{DUU-61} VOICES AGAINST DEVSARI HEP 14-3-2011

AGITATION ON

WORLD ANTI DAM DAY

NO DAM ON RIVER PINDER

There have been continuous demonstrations by the dam- affected people of the Pinder valley since January 20, 2011 against the Devsari HEP in several affected villages. On the occasion of the World Anti- Dam Day, on March 14, there was a large demonstration under the banner of Bhu- Swami Sangharsh Samiti and Matu Jansangathan in the three villages which served as venues for the drama of project ‘public hearings’. An effigy of the Land Acquisition Act was also burned by the people.

Several prominent leaders of the area were at the agitation. In Kotsari, Subhas Parihar of Matu Jansangathan, Jagdish bhai from village Sunau and Pansingh from village Paithani led the demonstration. In Chepdu, women leaders like Mamta Shah and Kamla Ben were at the forefront with Pushkar Shah. In Deval, Neema Ben of Phaldia, Sunita and Balwant bhai of Talot, Dinesh Misra of village Haat, Munni Devi of village Kael, K D Misra of Deval and Mahipat bhai from Devsari led the people in protest against the Devsari HEP. They were joined by Vimal Bhai.

The people of the Pinder valley stand in opposition to the destruction of the valley and the construction of the dams. Protests since January 20, 2011 have been going on in affected villages like Paithani, Paingad, Sunau, Devalgad, Soona, Tharali, Chepdu, Nandakesari, Ichholi, Hatkalyani, Talaur, Padmalla, Kothi, Ghaud, Khirkot, Atthu, Boragad, Chaud, Kunnipartha, Milkhet, Sorigad, Savaad, Thermalchoting, Lausriban, Mandoli, Khesbalad, Pinau, Bakh, Harmi, Ulanghra, Tudri, Kotha. People aware of the situation, must remember that the ‘public hearings’ of the project were stopped by the people twice, as they had been kept in the dark about the proceedings and were misled. Yet, this public hearing was declared a success. In the environmental ‘public hearing’ conducted on January 20, 2011 the government, the administration and the dam company were seen working together, securing each other’s interests. It is clear that this dam is being forced on the people. The dam- affected of the Mandakini valley are rotting in jails, the Alaknanda valley has been destroyed by the unyielding attacks of one dam project after another. The displacement from the Tehri dam continues to date.

While on the one hand, the dam- affected people are being wooed into voting and supporting various political parties to power; on the other hand, more than a 100 villages have been affected by earthquake induced land submergence and no rehabilitation policy has been framed for them. What will be the fate of the displaced by the Devsari HEP? Pansingh from village Paithani, one of the people leading the agitation in the village Kotsari, said “the sole objective of the dam company (Satluj Jal Vidhut Nigam) is to generate power; they neither know nor care for the people and the environment of the valley.” The people of the Pinder do not want the same to happen to them. Around Rs. 1351.33 crore are being spent on the dam project. The villages around the 17.903 km long and 6.90 m wide tunnel are likely to face earthquakes and induced submergence, drying of water sources and cracks on walls, etc. “Has the dam company made any offices in the villages surrounding the tunnel like Soona and Silodi?” asks Mamta Shah, a woman leader of the demonstration in village Chepdu. Till now, the State Government has not handed over the 195.2555 Hectares of forest land that the project demands. However, the land of 16 villages has been handed over to the project. The environment, which includes the protection and conservation of forests, water resources and land, is also being polluted and degraded. When the Uttarakhand of beautiful river prayags is rapidly changing into the Uttarakhand of dam reservoirs, then the Pinder valley, with its culturally and spiritually important prayags like the pranmati cannot be allowed to submerge.

The government- administration-dam company have used the draconian Land Acquisition Act, 1894 to snatch away the lands of 15 villages. While the Section 4 notices were announced in November, December and January, they were only published in the newspapers in February. It is clear that the company was only waiting to get the ‘public hearing’ over and done with, which it succeeded in doing on January 20, 2011, amidst wide protests from the public. The application of Section 17 along with Section 4 has resulted in the right of the people to oppose the acquisition of their lands being taken away. Section 17 is the emergency clause, which is to be used ‘in case of urgency’. In situations such as floods- drought- wars, etc the District Collector is authorised to exercise this clause, not in opposition to the people. “This is worse than the British Raj! No right to speak out in opposition of acquisition of your own lands?” said Mahipat Bhai of Devsari.

The Dam has not yet received its environmental clearance. How has the dam company started construction? Is the Government aware of this? The people want the cancellation of the proposed Devsari HEP with immediate effect. In support of this demand, demonstration were held in the villages of Kotsari, Chepdu, and Deval, villages where the project’s ‘public hearings’ were held. Vimal Bhai of Matu Jansangathan said,” The struggle against Big Dams will continue.”

URGENT URGENT URGENT

ACTIVISTS ARRESTED

PROTESTING AGAINST SINGOLI- BHATWADI AND PHATA-BHYUNG HEP

Mandakini River is boiling

Citizens familiar with the situation in Uttarakahnd would know of the demonstrations and protests against the Singoli- Bhatwadi and Phata- Bhyung projects that have been going on for many years. The Kedarghati Bachao Sangharsh Samiti (the Save the Kedar Valley Committee) has been opposing these projects and we support them fully.

Fake cases are being registered against protesters and intimidation using goons and power. In a new move, the administration is trying to suppress the anti-dam movement by intimidating the leaders and putting them in jail. The manner in which respected Ms Sushila Bhandari and Mr Jagmohan Jhingvan of the KBSS were arrested on January 30, 2011 was completely illegal and in infringement of their rights. The dam company is using money- power to serve its vested interests. They were picked up from their dharna 14 days ago, where they were peacefully protesting against the construction of these dams. To allow the arrest of the activists who are protesting in a non- violent manner for a better future for Uttarakhand amounts to selling Uttarakhand to the dam companies.

In the rally held on February 11, 2011 in the Rudrapryag, District Headquarters, many prominent activists like the President of KBSS Mr Gangadhar Noutiyal, Mr Madan Mishra of DYFI, Mr Rajaram Semwal, Ms Uma Noutiyal of AIDWA, Mr Dobhal of UKD, many village headmen & peoples' representatives condemned this unethical arrest. Hundreds of protesters including women marched in Rudraprayag from different affected villages.

Supporters from across the country like the senior Gandhian Radha Bhatt, Vimal Bhai of Matu Jan Sangthan, Annad Panday of Ganga Seva Samiti, Bhuwan also supported the struggle. Letters asking for the immediate release of the arrested activists were sent to the Prime Minister of India and the Chief Minister of Uttarakhand.

Supporters from across the country had written to the Chief Minister on February 5, 2009 asking about the need for these large dams. Today, the people struggling for sustainable development are being put behind bars, which is unfortunate for the State of Uttarakhand.

There have been many central committees constituted to assess the social, economic, political, cultural, situational and environmental damages of these large dams. It is clear from their reports that the promises made in the project agreements are never met. Nor are the project proponents seriously worried about the future damages and effects of their projects. Their sole objective is to complete the project, by hook or crook.

This area is an earthquake prone area and older GSI survey reports have made this clear. There have been continuous earthquakes in the village of Singoli. During the devastating earthquake in the Lavla village of Pithoragarh on August 9, 2009 the government had said that it would demarcate the villages affected and relocate them. However, several more villages would be affected by earthquakes when these projects are completed. The land available for rehabilitation in the State is scarce. Where, then, does the government propose to relocate these affected villages? The promises of employment are false which has been made clear from our past experience with large dams. While local employment should be encouraged, large dams are not a dependable source of employment. There are several other such issues which warrant a complete shutdown of these projects.

It is the duty of the State government to protect the interest of its people and the environment. But instead of doing so, the administration in Rudraprayag has resorted to jailing non- violent activists in an attempt to silence them. This deplorable behaviour tarnishes the Government’s image and cannot be allowed to go unacknowledged, if not unpunished, in a democratic society. The Government claims that it is working towards a progressive Uttarakhand; How can such a ‘progressive’ state stand for the false imprisonment of peaceful activists who are genuinely concerned about the future of this State.

Thus in this sitatuion we demand that:

1. The Singoli- Bhatwadi and Phata- Bhyung projectsshould completely shut down

2. The arrested activists are released without any conditions

3. The State Government create more schemes for sustainable development

{DUU-59} Public Hearing or Public Humiliation

Environment Public Hearing for the proposed Devsari HEP (252 MW) was a complete sham!

The Environment Public Hearing for the proposed Devsari HEP (252 MW) was a complete sham and led to the complete humiliation of the people of the Pinder Valley. The officers of the District Administration and the Uttarakhand State Environment Protection and Pollution Control Board were completely part of this drama held on January 20, 2011 at the Chepdu village on the banks of the River Pinder.

The public hearings for the project held on 13-10-2009 and 22-07-2010 were opposed by the people due to their procedural and legal violations and the 20-01-2011 public hearing was no different. This public hearing, too, was not legally or procedurally sound. Just like in the public hearings of 13 October 2009 and 22 July 2010, there is a long list of legal violations in the 20 January 2011 public hearing.

The stage set for the public hearing was 12 feet above the ground and behind it was a solid wall. In the 50 feet area around the stage there were three barricades set up. Thus, it was clear that the whole meeting had been well thought off and planned in advance. Behind the barricades was where this well – rehearsed drama of environment public hearing was being played out. The people from the affected villages of Deval, Tharali and Narayan Bagad block, in spite of lack of resources, turned up for the public hearing in thousands. People were shouting slogans such as- “Let the Pinder flow free- Let us be safe- Dam Company, go back- Suspend this fake public hearing”. And the police, the people from the project company and the barricades prevented the people from putting forward their views. The people could not even reach the stage during the entire hearing. Next to where the officers of the Uttarakhand State Environment Protection and Pollution Control Board sat, there was a small passage for the people to get to the stage. This passage, however, was being guarded by the police and the officers from the SJVN.

The Board was clearly on the side of the dam company; they could be seen following the SJVN’s orders. Only a few people were allowed to go on stage and these were people who were associated with the dam company. When the 63 year old, former teacher Mr Dinesh Mishra tried to get on stage with a letter, he was pushed and shoved and not allowed to do so. The women were also stopped from taking stage. When, somehow, from the ranks of the dam affected, Mr Madan Mishra got onto the stage to speak, the sound system was tampered with and the mikes went off. He was not allowed to finish.

The Additional District Collector, who was presiding over the public hearing, also did not pay attention to the blatant legal and procedural violations. Either he did not know that the public hearing is the one and only opportunity for the people to put forward their views, oppositions, etc or he just decided to sit there tongue-tied. The few people allowed onto stage said the exact thing given as the rules for public hearings in the Environment Impact Assessment Notification of 14 September 2006.

The company had not made any arrangements to get the affected people to the public hearing. The people spent their own money to get there. And yet, they were not allowed to make their point. This public hearing did not just cheat the people of their rights, but was also a great insult to the people of the Pinder valley. The Bhu- Swami Sangharsh Samiti and Matu Jansangathan have been continuously writing to the Board and keeping them abreast with the legal and procedural violations, but no action or enquiry has been undertaken by the Board in this matter.

But we will not keep quiet. After the public hearing, there was a huge meeting at Deval where this event was condemned and it was announced that the people were prepared for the long fight ahead.

On the afternoon of 21 January, the leaders of Bhu- Swami Sangharsh Samiti and Matu Jansangathan went to the office of the Uttarakhand State Environment Protection and Pollution Control Board and put the matter before the member Secretary of the Board, Mr Ajay Gairola. He guaranteed that after the investigation of the tathyon and after taking the views of the Board members into account, once they return from Tharali, he will talk to us. Only then will he take a decision on the public hearing.

On 24 January in the Gopeshwar office in the Chamoli District, around 250 people from affected villages surrounded the District Collector and demanded that this staged fake public hearing be suspended.

The struggle against forcing dams on people continues.
