बंड क्षेत्र की महिलाओं ने दिया हड़ताल को समर्थन:

दूरस्थ गांवो से आई महिलाओं ने बांध श्रमिकों की हड़ताल को समर्थन दिया और बांध कंपनी द्वारा जबरन कराये जा रहे काम को रोक दिया। उनका कहना था कि पहले बांध हमारे उपर लादा फिर जो कुछ काम भी मिला उसमें भी समस्यायें हो रही है। 

विष्णुगाड जलविद्युत परियोजना पीपलकोटी (444 मेगावाट) में बांध निर्माता कंपनी टी0 ए0 डी0 सी0 के अर्न्तगत कार्य करने वाली हिन्दुस्तान कंस्ट्रक्शन कम्पनी (एच.सी.सी.) के श्रमिकों की हड़ताल 18/04/2016 से जारी है। ये श्रमिक हडताल पर हैं। वहीं कम्पनी में कार्यरत सुरक्षाकर्मी भी 17/05/2016 से हड़ताल पर बैठ गये हैं। एक ओर श्रमिक/सुरक्षा कर्मियों की हड़ताल दूसरी तरफ अब कम्पनी में कार्य कर रहे, पेटी ठेकेदार व सप्लायर भी हड़ताल पर जाने का मन बना चुके हैं। कम्पनी चौतरफा हड़तालों से घिरी हुई है।

श्रमिकों की मांगे है - झूठे मुकद्दमें व हटाये कर्मचारियों को वापिस लेना, किसी भी अन्य कारणों से बांध काम बंद होने पर श्रमिकों को वेतन काटना अनैतिक है, वेतन हर महिने की 10 तारिख तक दे दिया जाये, कंपनी द्वारा बनाई यूनियन मंजूर नही इसलिये उसके लिये पैसा ना काटा जाये, नई यूनियन लिये एक दफ्तर की सुविधा दी जाये।

श्रमिकों का कहना है कि कम्पनी की फेडरेशन यूनियन श्रमिकों का शोषण कर रही है। फेडरेशन के पदाधिकारी चुपचाप उनके मेहनत का पैसा डकार रहे है। श्रमिक इसके खिलाफ मुखर हुए तो उनको झूठे मुकदमों व नौकरी से हटाने का नोटिस थमा दिया गया आज 100 से ज्यादा श्रमिकों पर मुकद्दमे लगे हुये है।

सुरक्षा कर्मियों का कहना है कि हमें 3-4 महीने से वेतन नहीं मिला है और कम्पनी ने हमारा पी0एफ0 खाता नहीं खोला है। हमारे मांगने पर भी हमें पी0एफ0 नम्बर नहीं दिया जा रहा है।

ठेकेदारों का भी भुगतान समय पर व पूरा भुगतान न होने के कारण ठेकेदार ने कम्पनी की कार्य शैली से सन्तुष्ट नहीं है। सबसे ज्यादा नुकसान सप्लायरों का हो रहा है। सप्लायरों का करोड़ों रूपये कम्पनी के पास फंसे हुए है। प्रश्न है कि क्या स्वंय कम्पनी की आर्थिक स्थिति अत्यधिक खराब है? सूत्रों का माने तो कम्पनी के खुद के स्टाफ का वेतन भी लगभग 3 महीने से नही मिला है। ऐसे में लोगों को चिन्ता सता रही हैं कि कम्पनी कहीं यहां से भाग न जाय। कर्मचारियों व ठेकेदारों के मन में संशय बना हुआ है। उन्हें अपना पैसा डूबने की चिंता सता रही है।

टी.एच.डी.सी. व विश्व बैंक इस पूरे प्रकरण पर चुप्पी साधे हुए है। इनकी चुप्पी भी कई प्रश्न खडे़ कर रही है। एच0सी0सी0 कम्पनी की तानाशाही नीति पर सब मौन है। एच0सी0सी0 कंपनी के फोन पर प्रशासन धरना स्थल पर पुलिस फोर्स मुस्तैद कर देती है लेकिन श्रमिकों की सुनने वाला कोई नहीं है।

विश्व बैंक द्वारा वित्त पोषिक परियोजना में श्रमिकों व कार्य कर रहे बेरोजगारों की खराब स्थिति विश्व बैक की कार्यप्रणाली पर सवाल खडे हुए है। श्रमिकों के हकों अधिकारों की रक्षा होनी चाहिए। विश्व बैंक सिर्फ लोन का पैंसा देने व उस पर लोन पर ब्याज वसूलने तक सीमित रह गया है। ये श्रमिक भी भारत देश के ही है इन्ही के मेहनत के पैंसो से यह ब्याज व लोन चुकाया जाना है। विस्थापितों/प्रभावितों के काम रोकने पर तो बांध कंपनी करोड़ो का नुकसान होने का हल्ला मचा देती है और विस्थापितों/प्रभावितों को तुरंत नोटिस थमा दिया जाता है। आज लगभग 100 विस्थापितों/प्रभावितों को अदालत के चक्कर काटने पड़ रहे है। मगर अपने ही कर्मचारियों/श्रमिकों के साथ भी अन्यायपूर्ण व्यवहार व उनकी भी जायज मांगों को नकाराना ये ही बताता है कि पुनर्वास व पर्यावरण मानको के उलंघन के साथ टी.एच.डी.सी. व विश्व बैंक को बांध निर्माण में लगे श्रमिकों की भी चिंता नही है। उनके अधिकारों को भी छीना जा रहा है।

ये श्रमिक भी भारत देश के ही है इन्ही की मेहनत के पैंसो से विश्व बैंक का ब्याज व कर्जा चुकाया जाना है। बांध कार्य में देरी की तोहमत बांध विरोधी आंदोलन पर लगाई जाती है। पर इस हड़ताल के कारण हो रही देरी की भरपाई कहां से होगी? कौन करेगा? देश का पैसा एक कम्पनी हाथों से इस तरह से बर्बाद किया जा रहा है इसका जिम्मेदार कौन रहेगा? टी.एच.डी.सी. व विश्व बैंक इस तरह गैरजिम्मेदाराना व्यवहार पर एच0सी0सी0 कंपनी पर क्यों नही कोई कार्यवाही करता? प्रशासन क्यों विस्थापितों/प्रभावितों व श्रमिकों के सामने विश्व बैंक व टी.एच.डी.सी. और उसकी सहायक कंपनियों के साथ खड़ा दिखता हैै?

इन प्रश्नों का हल समय पर होना ही चाहिये। सरकार समय रहते एच0सी0सी0 कम्पनी पर कडी कार्यवाही करें अन्यथा इसका परिणाम और भयावह होता जायेगा।

Women from distant villages came in huge numbers to extend their support to the Dam labourers strike and stopped the construction of the dam by the companies. According to them, firstly, the dam destroyed their shelter hindering their lives and now it is creating problems on the livelihood and occupation they have.

The labourers of Hindustan Construction company, the constructors of the Vishnughat Hydroelectricity Project Peepalkoti (444 MW) started the strike on the 18^th of april 2016 and has been going on since then. It is a labour stirke. The employed security persons of the companies have also taken part in the strike since the 17^th of May of 2016. On one side the labourers and the security persons have led the strike and now the employees of the company have decided to take part in the strike. The company has now been surrounded by strike.

The demands of the labourers are – False cases and the employees who have been dismissed on false allegations should be brought back; even if the construction of the dam stops or reduces, the salaries of the labourers should not be cut down; the salaries should be given by the 10^th of every month; and to stop the cut from the salaries for the Union which has been made by the company; an office area should be given to the new union.

The labourers feel that the company's federation is exploiting the labourers. The federation is taking away the hard earned money of them. When the labourers went against the same the labourers were dismissed on the basis of false allegations and now over 100 have been dismissed till this date.

The security persons say that the companies have not promised them anything since 3- 4 months and even after demands the Provident Fund accounts have not yet been opened for them.

As a result of lack of payments to the suppliers/contractors, they are not satisfied with the company. The suppliers have the maximum loss in the same. The suppliers are still to be paid crores of rupees by the companies. They are concerned if the companies have enough money to pay them back? According to sources the employees of the company are also yet to be paid 3 months of salary. The employees as well as the suppliers are scared if the company would elope due to the lack of funds and their money wont be paid back.

THDC and World bank are hidden in this incident. The lack of answers and inactivity from the company and the World Bank has led to tension among employees and suppliers. People have been silent over the HCC's dictatory policies. The complaints of the HCC are heard by the police even on the phones but the voices of the people are still unheard.

The employees in the project funded by the World Bank and the silence of the World Bank over the issues concerning the poor and the unemployed has raised questions on its role in the welfare of the people. The rights of the labourers should be guarded and ensured. The role of the World Bank has been limited to giving out loans and taking back the money with interests. Even these labourers are part of the motherland and deserve rights over their hard earned money through which loans are fulfilled. Whenever protests are organised by the displaced families they are accussed of causing loss amounting to crores and are issued notices immediately. Even today almost 100 displaced families are still knocking the doors of the courts. The rights of their own employees and labourers are taken away and the companies don't bother about their welfare which shows that the companies and the World Bank funded dams constructed for development do not care about their about employees.

The companies and the government accuse the protesters (labourers/employees/displaced people) or the people against dams for the hault and delay to the construction works of the dams. Who will take the losses caused due to the strike? How will it be done? The companies are destroying the money of the country who will take responsibility for the same?Why doesn't the world bank and the THDC question the HCC over irresponsibilities in the project. Why does the government stand with companies and the world bank infront of the displaced people and the labourers?

These questions should be answered at the right time. The government should investigate about the functioning of the HCC company or else the seriousness of the issue would increase drastically.

Case in National Green Tribunal on the issue of environmental violation. {Dumping of the construction debris directly into the river}

“We make it clear that in the event of default, the MD of the Corporation would be liable and would be dealt with in accordance with law.” Said the in the order given by NATIONAL GREEN TRIBUNAL in the case of Vimal Bhai Vs. Tehri Hydro Development Corporation, Ministry of Environment, Forest and climate change and Government of Uttarakhand.

The case was heard by the Principal Bench of NGT in New Delhi on 13^th May, 2016. Advocate Rahul Chowdhary from LIFE organization argued the case on behalf of Appellant.

Respondents pray for time to file the Reply, tribunal gave two weeks from 13^th itself to submitted the reply ‘with advance copies to the Learned counsel appearing for the Applicant who may file Rejoinder thereto, if any, within two weeks thereafter.’

Nest date of hearing will be on 13th July, 2016. Hon’ble Bach said “In the meanwhile, we restrain Respondent No. 1 {THDC} from throwing any building material or muck into the river Alaknanda or on the banks thereof. We make it clear that in the event of default, the MD of the Corporation would be liable and would be dealt with in accordance with law.”

The case was filed on the ground of Alaknanda River is getting polluted due to disposing of the debris generated from the construction of the road near the site of Vishnugad-Peepalkoti HEP. THDC is disposing the debris and muck coming from the construction of the HEP straight away into the Alaknanda river. THDC is bound to comply the Environmental Clearance conditions stipulated in letter Dated 22-8-2007. They are also bound to comply Environment Management Plan provided in Comprehensive Environmental Impact Assessment for Vishnugad-Pipalkoti Hydro Electric Power Project, as it was the basis of obtaining Environment Clearance of the project. It is necessary to make the retaining wall so that the construction debris does not get mixed with the flow of the river. Such illegal dumping is also endangering the life and property of the people living in the downstream area of the river. The hydrology and aquatic life of the River Alaknanda is getting disturbed due to dumping of the construction debris directly into the river and irreparable damage is being caused to the river. There is an emerging need to restore the Alaknanda River into its original form after it was badly hit by the floods of 2013.

NO need to say that Appellant went in the NGT after rasing the environment violation issue in front of THDC, Ministry of Environment, Forest and climate change also with information to World Bank.

Also no need to mention that it revealed the claims of World Bank’s “Best safeguard policy for Rehabilitation and Environment” for the Vishnugad-Peepalkoti HEP of Uttarakhand.
