EAC Postpones Environment Clearance of Pancheswar Project till the Next Meeting

Seeks More Studies for Rupali Dam, but Maintains Silence on Pertinent Issues Raised During the Public Hearing

Committee Visits the Pancheswar Valley Secretly, No meeting with PAFs

Two big dams, Pancheshwar, 315 mts high and Rupali, 95 mts high, are proposed on Mahakaliriver in Uttarakhand. On the basis of the reports of the public hearings of the Pancheshwar Multipurpose Project, the Environmental Assessment Committee (EAC) assigned with clearances for "river valley and hydro power projects" met on October 24th and decided the fate of thousands of hectares of land to be submerged and more than 40 thousand affected families, in less than an hour.

The committee postponed the final decision for the next meeting and constituted a committee of 7 members headed by Sharad Kumar Jain, Chairman, Environmental Assessment Committee and Member Secretary & Director Dr. S. Karketa. The Committee made a secret visit to the site without informing or meeting any of the Project Affected Families (PAFs) or social organisations protesting the dam. The report of this committee will be submitted before the next meeting and will also be considered in taking final decision. It is important to note that many mass organizations and eminent people had sent their objections to the EAC. However, the EAC meeting minutes reflect that none of those objections were considered at the meeting. All the misdeeds and illegality in conducting Public Hearings brought to notice of the EAC, were withheld from the full committee. Thought the complete essence of the project is summarized in minutes, and the Committee requested some clarifications, but the intent is clear that the final decision should show some due process followed by the Committee.

As for the Rupali Dam, given that it is now being shifted 2 kms downstream, from the proposed location, the committee has asked for a new study, along with the Environment Impact Assessment Report of the Nepal side of the project. The Committee with regard to other approvals has sought more clarifications from the project proponent. The committee has also sought clarifications on the Ministry of Water Resources Notification of October 2016, which prohibits construction in the Greater Ganga river valley.

It is worth mentioning that in the EAC meeting, the organizations had asked for mere 5 minutes. That too was not given. The question arises, how was all this done in less than 1 hour? The fact remains that in the affected villages, people still do not know about all the studies and reports related to the dam. Even the information related to the R&R hasn’t been given to the PAFs. Fake objections were generated by the authorities, on behalf the people, to complete formalities. The committee did not pay any attention to the complaint letters written by people on these topics. Even meeting the member secretary of the EAC in person, was completely disappointing.

Where will all the displaced people be given land? Till today, the rehabilitation of displaced people from Tehri is incomplete and is ongoing. The question of climate change and its dangerous consequences are facing us, and no one seems to be worried about it. On one hand, Ministry of Power is emphasising that there is surplus electricity in the country, but still we are pushing for more Hyde projects. Same is the issue with Uttarakhand Government, which is trying to stop migration by creating a Migration Ministry but on the other hand is planning displacement of 40,000 families. 350 villages are already displaced due to land slides in Uttarakhand. Kumaon’s densest forests, prime agriculture land all are faced with the direct or indirect submergence or other related impacts. Markets of Jhoolaghat-Jauljibi, symbols of Indo-Nepal socio cultural ties are facing submergence. There are many such issues, which have been ignored by the EAC in its present assessment. SIA done in haste is completely farcical, and has been blindly accepted by the Committee without any verification. All this rush will prove dangerous in future for everyone.

Separately, 45 eminent environmentalists and river activists of the country wrote in a letter to the Secretary, Ministry of Environment, Forest and Climate Change (MoEFCC), head of EAC and member secretary and all the members of EAC, raising their reservations with regard to the public hearing process. The environmentalists included prominent names like Mr. Ravi Chopra, Mr.Dunu Roy, Dr. Bharat Jhunjhunwala, Mr. Manoj Mishra, Mr.Himanshu Thakkar amongst others. According to them, public hearing held on August 9, 11 and 17 (in Champavat, Pithoragarh and Almora) were not as per the guidelines of the 14 September 2006 Notification. 134 affected villages are very remote and accessibility is very difficult, with hardly any reach of the newspapers, where public hearing notice was given. Hence, the information given by affected people was limited in nature, and without complete knowledge of the SIA, EIA and EMP studies. This is highly unethical and illegal practice for the beginning of an international project of this magnitude. They added that, whatever may be the motivations behind the project, whatever may the advantages or disadvantages be, the procedure used for holding Public Hearings by with holding crucial information from project affected people and further ignoring the objections raised by many, the continued process of clearance by EAC is completely unacceptable and will only cause severe damage to environment.

The letter demanded that:

  1. EAC must consider the continuance of the Clearance process for the Pancheswar Multipurpose Project
  2. It must re-conduct the Public Hearing after giving adequate information of EIA, EMP and SIA reports in local languages and a month notice.

MahakaliLokSanghatan is devoted towards right and sustainable development of Mahakali valley. The Governments is only pushing for displacement and environment destruction. We will expose their wrongdoing and bring the truth out to public.

The Pancheshwar multipurpose is rather multi-delusional project.
The process of the Pancheshwar dam and Rupaligad dam be stopped immediately.
Protect Forest Rights - make Biodiversity Register at village level.

The affected people have been kept in dark and the procurement of environment and forest clearance is being subtly processed which directly construes that the government does not at all have any intention of development, instead creating ways and means of the fulfilment for the contractors. It is more of Pancheshwar multi-delusional rather than Pancheshwar Multipurpose project.
How and according to which survey a former chief minister gives statement that 99 percent of the people are in favor of the dam? This shows that the government is trying to push the dam only on the basis of spurious data. Claims and promise in favor of the dam without studies show that the ruling party is treating the dam as an election campaign. Just in some way the dam should be put on a legal front and the promises & claims will remain swinging like the Tehri dam.
Administration has the pressure to fulfil the dream of Modi ji hence with the statement “anti-dam organization will be especially monitored”, they are now trying to frighten the affected and pro-people organizations. Incomparable beauty of Sarayu Valley and the Mahakali of Kumaon area of Uttarakhand, cultural heritage, religious beliefs, oxygen reserves and the villagers who have been kept isolated from health services, education and other benefits of development even after independence, are being imposed upon the dam of destruction. We utterly oppose both the dams.
We are able to prove not only ethically that the dam is unsuitable but also with logic and legal aspect.

Warfutting work in Champawat district:- The Pancheshwar and the Rupaligad dam are proposed in Champawat district. Therefore, all the legal formalities attached to these dams in the district are being formally completed. Which has nothing to do with the affected and the environment. Data of the Social Impact Assessment Report is outdated and inaccurate. The villagers are not even aware of when who came to survey? As if the ground survey were carried out with the help of Google Baba in the modern technologically developed world. Therefore, the meetings on the Social Impact Assessment Report and so-called rehabilitation policy going on in the villages Simlkhet, Botri, Needle etc. of the Champawat district are being opposed.

Two dam projects, not one: -Assuming the two dams as a single project, the Environmentl Assessment Committee gave Terms of Reffrence this project on April 25, 2015. Then, public hearing was also deceitfully unified in one.

There should have been separate public hearing of the 95-meter-high concrete Rupaligad dam of 240 MW below 27 kilometers of the Pancheshwar dam, proposed in the Champwat district itself. This has been done wrong having said it as a part of the Pancheshwar multipurpose hydro power Project. It is a big dam which itself is a separate project. This way, the rights of the people have been curtailed. This itself is an evidence that the foundation of the Pancheshwar multipurpose hydroelectric power project laid on deception.
Deceitful public hearing, Without information: -
The public hearings in Champawat on August 9, 2017, Pithoragarh on August 11, 2017, and in the Almora district on August 17, 2017, was wrong on all ethical, practical and legal ground. The public hearings were completed without informing them in fear, pressure and delusion.
Turn down the 'Social Assessment Report' and false claim of rehabilitation:-
The rehabilitation claims are beyond the reality. There is no mention of how the figures were gathered and from where. There is a mention of the year 2011 at one place in the 'social assessment report' about the effects of the dam on people, but there is no mention of years under each list. In the report, incorrect statistics have been given on the status of agriculture, ratio of women and their socio-economic status. There is no mention of even the two big markets such as Jauljibi and Jhulaghat in the report. whereas these are the major trade centers of Indo-Nepal on which thousands of families are dependent for years. This is also a cultural exchange center.

29,400 families of 134 villages are being affected in the Pancheshwar dam and 1,587 families in the Rupali Gada dam. These numbers are very deceptive. Because only those who had land registered on their name have been considered as a family. Which means, a 75-year-old who has 4 sons and 8 adult grandsons is considered only one family on this equation. The promise of giving land is not clear.
Violation of the forest land act 2006: - Without giving actually the forest rights to the villagers, forest related clearance are being obtained under the Forest Rights Act, 2006. In Champawat district, the task was accomplished even before August 9. The affected people do not even know that the Forest Rights Act 2006 entitle them rights at the nearby forest. Till date, nowhere in Uttarakhand, the people have been recognized under Forest Rights Act 2006.
The Biological Diversity Act 2002 be followed: - According to The Biological Diversity Act 2002, it is necessary to make a public biodiversity register at every town, village, block and district level, in which there would be a complete information of biological diversity of the area. So that the entire bio-diversity of the village can be found.

So, we demand that: -

  1. It is acknowledged that this was two dam projects, not one. Which is now getting closed.
  2. These public hearings should be considered unlawful.
  3. The 'Social Assessment Report' be turned down.
  4. Under the Forest Rights Act 2006 the villages be given rights.
  5. Public Biodiversity Register should be made at village, block, district and municipality level.

{English after the Hindi Press Note}

“Himalaya Diwas” 9th September

“No to DAM : Safe Himalayas”

Lets fight agaist distruction fo Himalaya

“Himalaya Diwas” 9th September, the government of Uttarakhand has prepared lot for the Himalaya da, this time central government of India has also made preparations for the Day. Narendra Modi is also coming. A mere celebration of the Himalaya Day will not save the Himalayas rather it would be more important to understand the grief of the Himalayas. What is the cause of concern for the Himalayas today, let us understand that. Today Himalaya is threatened by so called development activites. This so-called development has pierced the Himalayas. Thousands and millions of acres of forest have been destructed in these development works, building roads, constructing dams and in other works; And the remaining forest is also being destroyed by the grace of the forest department.
The basic element of the Himalayas are the snow, rivers, and forest and its protector is the inhabitants of there. The green cover beneath the entire Himalayas and the white snow cover above the top. The snow cover is the protector of the entire health of the Himalayas. Having snow and covered with trees, have been the two important things for the Himalayas. As we have expedited development plans in the Himalayas, the glacier has started melting in the region and the forests have also been recklessly cut down. The formation of a dam has caused clouds to burst. Cloud burst incidents have increased rapidly after the construction of the Tehri Dam.
The landslides have increased due to the formation of large widened roads. Wherever the roads are widened, more explosives are used, due to which landslide begins soon after the construction of roads. Himalaya is becoming vulnerable due to the excessive use of explosives. Wherever large and widened roads there and colossal projects of so-called development, in which these big dams etc. are included, have caused havoc to the Himalayas. Why do the government not understand it?
Chief Minister of Uttarakhand, Mr. Trivendra Rawat, had asked people of the state on 15 August to take a resolution to plant at least one tree. On the other side, thousands of millions of hectares of forest are submerged directly.
The rights of the Himalayas have been totally denied in the way that the public hearings of the Pancheseshwar Multipurpose Dam have taken place recently in the month of August. Governments are bringing the dam in the name of development, on the other hand, they talk about protection of the Himalayas. On one hand, they talk about planting a tree, on the other hand, thousands of hectares of forests are submerged. So, it seems the difference between their words and action.
Rivers are daughters of the Himalayas. We would like to remind the governments again that there was hardly any dam which the rivers did not show their outbreak during the June 2013. The rivers, especially the Ganges, went ahead by breaking the dams and wherever the dams hindered the flow of the river, it was more destructions over there. Because of the use of explosives in the construction of dams, landslides were recorded more in those areas. We have always kept the matter in front of the governments, but regretfully the government believing Ganges as the mother so far, which is now also being called the government of double engine, is not totally silent in the matter but is working against.
The way the mining is being extended in the rivers and the way the mining was done in the name of employment, they are all absolutely wrong. Because mining is not employment. Yes, only a few contractors get benefitted. We have told the government that in the Tehri Dam and other dams, a lot of debris and sand lying, like in the reservoir of Vishnupraya dam. If this sand is released, then the reservoir of Tehri Dam will be empty and it will also be able to store more water. But leaving it aside, there has been a talk of increasing mining in Haridwar and the areas below.
On this auspicious occasion of Himalaya Day, we demand the Central and the State Governments to first understand the grief of the Himalayas and change the policies of development accordingly. Of course, a little bit of electricity will be generated from the big dams, but devastation will be more than that.
On the Himalaya’s day, the governments may resolve not to repeat the mistake like Tehri dam. And take the Pancheshwar multi-purpose hydro power project back.
