Ref: Rivers health in danger:
Violation of Environment norms in Hydro Electric Project and others of Uttarakhand

Dear Sirs,
Since some years we, Matu jansangthan are raising the issues related with Hydro Electric Projects in Uttarakhand with your offices. But till today we have not seen any serious attempt from your office to address these issues.
Today the situation of Rivers have become frightening. Due to HEPs rivers are already in danger. Most of the course of river are in the tunnels or in the reservoir. After the HEPs rivers have become dumping areas of muck and garbage. Before HEPs the health of rivers was not as bad as it is in today's Uttarakhand. HEPs companies are putting muck in the Rivers, and this can be seen any where in HEPs areas. This has been happening in complete disregard of their Environment Clearances (EC).
There is no monitoring whatsoever of the water quantity in the river after diversion of river into the tunnels run-off the river HEPs or in the down stream of the reservoir HEPs.
AND the garbage on Tehri Dam reservoir is unbearable. Now the Bhagirathiganga water has become untouchable for the people living around the reservoir. It is both tragic and pathetic that the same water is being supplied to the New Tehri Town. This again is a violation of its EC, which says that there needs to be a master plan for the oustees. We are forced to ask: Is this is the master plan?
Also due to widening the roads by Border Road Organisation and other, all the excavation are putting in the river without taking care of any environment rule.
For example we are attaching some of the pix and giving you-tube links from the Bhagirathiganga Valley where you can easily see and understand the situation.

We hope and demand from you:-
  • Take serious action on the violations pointed out above by this communication and restore the rivers health.
  • Take action and fix liability of the culprit HEPs and other companies.
  • Evolve and put in place a permanent monitoring mechanism at your end so that such monitoring is not dependent on reports furnished by the involved HEPs, (You may note that this is mandatory legal requirement in their ECs) and such a mechanism ensures that in future HEPs companies do not take advantage by making rivers a dumping area of muck and other garbage.

Green Tribunal notice to Ministry on power project in Uttarakhand

(Under construction Srinagar HEP was initially got environment clearance of 200 MW but now build for 330 MW, with taking environment clearance, no public hearing etc. violation after violation. Photo-Matu)

After suspending the clearance to POSCO steel project in Odisha, the
National Green Tribunal has now issued a notice to the Union
Environment Ministry and sought its response on a plea seeking stay of
work on the 200 MW Srinagar Hydroelectric Power Project in
Uttarakhand’s Garhwal region.

The tribunal, that is giving a difficult time to the Government with
its uncompromising stand on environmental issues, has sought a
response from the Ministry of Environment and Forests (MoEF),
Uttarakhand Government and Alaknanda Hydro Power Co Ltd (AHPCL) by
April 19 on the plea. The petition also sought that the project on
river Alaknanda be suitably redesigned.

“Issue notice (to the respondents) indicating that the matter shall be
disposed off at the stage of admission,” the bench of tribunal headed
by its acting chairperson Justice A Suryanarayan Naidu said.

The order came on a plea filed by environmental activist Vimal Bhai
and former IIM-Bangalore professor-cum-economist Bharat Jhunjhunwala.
The petition sought stay of work on the project and a direction to
“redesign” it so as to “maintain free flow of the river in part of the
river bed” and to reduce the negative impact on forest and ecology of
the region.

Jhunjhunwala, who argued the matter in person before the bench, sought
a direction to “quash the power purchase agreement” of AHPCL with UP
Power Corporation and to direct AHPCL to supply the generated power to
local area by making a fresh agreement with Uttarakhand Power Corp.

He sought stay on construction work of project till the catchment area
treatment work and green belt work is completed up to four years. The
MoEF had granted environmental clearance to the Uttar Pradesh State
Electricity Board on May 3, 1985 for setting up the 200 MW project.
The petitioner alleged that MoEF has not taken any decision on the
representations submitted to it and on the submissions made during
personal hearing.”

It said MoEF “has, by inaction, allowed construction work to continue
in violation of its own orders and abetted and wilfully connived in
allowing violation of conditions of environment clearance and practice
of unsustainable development”.

Press Note 26-2-2012

People are agitating against Dams at Pipalkoti (Vishnugad-Pipalkoti HEP, 444 MW) on 14th March 2012, on the occasion of Anti Big Dam Week 14 to 22 March, 2012

Urgent Press Note: Green Tribunal Stays use of forest land for Alaknanda-Badrinath HEP in Uttarakhand

15-02-2012

Alaknanda-Badrinath HEP (300 MW)
River- Alaknandaganga
Agancy: GMR Energy Limited

On 15th National Green Tribunal has ordered that no trees on the forest land proposed to be diverted for the 300 MW Alaknanda (Badrinath) Hydropower project in Uttarakhand be cut without the prior permission of the Tribunal. This was in response to an appeal (no 7/2012 dated 31-1-12) filed by Vimal Bhai of Matu Jansangthan and Dr. Bharat Jhunjhunwala, challenging the forest clearance given by the Union Ministry of Environment and Forest on Nov 8, 2011.
It may be recalled that the Union Ministry of Environment and Forest had over ruled the decision of the Forest Advisory Committee to twice reject the forest clearance to the project in their meetings on May 30-31, 2011 and Oct 12, 2011. The Wildlife Institute of India (WII), through a report commissioned by the ministry had also recommended that the project should not be taken up considering the serious nature of impacts due to the projects. WII has concluded, on the basis of which Forest Advisory Committee has taken the decision, that “Alaknanda-Badrinath and Kotlibhel IB support significant ecological/wildlife values that include irreplaceable components. Any form of development in these areas will have irreversible and un-mitigable negative impacts on these values.”
The Alaknanda-Badrinath hydro project is located in the buffer zone of Nanda Devi Biosphere Reserve which has two core zones the Nanda Devi National Park (NP) and Valley of Flowers NP. Both the core zones are inscribed as UNESCO World Heritage Site. Also it is very close to the prestigious God Badrinath Temple. The ecological sensitive region is at the height of more than 2800 meters and very close to glacier.

NGT Order dated 15-2-12 says:
"Heard Mr. Dutta, Learned Counsel for Appellant. The case is admitted subject to limitation. Issue Notice to Respondents. Requisites shall be filed within 5 days. An extra copy be served upon Ms. Neelam Rathore, who usually appears for Respondent No. 1 (MoEF ). She is also directed to file the reply of MoEF by next date. List this matter on21st March, 2012. In the meanwhile, no trees existing on forest land proposed to be diverted shall be felled without obtaining prior permission of this Tribunal.

It is also recalled here that the Environment Clearance dated 12-03-2008 of this project was challenged in the then National Environment Appellate Authority (NEAA) {the then authority where environment clearance could be challenged} by Matu Jansangthan in 29-07-2008 appeal No. (FR) 7/2008 but has not been entertained by NEAA as it was outside the time limitation by its order dated 08-08-2008.
