April 10, 2016 | New Delhi: ‘Tehri 2015 – The Ten Years of Injustice’ documentary movie made by Vimal bhai, has been released by Justice Rajinder Sachhar yesterday at Constitution Club of India. The movie is a testimony to the human and ecological crisis that emerged in the Himalayan region after the construction of dams such as Tehri which have ruined the lives and livelihoods of local communities and caused irreparable damage to the ecology, environment and cultural values which were there for centuries. It also speaks of a long history of illegal and forced land acquisitions, violations of environmental safety norms and unfair rehabilitation of displaced families that are still seeking justice even after 10 years of its commissioning.

Shambhunath Shukla, senior journalist and former editor with Amar Ujala Hindi Daily released the book ‘Why Dams?’ written by Vimal bhai and published by National Alliance of People’s Movements (NAPM). It documents years of work done in dam affected regions of Uttarakhand and discusses the environmental degradation, displacement and loss of livelihoods of the people in Uttarakhand owing to building of large dams. Complementary to the documentary released, this book reflects on the worsening state of ecology, environment and people in Uttarakhand.

“Who really benefits from the dams?” asked Shambhunath Shukla while claiming that rehabilitation of Tehri dam inhabitants have been done in a very thoughtless manner. The people have been relocated to an area which only worsened their lives and brought environmental devastation.

“Till now the problems arising in the Uttarakhand and Ganga Valley due of a large number of small and big dams has been overlooked for the unjust greed of electricity, we have to save ecology and people’s rights over on natural resources of Himalaya” said Vimal bhai, while criticizing the Namami Ganga initiative which talks only about the pollution and cleaning the River Ganga but always run away from taking up the issues of dams on Ganga. We will not leave the fight till rivers and its people get their rights.

Adv. Sanjay Parikh, fighting cases for people on Tehri Dam since 1992, was felicitated by people’s movements. He has been continuing his endless struggle and extending support, which has benefited people of Uttarakhand and also provided strength to other people’s movements nationwide.

Justice Rajinder Sachhar ji along with Ms. Medha Patkar, Puran Singh Rana, senior activist of Matu Jansangthan and others honored him with the preamble of constitution and a shawl. Justice Rajinder Sachhar ji appreciated the Sanjay Parikh’s work and fight for human rights case since 1986 and evaluated his contribution worthy for a people’s award equivalent to a Bharat Ratna.

Sanjay Parikh, with his long 24 years’ experience in case of Tehri, shared that the judiciary has failed to understand the real problems caused by these large dams in which the govt. and also the judiciary focused on rehabilitation issues cornering the environmental concerns. Tehri dam was environmentally not feasible and thus were in planning stage only for many years after which the Govt. went straight to just build it. Also rehabilitation has not been done which refutes the claim of benefits to people from Tehri Dam. The lack of social assessment and other devastation of cultural values because of displacement were missing in the prior assessment. The association of human and environment has been largely ignored.

He shared with the people that the villages were looking horrifying, scary; the people were frightened by displacement. The project alienated the culture and society along with their association with the forests. “It was hard to witness the devastation and face the people as an advocate; we are human beings and cannot overlook the plight of people and upcoming devastation” said Mr. Parikh. He ended his conversation with the poem ‘Man Chaahta hai’, written by Vimal bhai.

In the panel discussion on “Tehri dam and Dams of Ganga Valley”, Medha Patkar, with her long journey fighting for the justice of people displaced and against the large dams, termed it an emotional journey. “Tehri Dam is a part of series of planned violence on people’s lives, livelihoods and environment” said Medha Patkar. These atrocities are not considered anti-national whereas the people raising voices for the justice are termed anti national. Govt. is playing a very dangerous role in diverting the people’s attention and defaming the real struggles to facilitate the natural resources in the hands of industries and rich people. The development model has become the slave of industries and corporate, moving out the people from their own villages and exploiting the natural resources available for all. Govt., executives and others are rarely questioned inside the courts. There is also unwillingness to even listen to those people who are fighting for people’s issues. Thus it is clear that “We should never aspire for the legal justice but for human Justice”.

“Three things impacting judgements are principles, pragmatism and prejudice”, said Usha Ramanathan, Legal Researcher and fellow at Centre for the Study of Developing Societies observing the travesty of justice in Tehri Dam case. There is a distinction between impartiality and neutrality. The powerful will also try to term the masses into subjects for their ulterior motives.

Mr. Soumya Dutta, a noted environmentalist accused the inequality in planning and delivering the benefits as a major issues causing people to suffer their lives, livelihoods and environment. Ganga – Brahmputra river system brings a lot of silt resulting in a very fertile soil deposition which has supported the agrarian system catering to food security majority of population of India, but ignoring these facts, the rivers are getting dammed which is resulting in declining reservoir capacity too apart from its larger socio-environmental impacts.

The struggle for Dam free rivers and people’s rights will continue with greater support and strength.

उत्तराखंड में गंगा के मायके अलकनंदा घाटी से विष्णुगाड पीपलकोटी बाँध प्रभावितों ने अंतर्राष्ट्रीय जगत को ये संदेश दिया है कि नदियों के जीवन से हमारा जीवन है । टीo एचo डीo सीo और विश्व बैंक का गठजोड़ पूरी तरह से गंगा घाटी के लोगों की आकांक्षाओं को पूरा करने में असफल रहा है, अब अन्य देशों में जैसे भूटान में भी टीo एचo डीo सीo जाने की कोशिश कर रही है । विश्व बैंक स्वच्छ उर्जा के नाम पर अन्य देशों में भी बड़े बांधों के लिए पैसा उधार दे रहा है उन सब को अपील करते हैं कि वे भी इनका पुरजोर विरोध करें ।

लगभग 20 से ज्यादा बांध प्रभावित गाँवों के लोगों ने एकमत में उत्तराखंड की संस्कृति की रक्षा के लिए बड़े बांधों का विरोध किया, सभी वक्ताओं ने कहा - “सलूढ़ गाँव, भरत सिंह - अब आवाज नहीं दब सकती, जल जंगल जमीन की कीमत पर उर्जा प्रदेश नहीं चाहिए । जखोला गाँव, मनवर सिंह व मातवर सिंह - बांधों से जलवायु परिवर्तन हो रहा है । लांजी गाँव, दिनेश राणा - गंगा में बांधों से प्रदूषण हो रहा है । पोखनी गाँव, जगदीश भंडारी - सरकार व टीo एचo डीo सीo ने हमे धोखा दिया है । पोखनी गाँव, बाल सिंह - भविष्य की बर्बादी हमसे छुपायी गई है । ह्युना गाँव, राकेश भंडारी - जब नदी ही नहीं होगी तो गंगा संस्कृति कहाँ होगी । दुर्गापुर गाँव, रामलाल - हम पर 23 मुक़दमे है मगर हम लड़ेंगे । द्विंग गाँव, उमा देवी - हम बाँध विरोधी हैं और रहेंगे, गंगा अविरल रहेगी । नरेन्द्र सिंह (मo) - बांधों से भूस्खलन बढ़े हैं । पीपलकोटी, वृहन्श्राज तडयाल - पहाड़ की जवानी व पानी बांधों से लुप्त हो रही है । पोखरी गाँव, धनेश्वरी देवी - हम पर्यावरण की शर्त पर कोई समझौता नहीं करेंगे । राजेंद्र हतवाल (हात) - हात का पुनर्वास धोखा रहा है हमने गाँव नहीं छोड़ा है, कम्पनी, राजनेता और शासन से भी धोखा ही मिला है, पुरातत्व विभाग ने ना ही बेलपत्री के जंगल और ना ही लक्ष्मी नारायण मंदिर का सर्वे किया । माटू जन संगठन के समन्वयक विमल भाई - संगठन से ही समस्या का निदान होगा, बड़े बांधों ने आजतक विस्थापन व पर्यावरणीय क्षति ही दी है, जिससे देश में व गंगा घाटी में साड़े पांच हज़ार बांधों के बाद भी दोहराया जा रहा है । आज इस टीo एचo डीo सीo व विश्व बैंक के गठजोड़ से बन रहे बाँध से लगभग 80 लोगों पर मुक़दमे हैं, तानाशाही और आतंक के साये में इस बाँध को आगे बढाया जा रहा है, किंतु हम न्याय के लिए, जन हकूकों व गंगा के लिए जमीन से लेकर कानूनी लड़ाई के लिए तैयार हैं । हमारा गांधी के मूल्यों व आदर्शों में विश्वास है, हम अहिंसक संघर्ष जारी रखेंगे ।“

सुबह कार्यक्रम का आरम्भ ढोल नगाड़ा व तुरही के साथ गाँव वालों ने गाँव से लायी मिटटी को गंगा कलश में इकठ्ठा किया, जिसे कार्यक्रम के बाद संघर्ष व रचना के प्रतीक रूप में रोपे गए पीपल के पेड़ के लिए डाला गया । कार्यक्रम का संचालन नरेन्द्र पोखरियाल द्वारा किया गया, जो कि दस वर्ष से अधिक समय से इस बाँध के खिलाफ संघर्षरत हैं ।

“गंगा चलेगी अपनी चाल, ऊँचा रहेगा उसका भाल“, “देख रहा है आज हिमालय गंगा के रखवालों को“, इन नारों के साथ भविष्य की संघर्ष की घोषणा के साथ मोर्चा निकला गया ।

No Dams, Development Required
Launch of the ‘River Day’

            From Alaknanda valley, Uttarakhand, Vishnugaad Peepalkoti Dam affected people have sent the message of “River’s health is vital for people’s survival” to communities across the world today. THDC and World Bank alliance has failed miserably in fulfilling the hope of people in Ganga Valley, and now they are also trying to go to other countries like Bhutan. We strongly oppose this in India and appeal to the people of other countries to do the same against the funding by World Bank to Big Dam projects in the name of clean energy.

            People from more than 20 affected villages have united and opposed the big dams to save the culture and ecology of Uttarakhand. Bharat Singh (Salood Village) – Voices cannot be subverted; we don’t need energy at the cost of water, forest, River and land. Manvar Singh and Maatwar Singh (Jakhola Village) – Dams are causing climate change. Dinesh Raana (Laanzi village) – Pollution is on rise due to dams on the River Ganga. Jagdeesh Bhandari (Pokhni Village) – Government and THDC has cheated us. Baal Singh (Pokhni Village) – Disaster will happen in future and they kept us unaware from the fact. Rakesh Bhandari (Huen Village) – How will the Ganga culture survive when the river itself is in danger. Ram lal (Durgapur Village) – There are 23 false cases filed against us but struggle will continue. Uma Devi (Dving Village) – We are and will remain anti dams, Ganga will flow incessant. Narendra Singh – Landslides has increased. Vrihansraj Tadiyal (Peepalkoti) – Biodiversity and water is getting diminished from hills because of dams. Dhaneshwari Devi (Pokhari Village) – We will not compromise with our environment at any cost. Rajendra Hatwal (Haat) – Rehabilitation in Haat village was false, we have not left the village. We have been cheated by company and government both. The archeological department has not surveyed the forest of Belpatri and Lakshmi Narayan temple. Vimal bhai, Convener of Matu Jan Sangathan – People’s unity and organization can solve the issues; Big Dams have given only displacement and ecological destruction which is being repeated even after more than five thousand dams in the country. There are more than 80 cases filed in court against people due to the destructive alliance between THDC and World Bank. The work on this dam is going ahead with the help of terror and dictatorship. But we have fought till now and will keep fighting for justice, people’s rights and legal struggles from the land to the water. We believe in the Gandhian principle and will continue the non violent struggles.

            The programme was commenced with the beating of drums and local instruments. People brought the soil form their villages and collected near the Peepal tree to remember this as a sign of protest and struggles. Narendra Pokhariyal has moderated the event, who is struggling for more than a decade against the Dams.

            “Ganga Chalegi Apni Chaal, Uncha Rahega Uska Bhaal (Ganga will continue to flow with its dignity intact)”, “Dekh Raha Hai Aaj Himalaya Ganga ke Rakhwaalon Ko (Himalaya is looking towards saviours of Ganga)”, the programme has ended with these slogans announcing the course of future struggles.

प्रभावितो ने विश्व बैंक के अधिकारियांे को घेरा

परियोजना का नामः विष्णुगाड-पीपलकोटी जलविद्युत परियोजना {444}; नदीः अलकनंदा गंगा; बांध कंपनीः टिहरी जलविकास निगम;

विष्णुगाड-पीपलकोटी जलविद्युत परियोजना से प्रभावितो ने विश्व बैंक के अधिकारियांे को घेरा। विश्व बैंक इस परियोजना में पैसा लगा रहा है। लोगो को बहुत शिकायतंे थी कि परियोजना में पुनर्वास का कार्य नहीं हो पाया। बांध से पर्यावरण कि क्षति होगी। सुरंग बनाने से लोगो का नुकसान होगा वगैरा-वगैरा। मगर विश्व बैंक ने बहुत चालाकी पूर्ण तरीके से यह दिखाने कि कोशिश कि सब समस्यायों का निदान हो गया और अब परियोजना व्यवस्थित रूप से चलानी चाहिये।

विष्णुगाड-पीपलकोटी जलविद्युत परियोजना को राज्य सरकार ने भी दूसरी वनस्वीकृति सुप्रीम कोर्ट के 13 अगस्त 2013 के आदेश की अवहेलना करते हुए दी। विश्व बैंक कि टीम को विभिन्न गाँव के विस्थापितों ने 2 मार्च को फिर घेरा। प्रायः जब भी विश्व बैंक के अधिकारी वहाँ गए है गाँव विस्थापितों ने उन्हें घेरा है। विश्व बैंक टीम ने प्रश्न पूछने पर हमेशा टालने वाले जवाब ही दिए है। किसी भी समस्या का निदान नही किया।
2 मार्च को भी यही हुआ ग्राम पल्ला, जाखोला, ह्यून, पोखनी, तिरोसी, लांजी, हरसारी, उरगम, मठ, जड़ेथा, बजनी, गनगोत और दुर्गापुर आदि गांवों के लोगों ने विश्व बैंक टीम को घेरा। इन गाँवों के नीचे से सुरंग बनने वाली है जिससे ये प्रभावित होंगे।

पोखनी गांव के मुरलीधर भंडारी ने कहा कि गंगा सुरंग में चली जायेगी तो हम दाह संस्कार कंहा करेंगे? सरपंच मातबर सिंह ने कहा की हमने अक्तूबर 2015 में बंाध कंपनी को पत्र भेजा था पर आज तक जवाब नही आया है। लांजी गांव के सरपंच कंवर सिंह भंडारी ने कहा सुरंग बनने से हमारे जल-जंगल-जमीन बुरी तरह से प्रभावित होंगे।अन्यो ने भी इसी तरह के सवाल पुूछे। मगर यह सब सुनने के बाद में विश्व बैंक के अधिकारियों ने यही जवाब दिया कि अगली बार हम आयंगे आपके गाँव में। ऐसा कह कर वह निकल गए। बैठक टीएचडीसी के गेस्ट हाऊस ‘सियासेन‘ .में हुई। यह सियासेन सबसे ज्यादा सुरक्षित है। यह स्थान सुरंग से बहुत दूर है। बाँध परियोजना कंपनी टीएचडीसी ने अपना कोई भी दफ्तर सुरंग के ऊपर के गांवों में नहीं बनाया और वो बार बार दावा कर रही है। कि सुरंग के ऊपर में कोई भी नुक्सान नहीं होने वाला। मगर अपने दफ्तर जरुर सुरक्षित कर लिये।

दुर्गापुर गाँव के लोग जब बैठक में पहुंचे अधिकारियो के पास में तो उन्होंने यही बहाना बनाया कि अब समय नही है हमें कही जाना है। जबकि दुर्गापुर के 21 लोगो पर टीएचडीसी की एक ठेकेदार कंपनी के द्वारा अभी मुकद्मा दायर हुआ है। क्यूंकि दुर्गापुर गाँव में विद्युतघर के उपर है जंहा से नदी बाहर निकलेगी। पूरा गाँव ही धसान को झेलने वाला है। लोगो ने लगातार काम रोका। महीनांे-महीनांे तक धरना चला, आन्दोलन चला और उसके बाद में चमोली के जिलाधीश ने यह कहकर धरना समाप्त कराया कि गांव पर विस्फोटों के असर के बारे में जांच होगी। सरकारी संस्थान ने अभी आधी ही जांच की है। पहले हो चुके नुकसान के लिये लोगो को मुआवज़ा दिया जाना था। वे नही दिये गये। बड़ा प्रश्न है कि टीएचडीसी कहती है कि लोगो ने 2013 की आपदा के बाद कंपनी की जगह पर घर बनाये है। जबकि 2013 कि आपदा के बाद सरकार ने लोगो को यह जमीन दी थी। इसकी जांच भी करने के लिए अधिकारी आये मगर अभी उसकी कोई रिपोर्ट हमारे सामने नहीं है। और अब उसी आंदोलन के कारण लोगो पर काम रोकने के झूठे आरोप लगाकर मुकदमा दायर कर दिया गया है।

सुरंग के शुरुआती तरफ जो गाँव है तथा विद्युतघर के उपर के गांव हरसारी, दुर्गापुर, हैलंग, जैसाल आदि के लोगो पर भी मुकदमें दायर कर दिये गये है। इस तरह जब भी लोगांे ने प्रदर्शन किया तो लोगों पर मुक़दमे ठोके गए। लोगो को एक तरफ फंसाया गया दूसरी तरफ बाँध का काम चालू किया गया। विश्व बैंक कि नीति इस तरफ नज़र आती है कि वो किसी भी तरह से अपनी ही पुनर्वास व पर्यावरण की नीतियों के खिलाफ, बाँध के काम को सही ठहराती है और पर्यावरण और पुनर्वास के गंभीर मुद्दों को नज़रंदाज़ करती है।

विश्व बैंक की ही नीतियों के उल्लंघन पर प्रभावितों द्वारा जो शिकायत विश्व बैंक के तथाकथित स्वतंत्र जांच दल के समाने डाली थी उसकी प्रक्रिया साल भर से ज्यादा चली किंतु उसकी रिपोर्ट भी सही मुद्दों को लाने में पूरी तरह असफल रही। मात्र लीपापोती ही की गई। बल्कि उसके बाद बांध कपंनी और विश्व बैंक दोनों ही निरंकुश होकर काम कर रहे है। लोगो कि शिकायतों पर ध्यान न देकर बांध का काम आगे बढ़ाना और प्रभावितों द्वारा यदि काम रोका जाता है तो टीएचडीसी व उसकी ठेकेदार कंपनियंा लोगो पर मुक़दमे डालती है। आज बंाध प्रभावित क्षेत्र के लगभग 74 लोग अपराधिक मुक़दमे झेल रहे है। पूरे प्रभावित क्षेत्र के लिये यह एक धमकी भी है।

विश्व बैंक की टीम में सुश्री सोना ठाकुर, श्री पीयूष व एक अन्य बैंक अधिकारी मौजूद थे। मगर लोगो ने जो चित्र रखा उसका उनके पास कोई जवाब नहीं था। विश्व बैंक की टीम कभी भी क्षेत्र में सूचना देकर नही आती। गंगा स्वतंत्र रहेगी तो ही हिमालय व उसके निवासी सही रहंेगें। हम इस लड़ाई को आगे तक लेकर जायेंगे।

Villagers summons the officials of World Bank
 Name of the Project: Vishnugaad – Peepalkoti hydroelectric project {444}: River: Alaknanda Ganga; Dam Company : Tehri Hydro Development Corporation;

The Villagers and Project Affected People of Vishnugaad – Peepalkoti hydroelectric project summons the officials of World Bank. World Bank is funding this project where people have continuously complained about the incomplete rehabilitation work in this project. The ecology and environment is getting largely affected due to the tunneling and overall development of this project. But World Bank has been cleverly showing that the problems have been resolved and this project should operation in a systematic manner.

The second environmental clearance has been given to the project violating the Hon’ble Supreme Court’s order dated August 13, 2013. The affected people of various villages have surrounded the officials of World Bank again today. This happened whenever the officials visited the villagers. They remained silent mostly and diverted the question when asked about the questions regarding resolution of problems related to rehabilitation, ecological devastation and environmental concerns.
On 2nd March also, the same thing happened with strong opposition from the villagers against the flawed developmental project and the promises from the Govt. and the World Bank. The dissent has spread all across the villages namely Palla, Jaakhola, Huon, Pokhni, Tirosi, Laanjhi, Harsari, Urgam, Matth, Jaretha, Bajni, Gangot, and Durgapur village. Villagers are going to be affected due to the tunneling work of this hydroelectric project. The tunneling has been questioned by various environmentalists on the ground of making hills vulnerable to landslides and ecological devastation.

At the same time, from the cultural aspect, Murlidhar Bhandari of Pokhni village has put a question that if the Ganga River will go into the tunnel, where will they do the funeral? Sarpanch Maatbar Singh has asked about the replies which he have not received till now against the letter, he sent in October, 2015 to the Company associated with the development of this Dam. Sarpanch Kanvar Singh Bhandari of Laanji Village said that the tunneling will affect dangerously the water, forest, and the land of the affected area.

Many others asked the similar questions but after listening to all the questions, the officials of World Bank has only replied that ‘we will come to your village next time’ and went back. The meeting was held in the ‘Siyasen’ Guest House of THDC, which is very much safe considering the distance from the actual place of tunneling. Contrastingly, after repeated claims of no destruction on the hills above the tunnel, THDC has not constructed any office there. It is clearly visible that putting the villagers in danger, they have marked themselves safe by keeping the office out of the affected area.

The villagers of Durgapur village were not heard showing lack of time and other engagements. 21 villagers have been framed in a legal case by a contractor company of THDC, alleging the disruption to the project work. The village is going to face the landslide as it is situated at the outlet of the tunnel from where the river will come out. The people have stopped the project work, staged protests, movements which was stopped by the district magistrate of Chamoli with an assurance of an investigation and report on likely impacts on the village due to the blasts carried out for tunneling under this project. The investigation is not yet completed; compensation for previous destruction has also not been given to villagers. THDC’s claim of illegal encroachment on their land after 2013 disaster is also false as the govt. only given the land to the villagers. The investigation report is not come out in the public even after the visits of officials and now because of the movements and protests against these irregularities, the company who has been given the contract is filing false cases on villagers for disrupting the work.
Similarly, the villagers have been framed in the village where the tunnel starts and village above Power House. Whenever people protested, they were framed and cases were filed against them, on the other hand the company kept moving ahead with the project work. This clearly shows the policies of World Bank where they are in a way against their own safeguard policies of rehabilitation and environmental and proving the work of Dam project right by ignoring the serious issues of rehabilitation and environmental devastation.

On blatant violation of World Bank policies, the affected villagers had complained with the so called independent investigation team in which the process took more than one year of time but the report has miserably failed to address the real issues. After which the company and the World Bank is working without any hesitation and when the villagers protested against the progress of dam work, they were endlessly framed by THDC and their contracted companies. Today almost 74 villagers are facing the legal cases in the dam affected area.

Ms. Sona Thakur, Mr. Piyush and a bank official were presenting the World Bank team. There was no information ever with the villagers and the Gram Sabha about their visit. The team has failed miserably to answer the questions and the real picture narrated by people during the meet.
Ganga need to be independent from the destruction then only the Himalaya and its inhabitants will remain protected and healthy. We will continue to take this struggle and movement ahead.

उच्चतम् न्यायालय ने अपने कंधों का भार उतारा

परियोजना का नामः
टिहरी बांध जलविद्युत परियोजना {1000+1000+400}; नदीः भागीरथी गंगा व भिलंगना नदी; बांध कंपनीः टिहरी जलविकास निगम; पर्यावरण स्वीकृतिः 19-7-1990; बांध का उद्घाटनः 2006 माननीय उच्चतम् न्यायालय में टिहरी बांध केसः एन0 डी0 जयाल व शेखर सिंह बनाम भारत सरकार व अन्य (SLP (c) No. 22894 of 2005)
लगभग 11 साल चलने के बाद माननीय उच्चतम् न्यायालय ने टिहरी बांध विस्थापितों के पुनर्वास के मुद्दे को वापिस नैनीताल उच्चन्यालय भेजा दिया। टिहरी बांध के विस्थापितों के लिए यह कोई अच्छी खबर नहीं है। उच्चतम् न्यायालय ने कहा कि दस साल से यहंा क्यों है? जबकि अपेक्षा थी की उच्चतम् न्यायालय सरकार व टिहरी बांध बनाने वाली कंपनी, टिहरी जल विकास निगम से पूछता की उन्होनें पुनर्वास क्यों नही किया? जिन मुद्दों को पिछले दस सालो से उच्चतम् न्यायालय देख रहा था उन सब  को एक ही झटके में नकार कर सिर्फ ‘‘उच्चतम् न्यायालय में दस साल से केस क्यों लंबित है?‘‘ इस पर ही चिंतित होकर विस्थापितों व पर्यावरण के गंभीर प्रश्नों से मुंह फेर लिया है। आखिर किस बात की जल्दी है माननीय उच्चतम् न्यायालय को? पिछले दस सालांे में उच्चतम् न्यायालय के कारण पुनर्वास के अनेक काम हो पाये थे। 11 साल में यह महत्व का है कि पिछले लगभग डेढ़ साल से  केस की तारिख बिना कारण आगे बढ़ती जा रही थी। यानि माननीय उच्चतम् न्यायालय ही न्याय में देर करता रहा। और अंत में केस ही वापिस किया उन्ही के पास जिनके निर्णय के खिलाफ वादी माननीय उच्चतम् न्यायालय आये थे।

उच्चतम् न्यायालय के कारण क्या हो पाया?

ऽ    टिहरी बांध बनने के बाद भी सर्वे ऑफ इंडिया के सर्वे ने, जो टिहरी बांध जलाशय की गलत सर्वे लाइन के कारण 1000 विस्थापित पुनर्वास से वंचित थे, उनको पुनर्वास योग्य पाया गया। अभी उन सबका पुनर्वास बाकी है।
ऽ    नवम्बर 2011 में 103 करोड़ उच्चतम् न्यायालय के आदेश पर टीएचडीसी ने उत्तराखंड सरकार को टिहरी बांध विस्थापितों के पुनर्वास के लिये दिये।
ऽ    अदालत के दवाब पर ही, 2010 में टिहरी झील भरने के कारण झील के किनारे के जो लगभग 45 गांव धसने लगे थे उनके लिये एक सम्पाशर्विक नीति बनाने के लिये सरकारें मजबूर हुई।
ऽ    इतने सालों में ग्रामीण विस्थापन से लेकर शहरी विस्थापन तक, कही पर भी पुनर्वास की सुविधाएं पूरी नही मिल पाई हैं। बल्कि नयी समस्याएं सामने आई है।
ऽ    हम नैनीताल उच्च न्यायालय में पूरी आस्था रखते हुये यह मानते है कि उच्चतम् न्यायालय के कारण ही सरकार व बांध कंपनी पुनर्वास के मामले पर कुछ सजग रही।

अभी भी बाकि हैः-
ऽ    जहाँ पर आज 36 साल बाद भी लोगो को पुनर्वास की समुचित सुविधायें नहीं मिल पाई है, भूमिधर अधिकार नहीं मिल पाया है।
ऽ    पुनर्वास की समस्याआंे को हल करने के लिए जो तंत्र बनाए गए वे भी काफी हद तक नाकामयाब रहे है।
ऽ    शिकायत विभाग ने जितनी भी उनके पास शिकायते आई उनको निरस्त कर दिया गया। क्यों निरस्त किया यह जानकारी भी लोगो को सीधी नहीं मिल पाई?
ऽ    ग्रामीण पुनर्वास स्थल में काफी लोगो ने अपनी ज़मीन इसीलिए बेचीं दी क्यूंकि वहाँ पर पानी एवं अन्य सुविधाएं नहीं थी।
ऽ    29 जुलाई 2005 में जब बाँध कमीशन हुआ था। और 2008 में तत्कालीन उर्जा मंत्री ने घोषणा की थी 1 प्रतिशत लाभ स्थानीय विकास कोष में दिया जाएगा। इस नीति पर कोई काम नही हुआ है।
ऽ    तत्कालीन उर्जा मंत्री ने यह भी घोषणा की थी कि बाँध विस्थापितों को 100 यूनिट बिजली मुफ्त मिलेगी। इस नीति पर कोई काम नही हुआ है।
ऽ    बाँध की झील भरने के साथ 2010 में लगभग 45 गाँव धसक कर नीचे आ रहे है उनके लिए सम्पाशर्विक नीति बनी। माननीय उच्चतम् न्यायालय में अभी उस नीति पर चर्चा ही चल रही थी।
ऽ    माननीय उच्चतम् न्यायालय अभी यह निर्णय नही कर पाया था नये विस्थापितों को ज़मीन नीचे हरिद्वार जिले में दी जाए या फिर झील के आस-पास दी जाए?
ऽ    टिहरी बांध शिकायत निवारण सेल के अध्यक्ष श्री इंद्रजीत मलहौत्रा ने उच्चतम् न्यायालय को भेजी अपनी अंतिम रिर्पोट में पुनर्वास निदेशालय के कामकाज पर पूरी तरह असंतोष जताते हुये कहा है कि पर्यावरण का विनाश और टिहरी बांध विस्थापितों का शोषण हो रहा है।
ऽ    केंद्रीय वन, पर्यावरण एंव जलवायु परिवर्तन मंत्रालय ने 2003 के बाद से टिहरी बांध क्षेत्र के पर्यावरण व पुनर्वास के मुद्दों की कोई निगरानी की है। 
ऽ    जलसंग्रहण उपचार योजना का काम सही नही हुआ है या योजना सही नही थी। इसका नतीजा है टिहरी बांध जलाशय के किनारे के गांव नीचे धसक रहे है।
ऽ    भारतीय भूसर्वेक्षण की रिर्पोटो पर भी ध्यान नही दिया।

इस पूरी परिस्थिति में आज उच्चतम् न्यायालय ने वापिस उच्च न्यायालय को ज़िम्मेदार बनाया है की अगर प्रभावितों की कोई शिकायत होती है तो उसमे जा सकते है। उच्चतम् न्यायालय का ये भी मानना रहा की विभिन्न तरह के जो भी तंत्र है यानि जिलाधिकारी, पुनर्वास कार्यालय से लेकर शिकायत विभाग तक। वो अपना काम करें और फिर यदि प्रभावितों को अगर कोई समस्या हो तो वो उच्चन्यायालय भी जा सकते है।

अब प्रश्न है कि आखिर कितने लोग वहंा जा सकते है? कितनों के पास उतने संसाधन होंगे?
ज्ञातव्य है की अभी तक राज्य सरकार ने बाँध की झील पूरा भरने की इजाज़त नहीं दी है। क्यूंकि राज्य सरकार पर पुनर्वास देख रही है पिछले कई वर्षाे से यह लगातार हो रहा है कि पुनर्वास कार्यालय पैसे की तंगी से जूझ रहा है पुनर्वास के लिए पैसा टीएचडीसी है। मगर टीएचडीसी मानती है कि पुनर्वास पूरा हो गया है। इसलिये अब पुनर्वास के लिये पैसा नहीं दे रही है। विस्थापित टीएचडीसी व पुनर्वास कार्यालय के बीच झूल रहा है।

सबसे बड़ी बात यह है एक तरफ बांध से उत्पादित बिजली में राज्य सरकार जो 12 प्रतिशत का हिस्सा मिलता है। राज्य सरकार उसका क्या कर रही है? उसका भी कोई पता नही। ऐसे तमाम प्रश्न रहे है जिनको उच्चतम् न्यायालय उठाया जा रहा था। 29 अक्तूबर, 2005 में जब नैनीताल उच्च न्यायालय ने बाँध की झील भरने की इजाज़त दी तो उसके अगले ही दिन सुप्रीम कोर्ट में एन. डी. जयाल व शेखर सिंह तथा किशोर उपाध्याय व अन्य ने इस अन्यायी निर्णय को उच्चतम् न्यायालय में चुनौति दी। इसमें बड़ी भूमिका वकील श्री संजय पारिख जी की रही जो 1992 से इस केस में वादियों की पैरवी कर रहे है।

लोगो की अपेक्षा इस कारण से भी उभरी थी माननीय उच्चतम् न्यायालय के दबाव के कारण से बांध कंपनी और सरकार कुछ-कुछ कामों को आगे बढ़ा रही थी मगर अब वो आशा धूमिल दिखती है मगर फिर भी हमारी अपेक्षा है की नैनीताल उच्च न्यायालय इन बातों पर निगाह रखेगा और जिलाधिकारी, पुनर्वास कार्यालय से लेकर के शिकायत विभाग व सरकार के अंतिम अधिकारी तक इस बात की कोशिश करेगे की उत्तराखंड का सिरताज  बताये जाने वाले टिहरी बाँध से जो विस्थापन हुआ है उन विस्थापितों को उनका जायज़ हक मिले और पर्यावरण की जो क्षति हुई है उसकी भरपाई हो।

इस निर्णय से ये भी संकेत मिलता है कि ये मामले सिर्फ अदालतंे ही तय नहीं कर सकती है। ये राज्य और केंद्र सरकार के उर्जा एवं पर्यावरण मंत्रालय की भी ज़िम्मेदारी है। आज जल संसाधन मंत्रालय जिसमें गंगा पुनर्जीवन शब्द भी जोड़ा गया है। वो भी गंगा की सफाई से उपर उठकर गंगा के बांधों से हो रही गंगा व स्थानीय लोगो की तबाही पर ध्यान दें।

          HON'BLE SUPREME COURT SHRUGGED OF THE CASE

After decades Hon'ble supreme court reversed back the Tehri dam displacement case to Nanital high court which is a setback for the people displaced due to Tehri Dam. Hon'ble Supreme Court commented why this case is here since last 10 years? It was expected from the Hon'ble supreme court that court will ask to the government and Tehri hydro development corporation (THDC), why the rehabilitation has not been done? Overlooking all the important aspects of the case like environmental hazards due to Tehri dam and the rehabilitation of the displaced people, court only focused on the question that why the case is in supreme court since last 10 years. Why is the Supreme court in such a hurry? It must be noted that the SC has been rescheduling and postponing the dates of hearing since one and half year. Its means Hon'ble supreme court delayed the justice and in the end reversed the case to high court against whom order the appellant had challenged in Hon'ble supreme court. It important to mention here that it is only because of the supreme court many rehabilitation works were done in last 11 years.

WHAT HAS BEEN DONE BECAUSE OF THE HON'BLE SUPREME COURT?

  • As in Tehri dam, because of the faulty survey 1000 people were struck out of the rehabilitation process. They were later found eligible for rehabilitation by the Survey of India, due to the efforts of SC but still the rehabilitation has not been done. 
  • By the order of the SC, in November 2011 THDC gave 103 rore rupees to Uttarakhand government for the rehabilitation purpose.
  • In 2010, due to the filling of the Tehri reservoir, around 45 villages on the periphery started to sink in. due to the pressure of the SC the government was compelled to frame collateral policy.
STILL LEFT:

  • So far the rehabilitation facilities have yet to be completed rather many new problems have surfaced out.
  • Even after 36 Years people have not been provided with the basic facilities and land rights.
  • The mechanism built for the rehabilitation process has failed to a larger extent.
  • GRA dismissed all the complaints without giving proper reason of dismissal.
  • people were forced to sell out their land because they had no water and other basic facilities.
  • On 29th July 2005, dam was commissioned. In 2008 the then power minister announced 1% of profit will be given to “Local Area Development Fund” and it is yet to be done.
  • The then power minister also announced to provide free 100-unit electricity to dam displaced people. Nothing has been done on this policy also.
  • In 2010 dam reservoir was filled which led to sink around 45 villages and for them collateral policy was framed and discussion was going on in SC.
  • SC is still in a dilemma whether to provide land to the new oustees, on the periphery of the lake or in the Haridwar district.
  • The chairperson of Tehri Dam GRA Mr. Indrajeet Malhotra submitted the final report to Hon'ble supreme court showed dissatisfaction towards the rehabilitation directorate work and commented in the report about environmental damage and the exploitation of the Tehri dam displaced people.
  • After 2003 Ministry of environment, forest & climate change (MoEFCC) didn't do inspection on any issues related to environment and rehabilitation in Tehri dam affected area.
  • Catchment area treatment plan or work was not in right direction. it resulted in sinking of the villages near by Tehri reservoir.
  • Reports of the Geological survey of India were not taken into consideration.
Considering the whole circumstances, Hon'ble supreme court has shifted the responsibility to Nainital High Court and said if the affected people have any complain they can appeal to the Nainital High Court. Hon'ble supreme court also believes that all the administrative bodies, be the District Magistrate, Rehabilitation directorate and GRA work properly and if then the affected people have any problem they can approach to the Nanital High Court.

NOW THE QUESTION IS HOW MANY PEOPLE HAVE THE CAPABLITY AND RESOURCES TO APPROACH HIGH COURT?

Uttarakhand state government has not given permission to fill the reservoir fully. State government is taking care of the rehabilitation. Rehabilitation directorate is short of funds,  monetary funds were provided by the THDC but now THDC believes that rehabilitation is complete and that’s why THDC is not giving funds anymore. So displaced people are hanging in between the THDC and rehabilitation directorate.

The question is about the 12 % share of electricity generated by Tehri dam, that government gets from the Tehri dam company? what the government is doing with it? All these questions have been raised in Hon'ble supreme court. On 29 October, 2005 Nainital high court ordered to fill up the reservoir. Next day it was challenged in Hon'ble supreme court in the case of N. D. Jayal and Shekher Singh also by Kishore Uppadhay and others. Advocate Sanjay Parikh played an important role who has been favoring appellant since 1992.

People’s expectations were increased because in the pressure of Hon'ble supreme court, the government and dam companies did some work on the issue of rehabilitation. Now it seems muddled but we hope that the Nainital High court will keep its eye on it and the district administration and rehabilitation directorate will try that affected people get proper compensation and the environmental damage will be taken care.
This order also indicated that only the courts cannot finalize the issues like this. This is also the responsibility of the center and state, Power Ministry and MoEFCC. Nowadays word Ganga rejuvenation is added to ministry of water resources, so the ministry should work for the protection of the National River Ganga in upper reaches and its people and it should be beyond the cleanliness of National River Ganga.

की शपथ

पिंडर को अविरल बहने दो! हमें सुरक्षित रहने दो!! के नारों से पिंडर गंगा का पंच प्रयाग गूंज गया। सैंकड़ो की संख्या में विभिन्न गांवों से आये ग्रामीणों ने मकर संक्राति पर पिंडरगंगा के पंचप्रयाग पर पूजा की और पिंडरगंगा पर बांध रोकने के लिये संघर्ष के अगले कदम की शपथ ली। ज्ञातव्य है कि उत्तराखंड की चमोली जिले में अबतक अनछुयी पिंडर नदी पर 252 मेगावाट का बांध प्रस्तावित है। अलकनंदा को कर्णप्रयाग में मिलने वाली पिंडर, गंगा की एक प्रमुख सहयोगिनी नदी है।

पंचप्रयाग पर स्नान के बाद ग्रामीणों ने सभा की जिसमें पंचप्रयाग के महत्व के बारे में चर्चा हुई और बांध विरोध के संघर्ष को आगे बढ़ाने की जोरदार तैयारी की बात हुई। सभा में तलोर गांव के बलवंत आगरी जी ने कहा की पंच प्रयाग सदियों से यहंा मौजूद है। हम इसकी पूजा करते है। बांध से इसे डूबने नही देंगे। हाट गांव के दिनेश मिश्रा जी पंचप्रयाग का महत्व बताते हुये कहा की बांध कंपनी अपने कागजों में नही बताया है कि यहंा पंचप्रयाग है। हम हर साल यहंा स्नानपर्व मनाते है। अपनी पहचान को डूबने नही देंगे। देवाल बाजार व्यापार संघ के पूर्व अध्यक्ष श्री आलमसिंह ने कहा की बद्रीनाथ जी के बाद इस पंचप्रयाग का महत्व सर्वोपरि है।
विमलभाई ने बताया कि अभी तक पर्यावरण, वन एंव जलवायु परिवर्तन मंत्रालय ने पर्यावरण व वन स्वीकृति नही दी है। 31 दिसंबर को संपन्न वन सलाहकार समिति ने भी अभी बांध कंपनी से और जानकारियंा मांगी है।उन्होंने आगे की पिंडरगंगा घाटी में रहने वालो के संघर्ष ने 6 सालों से ज्यादा बांध रोक रखा है। 2009 से हुई जनसुनवाईयंा लोगो के विरोध के कारण नही हो पाई। बाद 20 जनवरी 2011 में प्रशासन की मिलीभगत से धोखे से जनसुनवाई करके बांध कंपनी ने अपनी कागजी कार्यवाही पूरी कर ली। किन्तु 3 अपैल 2011 में पिंडर घाटी के लोगों ने माटू जनसंगठन व भू-स्वामी संघर्ष समिति द्वारा आयोजित जनसुनवाई में हजारों की संख्या में आकर बाँध का जबरदस्त विरोध कर के यह सिद्ध कर दिया कि सरकारी झूठ के सामने वे बाँध विरोध में मजबूती से खड़े हैं।
2013 में आई प्राकृतिक व बांध आपदा ने यह सिद्ध कर दिया है कि बांध स्थानीय पर्यावरण व रहनेवालो के लिये जानलेवा ही सिद्ध होगे। जून 2013 की आपदा में अलकनंदागंगा व निकट के गांवों की तबाही विष्णुप्रयाग व श्रीनगर बांधों के कारण हुई। इन सबके कारण सर्वोच्च न्यायालय ने भी अगस्त 2013 से उत्तराखंड की किसी भी जलविद्युत परियोजना पर किसी भी तरह की स्वीकृति पर पांबदी लगा रखी है। सर्वाेच्च न्यायालय के आदेश के कारण बनी रवि चोपड़ा समिति ने भी अपनी रिर्पोट में कहा है की जून 2013 की बाढ़ में बांध परियोजना की लगभग 30 प्रतिशत ‘‘हिस्सेदारी‘‘ है। पिंडर ने भी 2013 में अपना रौद्र रुप दिखा कर सिद्ध कर दिया था कि उसे कोई रुकावट स्वीकार नही।

हमारा आंदोलन जारी रहेगा।

 Paindarganga-Panchprayag Confluence with 

resolve to intensify struggle against mega-dams


Let Pindar flow freely ! Let us live fearlessly ! were the slogans that reverberated the hills of the Pindarganga valley, situated in the lap of the Himalayas. Hundreds of villagers from different villages marked Makar Sankranti this year by assembling at the confluence of five rivers at Panchprayag and resolved to leapfrog to the next phase of the struggle against mega dams in the region. The immediate challenge is the struggle against the 252 MW Hydro-Electric Dam proposed on the Pindar river in the Chameli District of Uttarakhand. Pindar is a significant tributary of Ganga, which meets Alaknanada at the Karnprayag confluence.

The day began with a ritualistic dip in the Pindar followed by a public conversation, wherein the locals highlighted the cultural significance of Panchprayag and also discussed strategies to take forward the struggle to keep Pindar alive and free of dams. Balwant Agri of Talor village stated that Panchprayag has been in existence for centuries. It is not just a cultural hallmark, but part of people’s lives and we shall not let it be damned. Dinesh Mishra of Haat village questioned the credibility of the dam building companies that have concealed the crucial fact in the project documents that there is a Panchprayag (confluence of 5 rivers) in the area. “We will not let our identities to be drowned”, he said. Former President of the Deval Market Dealers Association stated that Panchprayag is only next to Badrinath in significance and it should not be damned.

Environmental Activist and NAPM Convenor, Vimalbhai informed the gathering that till date the Union Ministry of Environment, Forests and Climate Change has not granted clearance to the Dam. The Forest Advisory Committee has infact directed the project authorities to furnish further documents and information, he said. It is indeed notable that the struggle of the people of the Pindar valley has ensured that the Dam could not be built for the past 6 years. The sham official ‘public hearings’ to push the project could not go ahead since 2009, due to popular protests.

Notwithstanding the fact that the project authorities hands-in-glove with the administration tried to conclude the ‘paper formalities’ by conducting a fake ‘public hearing’ on 20th January, 2011, thousands of people participated in an actual People’s Hearing organized by Matu Jan Sangathan and Bhu-Swami Sangharsh Samiti on 23rd April, 2011 and vocally protested against the Dam, exposing the falsity of the government ‘hearing’, as well as asserting the strength of the people of the region.

The country still remembers Uttarakhand and the dams-induced havoc caused in 2013 is fresh in the minds of the local residents, who know for sure that more damning of the Himalayan rivers would prove to be a monumental disaster and death-noose for the environment and people of the region. The destruction caused in June, 2013 in the villages in and around Alaknanda-Ganga was due to Vishnuprayag and Srinagar dams.

A disaster of this scale compelled the Hon’ble Supreme Court to take a serious cognizance of the deleterious impacts of dams and directed that no fresh clearances would be given to hydro-electric projects in the region. The Ravi Chopra Committee constituted pursuant to the directions of the Supreme Court also concluded in its Report that the dams in the region have at least a “30% share” in the June, 2013 Uttarakhand disaster. Pindar herself showed her furious form in 2013 and has conveyed the message that she will not brook any damning. Is the government listening?

Not sure. But the people of the region certainly are. Aware. And that is why, as the meeting concluded, they all resolved in a united voice”

Our struggle shall not only continue but even intensify until Pinder river is liberated from the dams “!!
