नदी को सुरंग में डालते हैं फिर बिजलीघर तक, जहंा से पानी बाहर निकलता है, वहंा तक नदी तल सूखा रहता है या बहुत ही कम पानी रहता है।
 देवभूमि उत्तराखंड में नदी किनारे के सभी प्रयाग या तो डूब रहे है या सूख रहे हैै। उत्तराखंडी देव भूमि के निवासी
कहलाते थे अब बांध भूमि से विस्थापित कहे जा रहे है।
 स्थानीय लोगो का नदी पर अधिकार नही बच रहा है। धार्मिक व सांस्कृतिक कार्यों जैसे स्नानपर्व, दाह-संस्कार, नदी-पूजन आदि के लिए नदी में पानी नहीं रहता। सूखी नदी के कारण, नदी के किनारे रहने वालों को खासकर पशुपालकों को पानी नहीं मिल रहा है।
 पूरी नदी घाटियों में सुरगें बनने से पहाड़ कमजोर हो रहे हैं। जिससे भूस्खलन बढ़े हैं।
 उत्तराखंड में नदियों पर जितनी परियोजनायें बन रही है। उनके बाद नदियंा कहीं भी नदी स्वतंत्र नही बचने वाली है।


सुरंगों से खतरेः-
 सुरंग परियोजनाओं में सुरंग निर्माण हेतु किये जाने वाले विस्फोटों के कारण जल स्रोत अपना स्थान बदलते हैं। वे प्रायः सूख जाते हैं। इसका कोई भी हल नही होता।
 सुरंग के ऊपर के मकानों में दरारें पड़ती हैं। जिसके कारण मकान कमजोर हो जाते हैं और हल्के भूकंप से भी गिर जाते हैं। भूमि में भी दरारें पड़ जाती है। इन सबका कोई मुआवजा नही मिलता है।

अध्ययन व निगरानीः-
 किसी भी जलविद्युत परियोजनाओं में केन्द्र व राज्य स्तरीय निगरानी तक नही हो रही है।
 परियोजनाओं के निमार्ण से पूर्व अध्ययन सही व पूरे ढंग से न होने के कारण बाद में समस्यायें और बढ़ती हैं।
 नदी पर एक के बाद एक बन रहे बांधों के आपसी प्रभाव नकारात्मक हो रहे हैैं। जिनका कोई अध्ययन भी नही हो रहा है।
अन्यः-
 बांध परियोजना कार्यों से उठी धूल के कारण पशुओं के चारे खराब होते हैं। विस्फोटकों की धूल व मिट्टी से क्षेत्र का चारा व खेती खराब हो जाती है। वन क्षेत्रों पर भी दूर तक नकारात्मक प्रभाव पड़ते हैं।
 इन परियोजनाओं के बनने से बहती नदी का पानी झील में बदल जाता है। जिससे जल में आक्सीजन की मात्रा घट जाती है। टिहरी झील का पानी पीने के लिए अयोग्य बताया गया है।
 इन परियोजनाओं के कारण उत्तराखंड मे जीव जन्तुओं पर भी बुरा असर पड़ा है। टिहरी झील के कारण बंदरो, सुअर, भालू व बाघ आदि का प्रकोप आबादी वाले इलाको में बढ़ा है।
 इन परियोजनाओं की झील से धंुंध, बिमारियां व झील के ऊपर की भूमि पर बुरे प्रभाव पड़ते हैं।
 जलाशयों मेें रेत का भरना आम बात है। चूंकि बांध एक ही नदी पर एक के बाद एक बांध बन रहे है। एक बांध से रेत खाली करने पर दूसरे बांध में रेत जमा होती है। जलाशय तो रेत से भरते जा रहे है।
 जलाशयों में रेत जमा होने के कारण निकट के क्षेत्रों में गर्मी बढ़ती है।
 जलाशयों का पानी बांध कंपनी की आवश्यकता अनुसार घटता बढ़ता है। जिससे नदी पर लोगो का अधिकार खत्म हुआ है।
 जलाशयों से अचानक पानी छोड़ने के कारण निचले क्षेत्रों में अनेक जाने जा चुकी है।
 जलाशयों में पानी घटने-बढ़ने से किनारों पर भूस्खलन, धसाव बढ़ते है रिम क्षेत्र हमेशा खतरे की जद में रहता है।
 पूरे राज्य में पहाड़ों पर पारेषण लाइनों के खतरे बढ़ रहे हैं।
 चूंकि उत्तराखंड राज्य हिमालय के मध्य में है। यहंा का वातावरण अपेक्षाकृत ठंडा ही रहता है। इन बांधों के कारण जो वन क्षेत्र कम हो रहा है उससे गर्मी बड़ी है जिसने वैश्विक गर्मी को भी बढ़ावा दिया है।
 बांधों की वजह से यहां जो गर्मी बढ़ी है। उसका स्थानीय फसलों व फलों पर ज्यादा बुरा असर पड़ रहा है।
 निर्माण में लगे हजारों लोग एक ही स्थान पर रहते हैं। जिससे प्रतिदिन की गंदगी व विभिन्न बीमारियां बढ़ती हैं। जो कि ज्यादातर बाहर से आये होते है। उनका स्थानीय समाज, वन, पर्यावरण पर भी बुरा असर पड़ता है।
 संस्कृति और महिलाओं की स्वतंत्रता पर सबसे बुरा असर पड़ता है। जिसका कोई मुआवजा नही हो सकता है।
 ग्रीन हाऊस गैसों में, संसार मंे जलाशयों से पैदा होने वाले कुल उत्पादन में भारत के जलाशयों से 17 प्रतिशत की
बढ़ोत्तरी होती है। इन जलाशयों में बांधों के जलाशय भी है।
 उत्तराखंड 4-5 स्तर के भूकंप संवेदनशील क्षेत्र में आता है। जो अत्याधिक खतरे वाला क्षेत्र माना गया है। राज्य में भूकंपों से हजारों लोग मारे जा चुके हैं। इतने सारे बांधों के निर्माण से भूकंप का खतरा और बढ़ेगा। यह वैज्ञानिक तथ्य है कि बांधो से भूकंप आते है। बांधों से भूंकपों की तीव्रता बढ़ती है।
 राज्य सरकार की नीति है पर किसी भी परियोजना में स्थानीय लोगो को 70 प्रतिशत रोजगार नही मिला है? जबकि
प्रचारित यही किया जाता है कि बांधो से स्थानीय लोगो को रोजगार मिलेगा। थोड़े अस्थायी रोजगार जरुर दिखते है जो
कि बांध बनने के बाद समाप्त हो जाते है।
 जहंा निजी कंपनियंा बांध बना रही है वहंा प्रशासन बांध वालों के साथ खड़ा दिखता है।
 बांधों से बाढ़ रोकने का दावा झूठा होता है। 2010 के मानसून में टिहरी बांध का उदाहरण सामने है। जिसके कारण बाढ़ का रुप ज्यादा भयानक हुआ। ये देश भर में हो रहा है।
 बांधो की पर्यावरणीय जन सुनवाईया पूरी तरह धोखा साबित हुई है। लोगो को ना कोई जानकारी दी जाती ना ही
उनके विरोध को मान्य किया जाता है।
 पूर्ववर्ती बांधो से कोई सबक नही लिया जा रहा है।

Dangers of Hydroelectric Projects 
 
Bhagirathi Ganga, Vishnupadi Ganga Alakananda and Ganga are being converted into reservoirs and pushed into tunnels due to Big Hydroelectric projects. From some kilowatts to thousands megawatts, Hydroelectric projects are taking over the Ganga Valley. It is our hope that our governments, country's development heads and the educated masses have been able to understand the effects of Hydroelectric projects and hence, would rectify errors in the under progress projects and will stop thinking about any new projects. But this would warrant an honest political willpower and selfless thinking.

Long term effects: important points............

Impact on Land
  • More land is taken over by Project colonies than is lost in the Tunnel projects. The project proponents do not give back the left over land like the land of labour colony etc to the people.
  • According to an estimate, under-construction Hydro-electric projects are hollowing 1500 km length of our mountains, the effects og which are being ignored. This could lead to problems in the future.
  • In Uttarakhand mountainous region only 7% cultivable land is left. The land near the river bank is often the most fertile. This land is either submerged by the reservoir or destroyed in project related work like living quarters for dam officials.
  • Because of diminishing agriculture, fertilizer production is going to be a big question.

Impact on Forests
  • A big cause of diminishing forest cover in Uttarakhand is the construction of dams. This is the permanent annihilation of Uttarakhand.
  • Fauna have been adversely affected because of these projects in Uttarakhand. Because of Tehri Dam reservoir and the destruction of the natural habitat of several creatures, the terror of monkeys, pigs, bears and tigers has increased in populated areas.
  • Due to the dust rising from dam construction site, fodder for animals is destroyed.

Impact on Rivers
  • In the whole state river banks have become more precarious. Whenever the river water is released for electricity production, the water current of the river becomes uncertain.
  • In Run-off-the river projects, all the way from where the river is pushed into the tunnel till it resurfaces at the Power House, the river basin is either dry or has very little water in it.
  • All prayags (confluences) on the river banks of Devbhoomi (land of Gods) Uttarakhand are either submerging or withering. The people of Uttarakhand were once called residents of Devbhoomi, now they are labelled as oustees.
  • The mountains are weakening due to digging of tunnels in the whole river valley. Increase landslides in the region are a direct consequence of this.
  • With the large number of projects being constructed in the Ganga valley, the Bhagirathi Ganga, the VishnupadiGanga Alaknanda and all their tributaries, there is no river left free to flow.

Cultural Impact
  • Thousands of people are engaged in construction work, live in the same place because of which everyday dirt has increased and spread of diseases has escalated.
  • Since most of the workers are immigrants, it affects the people, local culture, environment, etc for which there can be no compensation. The Local culture and women’s freedom is worst affected.
  • The rights of the locals on rivers are not protected. There is no river water available for religious and cultural rituals like bathing festival, funeral rites, river worship etc. Due to dry rivers, the people who live on the river banks, especially cattle herders, do not get enough water.

Danger of Tunnels
  • Because of explosions caused by digging of tunnels in Run-off-the river projects, the water sources changes its course. The river often dries up. In most cases no solution is provided by the project proponent.
  • Cracks appear in the houses which the tunnels underpasses. Houses become weak and collapse in very light earthquakes.
  • Cracks appear in the land too. No compensation is paid for this.

Study and Monitoring
  • Required monitoring of hydroelectric project is not being done by either the central govt. or by the state govt.
  • Problems have multiplied due to incomplete or faulty pre-construction study of project.
  • The effects of building one dam after another on the same river has created several negative impacts. Still no cumulative impact assessment study has ever been done.

Failure of Government
  • In spite of the state governments policy, 70% employment not been given to the locals in any of the projects. While this is exactly what has been reported and promoted by the government. There are a few jobs (Like shop ownership, guest houses) which can be seen, but shall shut down with the completion of the dam.
  • When private companies make dams, the Right to Information Act does not apply and collecting information is still tougher.
  • The Environment Public Hearings are a complete sham. Neither are the people given any information nor is their opposition taken into account.

Impact of Reservoirs
  • With the coming of these projects, the flowing water of the river changes into stagnant reservoir water that reduces the oxygen quantity in the water. Tehri reservoir water is said to be unfit for drinking.
  • Silt getting collected in the reservoir is a common problem with dam projects. Because a large number of dams are being constructed in the same river, the silt cleaned from one reservoir is washed ahead and gets collected in the next reservoir.
  • The excess amounts of silt collected in the reservoirs leads to increase in temperature of the local areas.
  • Dam reservoirs cause global warming- Of the total green house gases produced in the world, a 17% increase has been caused by the reservoirs in India which includes dam reservoirs. Projects like Kotli-Bhel, Pancheshwar all have reservoirs in tens of kilometres.

Downstream impact
  • In whole of the state, fear of transmission lines is on the rise.
  • The reservoir water level varies according to the THDC’s need.
  • The sudden release of water from the reservoir has led to deaths downstream.
  • This sudden release has also led to landslides near the water, making the rim area very dangerous.
  • There is no truth to the claim that ‘dams stop floods’. The example of how Tehri dam made the floods in Uttarakhand due to the 2010 monsoon much worse is a case in point. This is happening around the country.

Others
  • Because Uttarakhand is in the middle of the Himalayas, its environment remains comparatively cooler. Temperature has increased due to the dams and the local plants are suffering.
